From the 1820s to the 1930s, Christian missionaries and federal agents launched a continent-wide assault against Indian sacred dance, song, ceremony, and healing ritual in an attempt to transform Indian peoples into American citizens. In the early 1980s, however, a salary cap was not only novel but nonexistent. A retelling of American modernism through the lines of solidarity and division within and among ethnic and religious identities found in poetry. What happens if we approach the reading and writing of poetry not as an individual act, but as a public one? Answering this question challenges common assumptions about modern poetry and requires that we explore the important questions that define genre: Where is this poem situated, and how did it get there? Joshua Logan Wall's Situating Poetry studies five poets of the New York literary scene rarely considered together: James Weldon Johnson, Charles Reznikoff, Lola Ridge, Louis Zukofsky, and Robert Hayden. Charting their works and careers from 1910–1940, Wall illustrates how these politically marginalized writers from drastically different religious backgrounds wrestled with their status as American outsiders. These poets produced a secularized version of America in which poetry, rather than God, governed individual obligations to one another across multiethnic barriers. Adopting a multiethnic and pluralist approach, Wall argues that each of these poets—two Black, two Jewish, and one Irish-American anarchist—shares a desire to create more truly democratic communities through art and through the covenantal publics created by their poems despite otherwise sitting uncomfortably, at best, within a more standard literary history. In this unique account of American modernist poetics, religious pluralism creates a lens through which to consider the bounds of solidarity and division within and among ethnic identities and their corresponding literatures.
Joshua Gert presents an original account of color properties, and of our perception of them. He employs a general philosophical strategy - neo-pragmatism - which challenges an assumption made by virtually all other theories of color. Neo-pragmatism rejects the standard representationalist strategy for solving "placement problems" in philosophy, which relies on the existence of a substantive notion of reference and truth. Instead, it makes use of deflationary accounts of such semantic notions. Applied to the domain of color, the result is a view according to which colors are primitive properties of objects, irreducible to physical or dispositional properties. In this way they are more like numbers, and less like natural kinds such as water or gold. Objective colors are also - contrary to current dogma - insufficiently determinate in their nature to allow them to be associated with precise points in standard color spaces. A given color can present different veridical appearances in different viewing circumstances, and to different normal viewers. It is these appearances, which are to be understood in an adverbial way, that can be located in standard color spaces. In explaining the distinction between objective color and color appearance, a central analogy to which Gert appeals is that between the perceptible three-dimensional shape of an object, and the various ways in which that shape appears from various perspectives. Primitive Colors also offers an account of color constancy, a moderated version of representationalism about visual experience, and a criticism of the thesis of the transparency of experience.
In 1987 Judge Russell Clark mandated tax increases to help pay for improvements to the Kansas City, Missouri, School District in an effort to lure white students and quality teachers back to the inner-city district. Yet even after increasing employee salaries and constructing elaborate facilities at a cost of more than $2 billion, the district remained overwhelmingly segregated and student achievement remained far below national averages. Just eight years later the U.S. Supreme Court began reversing these initiatives, signifying a major retreat from Brown v. Board of Education. In Kansas City, African American families opposed to the district court's efforts organized a takeover of the school board and requested that the court case be closed. Joshua Dunn argues that Judge Clark's ruling was not the result of tyrannical "judicial activism" but was rather the logical outcome of previous contradictory Supreme Court doctrines. High Court decisions, Dunn explains, necessarily limit the policy choices available to lower court judges, introducing complications the Supreme Court would not anticipate. He demonstrates that the Kansas City case is a model lesson for the types of problems that develop for lower courts in any area in which the Supreme Court attempts to create significant change. Dunn's exploration of this landmark case deepens our understanding of when courts can and cannot successfully create and manage public policy.

According to a dichotomy commonly found in studies of American Indians, some noble Native people defiantly defend their pristine indigenous traditions in honor of their ancestors, while others in weakness or greed surrender their culture and identities to white American economies and institutions. This traditionalist-versus-assimilationist divide is, Joshua B. Nelson argues, a false one. To make his case that American Indians rarely if ever conform to such simplistic identifications, Nelson considers the literature and culture of many Cherokee people. Exploring a range of linked cultural practices and beliefs through the works of Cherokee thinkers and writers from the nineteenth century to today, Nelson finds ample evidence that tradition can survive through times of radical change: Cherokees do their cultural work both in progressively traditional and traditionally progressive ways. Studying individuals previously deemed either “traditional” or “assimilationist,” Nelson presents a more nuanced interpretation. The colorful history of paper money before the Civil War Before Civil War greenbacks and a national bank network established a uniform federal currency in the United States, the proliferation of loosely regulated banks saturated the early American republic with upwards of 10,000 unique and legal bank notes. This number does not even include the plethora of counterfeit bills and the countless shinplasters of questionable legality issued by unregulated merchants, firms, and municipalities. Adding to the chaos was the idiosyncratic method for negotiating their value, an often manipulative face-to-face discussion consciously separated from any haggling over the price of the work, goods, or services for sale. In Bank Notes and Shinplasters, Joshua R. Greenberg shows how ordinary Americans accumulated and wielded the financial knowledge required to navigate interpersonal bank note transactions. Locating evidence of Americans grappling with their money in fiction, correspondence, newspapers, printed ephemera, government documents, legal cases, and even on the money itself, Greenberg argues Americans, by necessity, developed the ability to analyze the value of paper financial instruments, assess the strength of banking institutions, and even track legislative changes that might alter the rules of currency circulation. In his examination of the doodles, calculations, political screeds, and commercial stamps that ended up on bank bills, he connects the material culture of cash to financial, political, and intellectual history. The book demonstrates that the shift from state-regulated banks and private shinplaster producers to federally authorized paper money in the Civil War era led to the erasure of the skill, knowledge, and lived experience with banking that informed debates over economic policy. The end result, Greenberg writes, has been a diminished public understanding of how currency and the financial sector operate in our contemporary era, from the 2008 recession to the rise of Bitcoin.
This book is a judicial, military and political history of the period 1941 to 1954. As such, it is also a United States legal history of both World War II and the early Cold War. Civil liberties, mass conscription, expanded military jurisdiction, property rights, labor relations, and war crimes arising from the conflict were all issues to come before the federal judiciary during this period and well beyond since the Supreme Court and the lower courts heard appeals from the government’s wartime decisions well into the 1970s. A detailed study of the judiciary during World War II evidences that while the majority of the justices and judges determined appeals partly on the basis of enabling a large, disciplined, and reliable military to either deter or fight a third world war, there was a recognition of the existence of a tension between civil rights and liberties on the one side and military necessity on the other. While the majority of the judiciary tilted toward national security and deference to the military establishment, the judiciary’s recognition of this tension created a foundation for persons to challenge governmental narrowing of civil and individual rights after 1954. Kastenberg and Merriam present a clearer picture as to why the Court and the lower courts determined the issues before them in terms of external influences from both national and world-wide events. This book is also a study of civil-military relations in wartime so whilst legal scholars will find this study captivating, so will military and political historians, as well as political scientists and national security policy makers.
