This book examines the prospects for business law reform to drive economic development in developing countries. It argues that, despite statements to the contrary, cultural factors and other local conditions in developing countries are not properly taken into account in current business law reform programs. Utilizing the city of Dakar as an example, this book investigates the consequences of this lack of fit between local needs and transplanted legal models by examining the potential and actual impact of the OHADA program of law reform on local business practices. Focusing on how managers make decisions and apply appropriate norms in routine business operations, the book documents how contractual disputes arise and are solved in Dakar and the role played by formal law in these processes. By examining imported law from the point of view of the end-users of legal reforms, the book reveals the complex relationship between formal law, local cultural norms and the activities of SMEs operating in developing economies, and calls for a reconsideration of current law and development theory as well as the role of contract law in business decisions. 'As Birmingham goes, so goes the nation,' Fred Shuttlesworth observed when he invited Martin Luther King Jr. to the city for the transformative protests of 1963. From the height of the civil rights movement through its long aftermath, the images of police dogs and fire hoses turned against protestors, and the four girls murdered when Ku Klux Klan members bombed the Sixteenth Street Baptist Church, made the city an uncomfortable racial mirror for the nation. But like many white people who came of age in the civil rights movement's wake, Julie Buckner Armstrong knew little about her hometown's history growing up with her single, working class mother in 1960s and 70s. It was only after moving away and discovering writers like Toni Morrison and Alice Walker that she began to realize that her hometown and her family were part of a larger story of racial injustice and struggle. In recent years, however, Birmingham has rebranded itself as a vibrant, diverse destination for civil rights heritage tourism. Former sites of violence have been transformed into a large moving National Park Service memorial complex that includes a museum, public art, churches, and multiple walking tours. But beyond the tourist map, one can see in Birmingham--just like Anytown, USA--a new Jim Crow reemerging in the place where the old one supposedly died. Returning home decades later to care for her aging mother, Shuttlesworth's admonition rang in her mind. By then an accomplished scholar and civil rights educator, Armstrong found herself pondering the lessons Birmingham has for America in the twenty-first century, where a 2014 Teaching Tolerance report characterized a common understanding of the civil rights movement in "two names and four words: Martin Luther King Jr, Rosa Parks, and 'I have a dream.'" Seeking to better understand her hometown's complicated history, its connection to other stories of oppression and resistance, and her own place in relation to it, Armstrong embarked on a journey to unravel the standard Birmingham narrative to see what she would find instead. Beginning at the center, with her family's arrival in 1947 in a neighborhood near the color line, within earshot of what would become known as Dynamite Hill, Armstrong works her way out in time and across the map. Nearly half of the world's eight million Palestinians are registered refugees, having faced partition and exile. Landscape of Hope and Despair examines this refugee experience in Lebanon through the medium of spatial practices and identity, set against the backdrop of prolonged violence. Julie Peteet explores how Palestinians have dealt with their experience as refugees by focusing attention on how a distinctive Palestinian identity has emerged from and been informed by fifty years of refugee history. Concentrating ethnographic scrutiny on a site-specific experience allows the author to shed light on the mutually constitutive character of place and cultural identification. Palestinian refugee camps are contradictory places: sites of grim despair but also of hope and creativity. Within these cramped spaces, refugees have crafted new worlds of meaning and visions of the possible in politics. In the process, their historical predicament was a point of departure for social action and thus became radically transformed. Beginning with the calamity of 1948, Landscape of Hope and Despair traces the dialectic of place and cultural identification through the initial despair of the 1950s and early 1960s to the tumultuous days of the resistance and the violence of the Lebanese civil war and its aftermath. Most significantly, this study invokes space, place, and identity to construct an alternative to the received national narratives of Palestinian society and history. The moving stories told here form a larger picture of these refugees as a people struggling to recreate their sense of place and identity and add meaning to their surroundings through the use of culture and memory.
