The book begins by analyzing the theory of executive emergency power across a wide breadth of philosophical history, from Ancient Greek, Renaissance, through modern American political thought. This analysis indicates that in political philosophy two models exist for determining and using executive emergency power: an unfettered executive prerogative or a constitutional dictatorship. The modern American approach to executive emergency power is an unfettered executive prerogative, whereby the executive determines what emergency power is and how to use it. The book addresses the fundamental question of whether executive power in times of crisis may be unfettered and discretionary or rather does the law define and restrain executive emergency power. The author reviews and analyzes seven U.S. presidencies that handled a domestic crisis—Washington, Jefferson, Madison, Jackson, Lincoln, G. W. Bush, and Obama—to show that presidents become extraordinarily powerful during crises and act unilaterally without oversight. The use of executive emergency power undermines the normal processes of democratic republicanism and harms the rule of law. The author analyzes the U.S. Constitution, formerly classified Department of Justice Memos, primary sourced letters, signing statements, executive orders, presidential decrees, and original founding documents to comprehensively conclude that presidential prerogative determines what emergency powers are and how they are to be executed. This book challenges the claim that presidents determine their emergency power with appropriate congressional oversight or consultation. Modern Monetary Theory and Distributive Justice shows how the macroeconomic framework called modern money theory (MMT) is relevant to the field of political philosophy called distributive justice. Many of the macroeconomic assumptions of distributive justice are unstated and unexamined. The framework of MMT illuminates these assumptions and provides an alternative vision of distributive justice analysis and prescriptions. In particular, MMT holds that modern money is a nominal state issued token (fiat), there is a distinction between nominal assets and real assets, that state money as a nominal token can cause changes in real terms, and that the macroeconomy has historically not operated at capacity. The upshot of these assumptions held by MMT is that state spending can bring about changes in persons’ well-being without traditional redistributive measures via taxation. This is in contradistinction to standard assumptions in the distributive justice literature, which holds that the macroeconomy is at capacity and, thus, redistribution is the necessary mechanism for enacting improvements in well-being. This is a fundamental shift in how distributive justice can be conceived.
This book examines the use of presidential power during the War on Terror. Justin DePlato joins the debate on whether the Constitution matters in determining how each branch of the federal government should use its power to combat the War on Terror. The actions and words of Presidents George W. Bush and Barack Obama are examined. DePlato's findings support the theory that executives use their own prerogative in determining what emergency powers are and how to use them. According to DePlato, the Presidents argue that their powers are implied in Article II of the Constitution, not expressed. This conclusion renders the Constitution meaningless in times of crisis. The author reveals that Presidents are becoming increasingly cavalier and that the nation should consider adopting an amendment to the Constitution to proffer expressed executive emergency powers.
Universities across the US have committed to a process of neoliberalization that is radically altering higher education: academia is increasingly being run like a business. As a result, the university is becoming less and less a place of wonder, self-cultivation and thinking and instead is becoming more and more a place to specialize, strategize, produce and profit. Students race through coursework to bolster job prospects while facing massive debt. Faculty scramble for the biggest grants and angle for the most prestigious journals. Sink or swim, publish or perish, triumph and win: there is no longer time to think and to wonder. This undermines the opportunity for students to develop into good citizens that can truly think critically and judge carefully. Thinking and judgment are, according to the philosopher Hannah Arendt, the only things that can save us if the powerful machines of science or capitalism begin to work in ways they should not. Arendt saw Nazi Germany use the newest science and the best economic management to systematically kill six million Jews. She saw the disturbing inability of the populace and the intellectuals to capably resist the Nazi machine once it got rolling. Applying Arendt’s insights to modern academia, Pack argues that unless checked, neoliberalization threatens to turn the university into a place that discourages thinking and the development of judgment in favor of hyper-specialization and strategic action.

These systems incorporated a more mature idea of the divine than Plato, but still minimized the material world. This book explores how early Christianity inherited Plato’s cosmology and terminology. Theoria was also reinterpreted within the Christian context. Eventually the term was abandoned for theosis. Theosis is beyond theoria, as it includes contemplation of the forms as well as union with the source of the forms and the affirmation of the material realm. In this volume, Justin A. Davis shows how the Orthodox use of icons can be key to understanding theosis. The icon is a material object that connects to a higher reality, and ultimately toward union with the divine. Plato’s cosmology is collapsed and transfigured in union with the uncreated energy of God. Icons are the depiction of spiritual ascesis and the new telos of man, theosis.

