Hedge funds have become important players in the U.S. & global capital markets. These largely unregulated funds use: a variety of complex trading strategies & instruments, in their liberal use of leverage, in their opacity to outsiders, & in their convex compensation structure. These differences can exacerbate market failures associated with agency problems, externalities, & moral hazard. Counterparty credit risk mgmt. (CCRM) practices are the first line of defense against market disruptions with potential systemic consequences. This article examines how the unique nature of hedge funds may generate market failures that make CCRM for exposures to the funds intrinsically more difficult to manage, both for regulated institutions & for policymakers. The DoD¿s U.S. Army Corps of Engineers awarded the $2.5 billion Restore Iraqi Oil (RIO I) contract to Kellogg Brown & Root in March 2003 in an effort to re-establish Iraq¿s oil infrastructure, & to ensure adequate fuel supplies inside Iraq. RIO I was a cost-plus-award-fee type contract that provided for payment of the contractor¿s costs, a fixed fee determined at inception of the contract, & a potential award fee. The Defense Contract Audit Agency (DCAA) reviewed the 10 RIO I task orders & questioned $221 million in contractor costs. This report determines: how DoD addressed DCAA¿s RIO I audit findings & what factors contributed to DoD¿s decision; & the extent to which DoD paid award fees for RIO I & followed the planned process for making that decision. Ill.

The Copper River Delta (CRD) stretches 75 km. along the south-central coastline of Alaska. It is the terminus of the outwash deposits from a large part of the most heavily glaciated region of N. Amer., & all major rivers that flow into the delta carry high levels of suspended sediments. In 1964, a severe earthquake raised the entire delta from 1.8 to 3.4 meters above the previous mean sea level. Subtidal areas became intertidal, & intertidal areas supertidal. Vegetation on newly supertidal levees changed from herb to shrub. A change in frequency & duration of tidal inundation & water salinity is the most obvious cause. The uplift appears to have altered locations & rates, but not the nature, of wetland plant succession on the CRD. Illustrations.
