Concealing the state frees us from admitting the unpleasant truth-in today's world we are utterly dependent upon the state's increasingly frantic efforts to control risk. To this end, states have created systems of coercion and surveillance that are difficult to reconcile with our theories of political legitimacy. The dominant ideology of contemporary politics has become the concealment of the state's overwhelming power and role in daily life. We prefer the comfortable illusion that we are autonomous individuals pursuing our plans in a free market. If we hold fast to that idea, then our distance from policy makers and dwindling political influence seems less important. Nonetheless, this book draws upon the anarchist tradition and a wide range of accessible policy examples (ranging from military organization and environmental regulations to scientific investment and education) to reveal the active role of contemporary states behind this ideological screen. Lindsey argues that we need a new politics that focuses on exposing and challenging the contemporary state's hidden agency. In early modern Germany, soothsayers known as wise women and men roamed the countryside. Fixtures of village life, they identified thieves and witches, read palms, and cast horoscopes. German villagers regularly consulted these fortune-tellers and practiced divination in their everyday lives. Jason Phillip Coy brings their enchanted world to life by examining theological discourse alongside archival records of prosecution for popular divination in Thuringia, a diverse region in central Germany divided into a patchwork of princely territories, imperial cities, small towns, and rural villages. Popular divination faced centuries of elite condemnation, as the Lutheran clergy attempted to suppress these practices in the wake of the Reformation and learned elites sought to eradicate them during the Enlightenment. As Coy finds, both of these reform efforts failed, and divination remained a prominent feature of rural life in Thuringia until well into the nineteenth century. The century after 1550 saw intense confessional conflict accompanied by widespread censure and disciplinary measures, with prominent Lutheran theologians and demonologists preaching that divination was a demonic threat to the Christian community and that soothsayers deserved the death penalty. Rulers, however, refused to treat divination as a capital crime, and the populace continued to embrace it alongside official Christianity in troubled times. The Devil’s Art highlights the limits of Reformation-era disciplinary efforts and demonstrates the extent to which reformers’ efforts to inculcate new cultural norms relied upon the support of secular authorities and the acquiescence of parishioners. Negotiation, accommodation, and local resistance blunted official reform efforts and ensured that occult activities persisted and even flourished in Germany into the modern era, surviving Reformation-era preaching and Enlightenment-era ridicule alike. On June 15, 2020, the Supreme Court ruled in Bostock v. Clayton County, in a 6-to-3 decision with a majority opinion authored by conservative Justice Neil Gorsuch, that Title VII of the Civil Rights Act of 1964 prohibited employment discrimination on the basis of gender identity and sexual orientation. The decision was a surprise to many, if not most, observers, but as Jason Pierceson explores in this work, it was not completely unanticipated. The decision was grounded in a recent but well-developed shift in federal jurisprudence on the question of LGBTQ rights that occurred around 2000, with gender identity claims faring better in federal court after decades of skepticism. The most important precedent for these cases was a 1989 Supreme Court case that did not deal directly with LGBTQ rights: Price Waterhouse v. Hopkins. The court ruled in Price Waterhouse that “sex stereotyping” is a form of discrimination under Title VII, a provision that prohibits discrimination in employment based upon sex. Ann Hopkins was a cisgender heterosexual woman who was denied a promotion at her accounting firm for being too “masculine.” At the time of the decision, and in the wake of the devastating decision for the LGBTQ movement in Bowers v. Hardwick (1986), the case was not viewed as creating a strong precedential foundation for LGBTQ rights claims, especially claims based upon sexual orientation. Even in the context of gender identity, the connection was not made to the emerging movement for transgender rights until a decade later. In the 2000s, however, federal courts were consistently applying the case to protect transgender individuals. While not the result of coordinated litigation, nor initially connected to the LGBTQ rights movement, Price Waterhouse has been one of the most important and powerful precedents in recent years outside of the marriage equality cases. Before Bostock tells the story of how this “accidental” precedent evolved into such a crucial case for contemporary LGBTQ rights. Pierceson examines the groundbreaking Supreme Court decision of Bostock v. Clayton County through the legal path created by Title VII of the Civil Rights Act of 1964 and the interpretation of the word “sex” over time.
