This study explores the egalitarian policies pursued in the provinces during the radical phase of the French Revolution, but moves away from the habit of looking at such issues in terms of the Terror alone. It challenges revisionist readings of Jacobinism that dwell on its totalitarian potential or portray it as dangerously utopian. The mainstream Jacobin agenda emphasised 'fair shares' and equal opportunities for all in a private ownership market economy. It sought to achieve social justice without jeopardising human rights and tended thus to complement, rather than undermine, the liberal, individualist programme of the Revolution. The book stresses the relevance of the 'Enlightenment legacy', the close affinity between Girondins and Montagnards, the key role played by many lesser-known figures and the moral ascendancy of Robespierre. It reassesses the basic social and economic issues at stake in the Revolution, which cannot be understood solely in terms of political discourse.

Permanent establishment is the key concept for allocating taxation rights in respect of business income, and the question ‘Is there a permanent establishment?’ is a tax treaty issue that advisers, government officials, and courts perennially confront. Based on a ‘fixed link to the ground’, the idea has become progressively more difficult to apply until, at this stage, re-evaluation has become a political necessity. If a permanent establishment may exist in the context of e-commerce, the concept of a geographical presence must be redefined. However, the question remains: Is e-commerce a sufficient reason for challenging the well-established permanent establishment nexus? Drawing on case law, administrative practice, and business decisions in numerous jurisdictions, the author discusses the permanent establishment criteria under conditions of e-commerce and the service economy. He shows that the OECD Model Convention and its commentaries already offer the basis for the evolution of the analysis of the concept, and that the preservation of permanent establishment protects and maintains the level playing field between capital importing and capital exporting economies. He examines in depth such elements as the following: ;the prevalence of commercial coherence over geographic coherence; the role of value-added tax; services permanent establishment; relevant definitions of ‘activity’ and ‘personnel’; multiple permanent establishments; supervision activity and sub-contracting; the differences between civil law and common law concepts of representation; particular treatment of the insurance sector; the ‘force of attraction’ concept; and specific exceptions (e.g., transportation, artists and sportsmen, rental income, agricultural activities, pipelines). Taking into account important distinctions between two model conventions (OECD and UN), as well as pertinent EU directives and the impact of EU law, the author proposes minor amendments to the OECD Model that adapt it to economic reality and current trends in jurisprudence and that can be implemented immediately. An appendix includes Article 5 and its commentaries as they have evolved since 1963, with the successive addenda and deletions. The author’s 20-plus years of experience as a tax lawyer lend the presentation a thoroughly practical aspect. The work addresses in more detail than any other publication the topic of profit allocation to a permanent establishment in the e-commerce world, an issue which is evolving rapidly in the current economic environment. Tax advisors, lawyers, and interested academics and policymakers will benefit from the book’s clear analysis of the conditions under which a permanent establishment not only should be preserved, but also how it is likely to be adapted in the future.

For the radical Left today, Guesde is often considered a dogmatist who supported the Union sacrée during World War I and rejected the Bolshevik revolution; for the governmental Left, he embodies an intransigent ideologue who held back the modernization of the French Left. Throughout Jules Guesde, Jean-Numa Ducange argues that it is impossible to study the history of the French socialist movement without a close look at this singular figure and offers a fuller picture of the deep transformations of the Left and Marxism in France from the late 19th century up to the present. This scholarly biography of Jules Guesde seeks to put Guesde’s record on a properly historical footing, closely analysing both archival sources and accounts by his contemporaries. Chapter One begins with his early life and the mark left on him by the Paris Commune and exile. Chapter Two emphasises Guesde’s importance as leader of a distinct current of French socialism, recognised by figures like Karl Marx and Friedrich Engels. Chapter Three sees Guesde become an MP for working-class Roubaix, exploring the contradictions between his revolutionary rhetoric and concrete political practice. Chapter Four turns to the years following his electoral defeat in 1898 and his renewed intransigence in the period of the Dreyfus affair and rivalry with Jaurès. Chapter Five explores his key role in the formation of a united Socialist Party. Chapter Six examines the test of World War I and Guesde’s anguish at the divisions of French socialism. The book then concludes with an examination of Guesde’s contested legacy, as both a “founding father” and figure subject to often pejorative framings.

Cet ouvrage explore une dimension encore inédite de la vidéosurveillance. Elle réside dans le caractère automatique de la détection des « comportements anormaux » dans l'espace public. L'anormalité est un enjeu fondamental dans la définition de la citoyenneté, en établissant une frontière entre ce qui est jugé acceptable et ce qui doit être réprimé. Or, des projets de recherches appliqués récents tentent de coupler l'usage de la vidéosurveillance avec une évaluation automatique de l'anormalité. Désormais, les algorithmes contribuent à définir ces comportements anormaux et donc, dessinent les figures de l’anormal. L’automaticité modifie considérablement les capacités d’appréciation de la normalité, jusqu’ici de la compétence du juge et des pouvoirs publics. La convergence des techniques (vidéo, base de données informatiques...) contribue à modifier profondément les frontières de l’espace public et, par conséquent, de l’espace démocratique. L’ouvrage présente les débats interdisciplinaires qui ont eu lieu à l’occasion d’une application technique actuellement en cours. S’interroger sur ce qu’est un comportement anormal permet de rappeler les modalités d’élaboration de la normalité dans une démocratie.
