On the way to offering a new analysis of the basis of the Supreme Court's iconic decision in Brown v. Board of Education, Jeffrey Hockett critiques an array of theories that have arisen to explain it and Supreme Court decision making generally. Drawing upon justices' books, articles, correspondence, memoranda, and draft opinions, A Storm over This Court demonstrates that the puzzle of Brown's basis cannot be explained by any one theory. Borrowing insights from numerous approaches to analyzing Supreme Court decision making, this study reveals the inaccuracy of the popular perception that most of the justices merely acted upon a shared, liberal preference for an egalitarian society when they held that racial segregation in public education violates the equal protection clause of the Fourteenth Amendment. A majority of the justices were motivated, instead, by institutional considerations, including a recognition of the need to present a united front in such a controversial case, a sense that the Court had a significant role to play in international affairs during the Cold War, and a belief that the Court had an important mission to counter racial injustice in American politics. A Storm over This Court demonstrates that the infusion of justices' personal policy preferences into the abstract language of the Constitution is not the only alternative to an originalist approach to constitutional interpretation. Ultimately, Hockett concludes that the justices' decisions in Brown resist any single, elegant explanation. To fully explain this watershed decision--and, by implication, others--it is necessary to employ a range of approaches dictated by the case in question.

In Abolitionists Remember, Julie Roy Jeffrey illuminates a second, little-noted antislavery struggle as abolitionists in the postwar period attempted to counter the nation's growing inclination to forget why the war was fought, what slavery was really like, and why the abolitionist cause was so important. In the rush to mend fences after the Civil War, the memory of the past faded and turned romantic--slaves became quaint, owners kindly, and the war itself a noble struggle for the Union. Why is it so difficult to design and implement fundamental educational reform in large city schools in spite of broad popular support for change? How does the politics of race complicate the challenge of building and sustaining coalitions for improving urban schools? These questions have provoked a great deal of theorizing, but this is the first book to explore the issues on the basis of extensive, solid evidence. Here a group of political scientists examines education reform in Atlanta, Baltimore, Detroit, and Washington, D.C., where local governmental authority has passed from white to black leaders. The authors show that black administrative control of big-city school systems has not translated into broad improvements in the quality of public education within black-led cities. Race can be crucial, however, in fostering the broad civic involvement perhaps most needed for school reform. In each city examined, reform efforts often arise but collapse, partly because leaders are unable to craft effective political coalitions that would commit community resources to a concrete policy agenda. What undermines the leadership, according to the authors, is the complex role of race in each city. First, public authority does not guarantee access to private resources, usually still controlled by white economic elites. Second, local authorities must interact with external actors, at the state and national levels, who remain predominantly white. Finally, issues of race divide the African American community itself and often place limits on what leaders can and cannot do. Filled with insightful explanations together with recommendations for policy change, this book is an important component of the debate now being waged among researchers, education activists, and the community as a whole.
In Constitutional Identity, Gary Jeffrey Jacobsohn argues that a constitution acquires an identity through experience—from a mix of the political aspirations and commitments that express a nation’s past and the desire to transcend that past. It is changeable but resistant to its own destruction, and manifests itself in various ways, as Jacobsohn shows in examples as far flung as India, Ireland, Israel, and the United States. Jacobsohn argues that the presence of disharmony—both the tensions within a constitutional order and those that exist between a constitutional document and the society it seeks to regulate—is critical to understanding the theory and dynamics of constitutional identity. He explores constitutional identity’s great practical importance for some of constitutionalism’s most vexing questions: Is an unconstitutional constitution possible? Is the judicial practice of using foreign sources to resolve domestic legal disputes a threat to vital constitutional interests? How are the competing demands of transformation and preservation in constitutional evolution to be balanced?
