American Constitutionalism and the Myth of the Legislative Veto

Jessica Korn challenges the notion that the eighteenth-century principles underlying the American separation of powers system are incompatible with the demands of twentieth-century governance. She demostrates the continuing relevance of these principles by questioning the dominant scholarship on the legislative veto. As a short-cut through constitutional procedure invented in the 1930s and invalidated by the Supreme Court's Chadha decision in 1983, the legislative veto has long been presumed to have been a powerful mechanism of congressional oversight. Korn's analysis, however, shows that commentators have exaggerated the legislative veto's significance as a result of their incorrect assumption that the separation of powers was designed solely to check governmental authority. The Framers also designed constitutional structure to empower the new national government, institutionalizing a division of labor among the three branches in order to enhance the government's capacity. By examining the legislative vetoes governing the FTC, the Department of Education, and the president's authority to extend most-favored-nation trade status, Korn demonstrates how the powers that the Constitution grants to Congress made the legislative veto short-cut inconsequential to policymaking. These case studies also show that Chadha enhanced Congress's capacity to pass substantive laws while making it easier for Congress to preserve important discretionary powers in the executive branch. Thus, in debunking the myth of the legislative veto, Korn restores an appreciation of the enduring vitality of the American constitutional order.

Both the special sciences and ordinary experience present us with a world of macro-entities - trees, birds, lakes, mountains, humans, houses, and sculptures, to name a few - which materially depend on lower-level configurations, but which are also distinct from and distinctively efficacious ascompared to those configurations. This give rise to two key questions. First, what is metaphysical emergence, more precisely? Second, is there actually any metaphysical emergence? Metaphysical Emergence provides clear, compelling, and systematic answers to these questions. Wilson argues that thereare two and only two forms of metaphysical emergence that make sense of the target cases: 'Weak' emergence, whereby a macro-entity or feature has a proper subset of the powers of its base-level configuration, and 'Strong' emergence, whereby a macro-entity or feature has a new power as compared toits base-level configuration. Given that the lower-level configurations are physical, Weak emergence unifies and accommodates diverse accounts of realization associated with varieties of non-reductive physicalism, whereas Strong emergence unifies and accommodates anti-physicalist views according towhich there may be fundamentally novel features, forces, interactions, or laws at higher levels of compositional complexity. After defending each form of emergence from various objections, Wilson considers whether complex systems, ordinary objects, consciousness, and free will are actually eitherWeakly or Strongly metaphysically emergent. She argues that Weak emergence is quite common, and that Strong emergence, while in most cases at best a live empirical possibility, is instantiated for the important case of free will.

Plato's Epistemology: Being and Seeming presents an original interpretation of one of the central topics in Plato's work: epistemology. Jessica Moss argues that Plato's epistemology is radically different from our own. Going against the grain of recent scholarship, and drawing on ancient interpretations of Plato, Jessica Moss argues that Plato is not best understood as studying what we now call knowledge and belief. Instead, Moss proposes that the central players in his epistemology, epistêmê and doxa, are each essentially to be understood as cognition of a certain kind of object. Epistêmê is cognition of what Is - where this turns out to mean that it is a deep grasp of ultimate reality. Doxa is cognition of what seems - where this turns out to mean that it is atheoretical thought that mistakes images for reality. The book defends these characterizations by arguing that they explain important features of Plato's epistemology. In particular, it shows that they underlie and make sense of a view which was long attributed to Plato but has recently been deemed "outrageous": that there is no doxa of Forms, and no epistêmê of perceptibles. Finally, Moss contends that Plato's epistemology is so different from modern epistemology because it is motivated by his central ethical and metaphysical views. As the Cave allegory illustrates, he holds that the goal of life is to be in contact with genuine Being, and that the greatest obstacle to this goal is our tendency to rest content with appearances. Therefore, when Plato turns to epistemological investigations, the distinction he finds most salient is that between cognition of what Is and cognition of what seems.

Bachelor Thesis from the year 2022 in the subject American Studies - Culture and Applied Geography, grade: 1,7, University of Koblenz-Landau (Anglistik), language: English, abstract: This thesis poses the research question whether Donald Glover reproduces or dismantles racial stereotypes in the music video "This is America". In order to get to the root of this question, one first must understand the concept of racism, and the purpose racism fulfils in the social system of the United States. Then the racist stereotypes need to be elaborated, because they are only visible and perceptible when known. Because of the male biased gender statistics and the fact that Donald Glover as a black man is the main protagonist of the video, the representation of black masculinity is an interesting additional aspect to be illuminated, especially regarding the hip-hop genre of the song. In the analysis, the music video is examined based on the semiotic approach and the theoretical foundation. Finally, a conclusion to the research question is drawn based on the multifaceted results. A music video that can hardly be surpassed in semiotic richness is “This is America” by Donald Glover, released under his pseudonym Childish Gambino. The music video tackles gun violence, systemic racism, slavery, and juxtaposes jaunty images of dancing school children with shocking scenes of Gambino shooting a black man and gunning down a black choir. While the music video features the aforementioned racist stereotypes, the effect on the viewer is peculiar. The video has provoked a strong social reaction and has been highly discussed in the media, after the death of George Floyd in May 2020 and the resulting protests, the song has become the anthem for people posting footage of the protests on TikTok. Until January 2021, the video was watched 750,776,033 times, vinyl records of the song are sold for 418 € on eBay. The topic, and therefore the video itself, has not lost significance today and goes on like the echo of a disturbing American history. The song has become a worldwide phenomenon, following numerous analysis and interpretations of the innumerable obvious and unapparent images and this thesis does not foresee to reproduce such an analysis, but to take a closer look at the racist stereotypes the video alludes to and on how they are used. Many of the stereotypes elaborated by Bogle (2016) as well as more generalized attributions of black masculinity in hip hop culture are represented in the video, but differ strongly from typical music videos in this genre in the widespread reception, which leads to the question of how stereotypes are embedded here.