The Temporality of Political Obligation offers a critique and reconceptualization of the ways in which our political obligations – what we owe to political authorities and communities, and the reasons why we ought to obey their rules – have been traditionally conceptualized, justified, and contested. Drawing from theories of time and temporality, Justin Mueller demonstrates some of the unacknowledged assumptions and theoretical blind spots shared among these ostensibly opposed positions, and the problems and contradictions that this neglect of time poses. In each of Plato’s “dialogues of definition” (Euthyphro, Laches, Meno, Charmides, Lysis, Republic I, Hippias Major), Socrates motivates philosophical discussion by posing a question of the form “What is F-ness?” Yet these dialogues are notorious for coming up empty. Socrates’ interlocutors repeatedly fail to deliver satisfactory answers. Thus, the dialogues of definition are often considered negative— empty of any positive philosophical content. Justin C. Clark resists the negative reading, arguing that the dialogues of definition contain positive “Socratic” answers. In order to see the positive theory, however, one must recognize what Clark calls the "dual function" of the “What is F-ness?” question. Socrates is not looking for a single type of answer. Rather, Socrates is looking for two distinct types of answers. The “What is F-ness?” question serves as a springboard for two types of investigation— conceptual and causal. The key to understanding any of the dialogues of definition, therefore, is to decipher between them. Clark offers a way to do just that, at once resolving interpretive issues in Socratic philosophy, providing systematic interpretations of the negative endings, and generating important new readings of the Charmides and Lysis, whilst casting further doubt on the authenticity of the Hippias Major.

This work provides an exhaustive look at Friedrich Schleiermacher, the father of modern liberal Protestantism, and Phoebe Palmer, the mother of the Holiness movement. The trend of liberalism is to strip away all but what is essential to Christian life, while the Holiness movement sought to make all of life applicable to the Bible and God. While these two movements may appear contradictory, they are grounded in a shared source of experiential Protestantism, commonly known as Pietism, and develop their theological systems from this starting point. In the contemporary domain of American legal thought there is a dominant way in which lawyers and judges craft their argumentative practice. More colloquially, this is a dominant conception of what it means to 'think like a lawyer'. Despite the widespread popularity of this conception, it is rarely described in detail or given a name. Justin Desautels-Stein tells the story of how and why this happened, and why it matters. Drawing upon and updating the work of Harvard Law School's first generation of critical legal studies, Desautels-Stein develops what he calls a jurisprudence of style. In doing so, he uncovers the intellectual alliance, first emerging at the end of the nineteenth century and maturing in the last third of the twentieth century, between American pragmatism and liberal legal thought. It is widely claimed that notions of gods and religious beliefs are irrelevant or inconsequential to early Chinese (“Confucian”) moral and political thought. Rejecting the claim that religious practice plays a minimal philosophical role, Kelly James Clark and Justin Winslett offer a textual study that maps the religious terrain of early Chinese texts. They analyze the pantheon of extrahumans, from high gods to ancestor spirits, discussing their various representations, as well as examining conceptions of the afterlife and religious ritual. Demonstrating that religious beliefs in early China are both textually endorsed and ritually embodied, this book goes on to show how gods, ancestors and afterlife are philosophically salient. The summative chapter on the role of religious ritual in moral formation shows how religion forms a complex philosophical system capable of informing moral, social, and political conditions.
First Published in 2004. Since before Plato, philosophers have puzzled over why it is that people will sometimes deliberately take the worst course of action. The book begins by examining the various theories put forward by Plato, Aristotle, the Stoics and a selection of medieval philosophers and discusses how and why later philosophers avoid the problem. In the second section, Justin Gosling argues that familiar ways of viewing the problem mislocate the apparent irrationality of weakness. The author then moves on to the traditional cases of being overcome by passion to argue for a further sense in which weakness may be thought irrational, and to open up an unusually wide field of examples for consideration.
In this book, Justin Pack proposes a genealogy of the traditional suspicion of money and merchants. This genealogy is framed both by how money itself has changed and how different traditions responded to money. Money and merchants became heavily debated concerns in the Axial Age, which coincided with the spread of coinage. A deep suspicion of money and merchants was particularly notable in the Greek, Confucian and Christian traditions, and continued into the Middle Ages. These traditions wrestled with a new dialectic of purity that also appears with the widespread use of money. How were these concerns dealt with politically, socially and philosophically? How did they change over time? How did medieval Europe deal with money and how did this inform modern governmentality? To answer these questions, Pack turns to Hanna Arendt’s work. Arendt argues that one of the outstanding characteristics of our time is thoughtlessness. This thoughtlessness is related to how modern life, especially under neoliberalism, is increasingly structured by abstract systems, abstract calculative rationality, abstract relations, and the profit motive. Money both drives and embodies this machinery. The hyper-complex abstract systems of modernity discourage, to use Arendtian terms, “thinking” (wonder, questioning everything) in favor of “cognition” (problem solving). Too often the result is thoughtless cognition—the ability to make things more productive and efficient paired with the incapacity to question and challenge the implications and morality of these systems.
