The magnitude of wrongful conviction is increasing across the country and around the world, with individuals arrested, convicted, and incarcerated for extended periods of time. This book provides an understanding of legal remedies, organizational reforms, and policy changes that have been proposed and implemented. In various jurisdictions, these procedures reduce the likelihood of a wrongful conviction. Legal and organizational reforms and changes in criminal justice policy are considered at three key junctures of the process: (1) the investigation, evidence gathering, and forensic analysis, (2) prosecutorial decision-making, and (3) the judicial review and exoneration of a wrongfully convicted defendant. Each chapter opens with a wrongful case vignette that illustrates the reform strategies being considered. The investigatory process is studied on each case, and the police process is analyzed in detail. Part 1 includes the introductory chapter that provides an overview of wrongful convictions, and the investigatory process routinely employed to gather evidence and identify a suspect. The analysis of forensic evidence is explored, including the chain of custody, contamination of the evidence, misinterpretation, and the falsification of forensic reports. Part 2 focuses on the prosecutors, defense attorneys, judges and juries. Plea bargaining strategies, coaching witnesses, violations of the rules of discovery, use of jailhouse snitches, inadequate defense counseling, lack of preparation and adequate resources are examined. Part 3 analyzes the processes involved in the reversal of wrongful convictions, the judicial review, and obstacles encountered in the exoneration process. In addition, the authors provide a thorough analytical overview of the criminal justice processes involved in wrongful conviction and the reforms that are needed to prevent and reverse injustices. This book is an invaluable resource for prosecutors, defense attorneys, judges, advocates for the wrongfully convicted, criminal justice policymakers, law and society, and will contribute to academic courses in the fields of criminology and justice.

The formation of the Democratic-Farmer-Labor party of Minnesota took place in a context of intense factional struggle that lasted from the death of Governor Floyd B. Olson in 1936 to the election of Hubert Humphrey to the U.S. Senate in 1948. Dubious Alliance, the first full account of this critical chapter in the state's political history, has wider significance not only because many of the leading figures in the story have played a role in national politics, but also because it deals with issues—chief among them, the origins of Cold War liberalism— that matter far beyond the boundaries of a single state. John Haynes follows the struggle from its inception to the postwar battle within the new DFL between Popular Front adherents and anti-Communist liberals led by Minneapolis Mayor Hubert Humphrey. He makes clear that the struggle with the Popular Front was the formative political experience of Humphrey's generation; those who fought with him, and who became active in national politics—Orville Freeman, Eugene McCarthy, Walter Mondale, Donald Fraser—did not seriously question Cold War foreign policy till well into the Vietnam era. Thorough and dispassionate, this book will help today's readers better understand the DFL's birth and the struggle that surrounded it—complex events long obscured by Cold War fears and political myth-making. John Earl Haynes is a historian by training—he earned his Ph.D. at the University of Minnesota—and also a specialist in tax policy. He was an adviser to Governor Wendell Anderson and later served as a congressional aide to Anderson and to Representative Martin Sabo. Haynes is now Director of Tax and Credit Analysis for the state of Minnesota.

Formed in 1851 by Irish immigrants, the Fighting Sixty-Ninth has served with distinction since the Civil War. This is a complete, illustrated history of the regiment's service in the Irish Brigade and the Rainbow Division. Functioning as the 1st Regiment, Irish Brigade, 2nd Corps, Army of the Potomac throughout the Civil War, the regiment made history at Malvern Hill, Antietam, Fredericksburg, Gettysburg, Spotsylvania, Cold Harbor, Petersburg and Appomatox. According to legend, an exasperated General Jackson cursed them as part of "that damn brigade." Functioning as the 165th Infantry, 42nd Division (Rainbow Division) throughout World War I, the regiment helped turn back the last German offensive, counterattacked at the Ourq river, spearheaded one of Pershing's pincers at St. Mihiel, and helped break the Hindenburg Line in the Argonne Forest. Today, the regiment is known as 1st Battalion, 69th Infantry (Mechanized), New York Army National Guard.

This book is part of our history, one that has slipped from memory in the passage of time. The story of Nick Coleman, one of his generations most inspired leaders, while overdue, is still worth telling, and surely it carries important lessons for us now. Walter F. Mondale In January 1973, Nick Coleman became the fi rst Democrat in 114 years to lead the majority in the Minnesota Senate. He provided the vision and leadership required to enact the Minnesota equivalent of Lyndon Johnsons social and economic programs known as the Great Society. This was the high tide of liberal politics in Minnesota, the crest in voter support that also sent Hubert Humphrey, Eugene McCarthy, and Walter Mondale to national prominence. For the Good of the Order chronicles Nick Colemans role in the legislative cauldron that resulted in Minnesota being recognized throughout the country as the state that works. Despite spirited political challenges, these remarkable achievements resulted from genuine collaboration from both sides of the aisle. Moreover, the debate over these initiatives helped raise Minnesotas legislative branch to coequal status with the executive. Sadly, they also marked the beginning of the demise of civility, respect, and compromise among lawmakers. Coleman was an Irish-American, and proud of his heritage. His talent for leadership was surely enhanced by his Celtic wit and view of the world. No caricature of the Irish pol, however, Coleman used his verbal gifts and charm to offer reasons why a hesitant colleague could safely follow him when votes were needed for controversial bills. He led from the front, especially when debate was most intense, and unfl inchingly took the fi ercest fi re from adversaries. When Nick Coleman left the political arena in 1981, a wave of conservatism was sweeping the country. Since his departure, much of the agenda Coleman fought so hard to accomplish has been diluted or reversed. Nevertheless, his legacy remains an inspiration to all who believe that a society should be judged by how it treats its weakest and least powerful. Perhaps Hubert Humphrey voiced this belief most succinctly when he said, ...the moral test of government is how that government treats those who are in the dawn of life, the children; those who are in the twilight of life, the elderly; those who are in the shadows of life: the sick, the needy and the handicapped. Those were the people Nick Coleman fought forand never forgot.
