This title was first published n 2000: The most recent developments in occupational health and safety regulation in the UK’s offshore oil industry represent a departure from traditional legal forms. But how should they best be understood and what advantages do they offer over the previous regulatory approaches? Informed by autopoiesis theory, this study takes seriously the notion of an empirical field constituted by diverse communicative systems and thus traces the development of the industry along a series of dimensions including those of management and engineering as well as of politics and regulation. Adapting cognitive mapping, the book offers graphic demonstrations of the resultant constructive misunderstandings of regulatory and scientific signals and accordingly an alternative perspective on the nature of risk. The latest regulatory developments are shown to possess the potential to address these issues but only insofar as they are understood as distinct from previous legal forms and in particular as an example of reflexive law.

Rather less well discussed has been the extremely complex form that such instruments have in fact taken in practice. Environmental Taxation Law: Policy, Contexts and Practice examines the legal implications of introducing environmental taxes and other economic instruments into the regulatory framework of UK law. In doing so, it analyzes and explains the difficulties of grafting environmental taxes onto the complexities of existing regulatory structures, not all of which, of course, were originally devised with environmental considerations in mind. Although the focus of the book is the UK's pioneering implementation of a web of distinct yet interrelated policy measures, it locates the UK's taxes and instruments not simply in their broader context of market and environmental regulation, but also in the contexts of European and international law.

Alongside his reputation as an author, H.G. Wells is also remembered as a leading political commentator of the late nineteenth and early twentieth centuries. Building Cosmopolis presents the worldview of Wells as developed between his student days at the Normal School of Science (1884-1887) and his death in 1946. During this time, Wells developed a unique political philosophy, grounded on the one hand in the theory of 'Ethical Evolution' as propounded by his professor, T.H. Huxley, and on the other in late Victorian socialism. From this basis Wells developed a worldview which rejected class struggle and nationalism and embraced global co-operation for the maintenance of peace and the advancement of the human species in a world society. Although committed to the idea of a world state, Wells became more antagonistic towards the nation state as a political unit during the carnage of the First World War. He began moving away from the position of an internationalist to one of a cosmopolitan in 1916, and throughout the inter-war period he advanced the notion of regional and, ultimately, functional world government to a greater and greater extent. Wells first demonstrated a functionalist society in Men Like Gods (1923) and further elaborated this system of government in most of his works, both fictional and non-fictional, throughout the rest of his life. Following an examination of the development of his political thought from inception to fruition, this study argues that Wells's political thoughts rank him alongside David Mitrany as one of the two founders of the functionalist school of international relations, an acknowledgement hitherto denied to Wells by scholars of world-government theory.

The events that took place on September 11th caused Dr. John Brighton, a naturopathic health consultant, to ask himself questions about what role natural forms of healing might have in a scenario involving weapons of mass destruction (WMD). As he examined the issues and the nature of the threat, he felt assured that a naturalistic approach could make a significant contribution in conjunction with that offered by conventional medicine. Moreover, he felt that to use both would provide a more powerful deterrent than if either were used alone. The naturalistic approach would augment the use of drugs by adding 5 extra lines of defense aimed at supporting and strengthening the immune system to deal with such a dire event. These lines include: A psychological dimension A social dimension A preventative dimension An environmental dimension A specific dimension The whole idea of this holistic strategy is to employ prevention and immune-enhancing factors in order to reduce the level of crisis to begin with. As a result, the dependency on antibiotics (there are no effective antivirals) and other valuable medical resources can be considerably reduced, and, most importantly, preserved for when they would be needed most. Another benefit of integrating these two systems would add what Dr. Brighton calls "synergistic complexity" as a way to reduce the current crisis of germ resistance to many most potent antibiotics and to provide a holistic approach to all forms of WMD. The book clarifies the scope of the threat we face by examining: The variety of biological, chemical, and nuclear threats The factors involved in the creation of WMD The uncanny capacity of microbes to develop resistance to our medications The threat of bioengineering and the creation of superbugs How synergistic complexity could provide a possible solution A chapter is dedicated to focusing on the specific nature and challenges posed by each biological, chemical and nuclear agent. This includes: A description of the agent How it causes harm How it might be used as a weapon, and the possibility of it being used How it is detected diagnostically and in the field The conventional method of care and treatment The suggested natural forms of defense including herbs, vitamins & minerals, and other natural substances and healing therapies. The book ends with a forward-looking chapter on emerging technologies that have promise of increasing our level of defense against WMD. A bibliography and a full section on resources are available.

A Historical and Comparative Perspective on English Public Law

The development of an autonomous English public law has been accompanied by persistent problems - a lack of systematic principles, dissatisfaction with judicial procedures, and uncertainty about the judicial role. It has provoked an ongoing debate on the very desirability of the distinctionbetween public and private law. In this debate, a historical and comparative perspective has been lacking. A Continental Distinction in the Common Law introduces such a perspective. It compares the recent emergence of a significant English distinction with the entrenchment of the traditional Frenchdistinction. It explains how persistent problems of English public law are related to fundamental differences between the English and French legal and political traditions, differences in their conception of the state administration, their approach to law, their separation of powers, and theirjudicial procedures in public-law cases. The author argues that a satisfactory distinction between public and private law depends on a particular legal and political context, a context which was evident in late nineteenth-century France and is absent in twentieth-century England. He concludes byidentifying the far-reaching theoretical, institutional, and procedural changes required to accommodate English public law.
