A human right to higher education was included in the International Covenant on Economic Social and Cultural Rights (ICESCR), which came into force in 1976. Yet the world has changed significantly since the ICESCR was drafted. State legislation and policies have generally followed a neoliberal trajectory, shifting the perception of higher education from being a public good to being a commodity able to be bought and sold. This model has been criticized, particularly because it generally reinforces social inequality. At the same time, attaining higher education has become more important than ever before. Higher education is a prerequisite for many jobs and those who have attained higher education enjoy improved life circumstances. This book seeks to determine: Is there still a place for the human right to higher education in the current international context? In seeking to answer this question, this book compares and contrasts two general theoretical models that are used to frame higher education policy: the market-based approach and the human rights-based approach. In the process, it contributes to an understanding of the likely effectiveness of market-based versus human rights-based approaches to higher education provision in terms of teaching and learning. This understanding should enable the development of more improved, sophisticated, and ultimately successful higher education policies. This book contends that a human rights-based approach to higher education policy is more likely to enable the achievement of higher education purposes than a market-based approach. In reaching this conclusion, the book identifies and addresses some strategic considerations of relevance for advocates of a human rights-based approach in this context.

In this book, Fiona Gregson examines the practice and theology of sharing possessions in community in the NT by examining six diverse NT examples of sharing. Each example is considered in its historical and cultural context before being compared to one or more non-Christian examples to identify similarities and differences. Gregson identifies common characteristics across the NT examples and consistent distinctives in how the early church shared possessions compared to the surrounding cultures. Gregson's findings demonstrate that Christians subverted Roman patronage expectations; Christian groups were more diverse in their membership and exhibited more flexible, less structured examples of sharing; Christians placed greater emphasis on the free choice of individuals to contribute to sharing; and Christians more frequently participated in eating together and had a greater focus on relational bonds than was common in Graeco-Roman society/culture.

Why the increasing use of boilerplate is eroding our rights Boilerplate—the fine-print terms and conditions that we become subject to when we click "I agree" online, rent an apartment, enter an employment contract, sign up for a cellphone carrier, or buy travel tickets—pervades all aspects of our modern lives. On a daily basis, most of us accept boilerplate provisions without realizing that should a dispute arise about a purchased good or service, the nonnegotiable boilerplate terms can deprive us of our right to jury trial and relieve providers of responsibility for harm. Boilerplate is the first comprehensive treatment of the problems posed by the increasing use of these terms, demonstrating how their use has degraded traditional notions of consent, agreement, and contract, and sacrificed core rights whose loss threatens the democratic order. Margaret Jane Radin examines attempts to justify the use of boilerplate provisions by claiming either that recipients freely consent to them or that economic efficiency demands them, and she finds these justifications wanting. She argues, moreover, that our courts, legislatures, and regulatory agencies have fallen short in their evaluation and oversight of the use of boilerplate clauses. To improve legal evaluation of boilerplate, Radin offers a new analytical framework, one that takes into account the nature of the rights affected, the quality of the recipient's consent, and the extent of the use of these terms. Radin goes on to offer possibilities for new methods of boilerplate evaluation and control, among them the bold suggestion that tort law rather than contract law provides a preferable analysis for some boilerplate schemes. She concludes by discussing positive steps that NGOs, legislators, regulators, courts, and scholars could take to bring about better practices.

A confederate soldier, pioneer merchant, rancher, newspaper publisher, and town builder, George Washington Grayson also served for six decades as a leader of the Creek Nation. His life paralleled the most tumultuous events in Creek Indian and Oklahoma history, from the aftermath of the Trail of Tears through World War I. As a diplomat representing the Creek people, Grayson worked to shape Indian policy. As a cultural broker, he explained its ramifications to his people. A self-described progressive who advocated English education, constitutional government, and economic development, Grayson also was an Indian nationalist who appreciated traditional values. When the Creeks faced allotment and loss of sovereignty, Grayson sought ways to accommodate change without sacrificing Indian identity. Mary Jane Warde bases her portrait of Grayson on a wealth of primary and secondary sources, including the extensive writings of Grayson himself.

Combining black feminist theory, philosophy, and performance studies, Sarah Jane Cervenak ruminates on the significance of physical and mental roaming for black freedom.