As society rushes to digitize sensitive information and services, it is imperative to adopt adequate security protections. However, such protections fundamentally conflict with the benefits we expect from commodity computers. In other words, consumers and businesses value commodity computers because they provide good performance and an abundance of features at relatively low costs. Meanwhile, attempts to build secure systems from the ground up typically abandon such goals, and hence are seldom adopted. In this book, I argue that we can resolve the tension between security and features by leveraging the trust a user has in one device to enable her to securely use another commodity device or service, without sacrificing the performance and features expected of commodity systems. At a high level, we support this premise by developing techniques to allow a user to employ a small, trusted, portable device to securely learn what code is executing on her local computer. Rather than entrusting her data to the mountain of buggy code likely running on her computer, we construct an on-demand secure execution environment which can perform security-sensitive tasks and handle private data in complete isolation from all other software (and most hardware) on the system. Meanwhile, non-security-sensitive software retains the same abundance of features and performance it enjoys today. Having established an environment for secure code execution on an individual computer, we then show how to extend trust in this environment to network elements in a secure and efficient manner. This allows us to reexamine the design of network protocols and defenses, since we can now execute code on endhosts and trust the results within the network. Lastly, we extend the user's trust one more step to encompass computations performed on a remote host (e.g., in the cloud). We design, analyze, and prove secure a protocol that allows a user to outsource arbitrary computations to commodity computers run by an untrusted remote party (or parties) who may subject the computers to both software and hardware attacks. Our protocol guarantees that the user can both verify that the results returned are indeed the correct results of the specified computations on the inputs provided, and protect the secrecy of both the inputs and outputs of the computations. These guarantees are provided in a non-interactive, asymptotically optimal (with respect to CPU and bandwidth) manner. Thus, extending a user's trust, via software, hardware, and cryptographic techniques, allows us to provide strong security protections for both local and remote computations on sensitive data, while still preserving the performance and features of commodity computers.

Thirty years before Lincoln issued the Emancipation Proclamation, the antislavery movement won its first victory in the British Parliament. On August 1, 1834, the Abolition of Slavery Bill took effect, ending colonial slavery throughout the British Empire. Over the next three decades, "August First Day," also known as "West India Day" and "Emancipation Day," became the most important annual celebration of emancipation among people of African descent in the northern United States, the British Caribbean, Canada West, and the United Kingdom and played a critical role in popular mobilization against American slavery. In Rites of August First, J. R. Kerr-Ritchie provides the first detailed analysis of the origins, nature, and consequences of this important commemoration that helped to shape the age of Anglo-American emancipation. Few terms in political theory are as overused, and yet as under-theorized, as constitutional revolution. In this book, Gary Jacobsohn and Yaniv Roznai argue that the most widely accepted accounts of constitutional transformation, such as those found in the work of Hans Kelsen, Hannah Arendt, and Bruce Ackerman, fail adequately to explain radical change. For example, a "constitutional moment" may or may not accompany the onset of a constitutional revolution. The consolidation of revolutionary aspirations may take place over an extended period. The "moment" may have been under way for decades--or there may be no such moment at all. On the other hand, seemingly radical breaks in a constitutional regime actually may bring very little change in constitutional practice and identity. Constructing a clarifying lens for comprehending the many ways in which constitutional revolutions occur, the authors seek to capture the essence of what happens when constitutional paradigms change.
This volume focuses on constitutional ratification, the procedure in which a draft constitution is submitted by its creators to the people or their representatives in an up or down vote determining implementation. Ratification is increasingly common and routinely recommended by experts. Nonetheless, it is neither neutral nor inevitable. Constitutions can be made without it and when it is used it has significant effects. This raises the central question of the book: should ratification be recommended? Put another way: is there a reason for treating the procedure as a default for the constitution-making process? Surprisingly, these questions are rarely asked. The procedure's worth is assumed, not demonstrated, while ratification is generally overlooked in the literature. In fact, this is the first sustained study of ratification. To address these oversights, this book defines ratification and its types, explains the procedure's effects, conceptual origins, and history, and then concentrates on finding reasons for its use. Specifically, it builds up and analyzes the three most likely normative justifications. These urge the implementation of ratification because the procedure: enables the constituent power to make its constitution; fosters representation during constitution-making; or helps create a legitimate constitution. Ultimately, these justifications are found wanting, leading to the conclusion that ratification lacks a convincing, context-independent justification. Thus, until new arguments are developed, experts should not give recommendations for ratification as a matter of course, practitioners should not reach for it uncritically, and-more generally-one should avoid the blanket application of concepts from democratic theory to extraordinary contexts such as constitution-making.
