Gender is an increasingly prominent aspect of the contemporary debate and discourse around law. It is curious that gender, while figuring so centrally in the construction and organization of social life, is nevertheless barely visible in the conceptual armoury of law. In the jurisprudential imagination law is gender-less; as a result legal scholarship for the most part continues to hold on to the view that gender plays little or no role in the conceptual make-up, normative grounding, or categorical ordering of law. The official position is that the idea of law and legal fundamentals are, or at least ought to be, gender-independent. This book challenges these long-held assumptions. Exploring the relationship between law and gender it takes gender as a core concept and analytical tool and examines how law is conceptualized, organized, articulated, and legitimated. How can gender be given meaning in legal texts, doctrine, and practices, and how can gender operate within the law while simultaneously appearing to be outside it? The relationship between gender and the law is relevant to virtually all areas of law including in particular criminal law, tort law, family law, employment law, and human rights. Increasingly issues of gender are perceived as the concern of all, reflecting broader debates in the law, including those of equality and sexuality. Parenting in England is the first study of the world of parenting in late Georgian England. The author, Joanne Bailey, traces ideas about parenthood in a Christian society that was responding to new cultural trends of sensibility, romanticism and domesticity, along with Enlightenment ideas about childhood and self. All these shaped how people, from the poor to the genteel, thought about themselves as parents, and remembered their own parents. With meticulous attention to detail, Bailey illuminates the range of intense emotions provoked by parenthood by investigating a rich array of sources from memoirs and correspondence, to advice literature, fiction, and court records, to prints, engravings, and ballads. Parenting was also a profoundly embodied experience, and the book captures the effort, labour, and hard work it entailed. Such parental investment meant that the experience was fundamental to the forging of national, familial, and personal identities. It also needed more than two parents and this book uncovers the hitherto hidden world of shared parenting. At all levels of society, household and kinship ties were drawn upon to lighten the labours of parenting. By revealing these emotional and material parental worlds, what emerges is the centrality of parenthood to mental and physical well-being, reputation, public and personal identities, and to transmitting prized values across generations. Yet being a parent was a contingent experience adapting from hour to hour, year to year, and child to child. It was at once precarious, as children and parents succumbed to fatal diseases and accidents, yet it was also enduring because parent-child relationships were not ended by death: lost children and parents lived on in memory.

This monograph addresses the phenomenon of mass harm and how it may be resolved through collective redress. It examines particularly how such redress may be achieved through mechanisms such as multi-party actions (MPAs). In order to do this, an analytical framework is created against which to evaluate various multi-party procedures. This is illustrated through the experience of a selection of common law jurisdictions in dealing with mass harm – namely that of England and Wales, Canada, Australia and the United States, as well as that of EU collective redress. It examines multi-party action laws benchmarked against the objectives identified in the analytical framework. The phenomenon of environmental mass harm in particular is explored as a case study, as it illustrates some of the difficulties that may arise in mass harm litigation. Also, this work explores where the best solutions for mass harm redress may lie in the future – perhaps in collective actions or through alternatives such as regulation and alternative dispute resolution or a combination of these. Finally, the experience of mass harm litigation in Ireland is examined, as currently this jurisdiction does not have an effective mechanism for dealing with mass harm.
