Lawfare is a complex and evolving concept with many permutations. It is a term that is used to describe both a judicialisation of politics where the Constitutional Court is called upon to uphold constitutional responsibilities, compensating for institutional failures in the broader democratic space, and instances where there is abuse of the legal process to escape accountability. When the court is dragged into politics, it forces an examination of the legitimate scope of judicial review. This book explains how judicialisation of politics leads to the politicisation of adjudication and further weaponisation of the law. Exploring the judicial-political dynamics of South Africa from 2009 onwards, the work traces the consequences of the judicialisation of politics for institutional resilience and broader constitutional stability. Through an in-depth study of judicial legitimacy, the book seeks to provide an overarching theoretical justification for the dangers that inhere in lawfare. It analyses the potential costs of both judicial statesmanship and strategies of deference and avoidance when trying to navigate the Court safely through the era of lawfare. South Africa offers an interesting crucible within which to observe an unfolding global trend. Strengthened by its comparative focus, the implications of lawfare presented in this book transcend the South African context and are applicable to other jurisdictions in the world. Few medieval or Renaissance political writers, male or female, wrote more works on politics than Christine de Pizan; none of them addressed audiences so varied in class or gender. Yet until now there has been no comprehensive full-length study of Christine de Pizan's political thought. With The Political Theory of Christine de Pizan, Kate Forhan rectifies this oversight, situating de Pizan in the history of political thought while discussing traditional concerns of political theorists, such as justice, obligation, law, equality, and just war. Forhan also addresses the question of whether Pizan's work is original or derivative; whether she is a theorist or "merely" a political writer. Between 1400 and 1429, at a time of great civil strife in France, Christine de Pizan wrote ten books for the instruction and guidance of those engaged in political life. Her theory is focused on a "politics of inclusion," which validates the essential contribution of each member of the body politic to the whole, despite socially and politically mandated difference of class, nationality, and gender-ideas not without significance to the modern era. As Forhan demonstrates through analysis of her work, the thought of Christine de Pizan has true relevance for modern times. First, hers was a society in transition: new class structures, new occupations, and new aspirations were appearing behind the crumbling structures of the late medieval world. Secondly, Christine de Pizan was an outsider; a woman in a world dominated by men, an Italian in France, a member of the "meritocracy" at a court that was rigidly hierarchical. Her "difference" gave her the perspective to observe her society objectively. Her personal vulnerability allowed her to see politics more clearly, as those who are most vulnerable might see our own. Thirdly, she was a shrewd observer in a country that was emerging as a nation-state, where new concepts and practices of law, justice, administration, and politics in general were in the process of development. This book will be of interest to political theorists and political scientists; medieval historians; historians of women and gender; and scholars of comparative literature.

This book looks at how civil society negotiates power on a global stage, under Russia's authoritarian regime, and in a particularly isolated and remote part of the world: within environmental activism around Lake Baikal in Siberia. More than a mile deep, Lake Baikal is the oldest, deepest, and most voluminous lake on the Earth, and home to thousands of endemic species. It is also ecologically unique in that it is oxygenated to its maximum depth and supports life even at the lake floor -- a phenomenon occurring nowhere else on the planet. The lake is not just a natural wonder, but home to a strong environmentalist community that works tirelessly to protect the lake from human harm. Environmentalism at Baikal began in the late 1950s, eventually igniting the first national protest in the USSR. They have remained active in some form ever since, across the years of chaos, instability, and crisis, from the opening of Russia to the forces of globalization to the authoritarianism of Putin in the present. This book examines the struggle of Baikal environmentalists to develop a new understanding of civil society under conditions of globalization and authoritarianism. Through extended, historically-informed ethnographic analysis, Kate Pride Brown argues that civil society is engaged with political and economic elites in a dynamic struggle within a field of power. Understanding the field of power helps to explain a number of contradictions. For example, why does civil society seem to both bolster democracy and threaten it? Why do capitalist corporations and environmental organizations form partnerships despite their general hostility toward each other? And why has democracy proven to be so elusive in Russia? The field of power posits new answers to these questions, as Baikal environmental activists struggle to protect and save their Sacred Sea.
