Perverse Memory and the Holocaust presents a new theoretical approach to the study of Polish memory bystanders of the Holocaust. Drawing on psychoanalytic theory, it examines representations of the Holocaust in order to explore the perverse mechanisms of memory at work, in which surface a series of phenomena difficult to remember: the pleasure derived from witnessing scenes of violence, identification with the German perpetrators of violence, the powerful fear of revenge at the hands of Jewish victims, and the adoption of the position of genocide victims. Moving away from the focus of previous psychoanalytic studies of memory on questions of mourning, melancholy, repressed memory, and loss, this volume considers the transformation of the collective identity of those who remained in the space of past Holocaust events: bystanders, who partook in the events and benefited from the extermination of the Jews. Indonesia is the home of the largest single Muslim community of the world. Its Christian community, about 10% of the population, has until now received no overall description in English. Through cooperation of 26 Indonesian and European scholars, Protestants and Catholics, a broad and balanced picture is given of its 24 million Christians. This book sketches the growth of Christianity during the Portuguese period (1511-1605), it presents a fair account of developments under the Dutch colonial administration (1605-1942) and is more elaborate for the period of the Indonesian Republic (since 1945). It emphasizes the regional differences in this huge country, because most Christians live outside the main island of Java. Muslim-Christian relations, as well as the tensions between foreign missionaries and local theology, receive special attention.

This edited volume is based on the European Law Institute's (ELI) project 'Rescue of Business in Insolvency Law'. The project ran from 2013 to 2017 under the auspices of the ELI and was conducted by Bob Wessels and Stephan Madaus, who were assisted by Gert-Jan Boon. The study sought to design (elements of) a legal framework that will enable the further development of coherent and functional rules for business rescue in Europe. This includes certain statutory procedures that could better enable parties to negotiate solutions where a business becomes financially distressed. Such a framework also includes rules to determine in which procedures and under which conditions an enforceable solution can be imposed upon creditors and other stakeholders despite their lack of consent. The project had a broad scope, and extended to consider frameworks that can be used by (non-financial) businesses out of court, and in a pre-insolvency context. Part I of this book, the ELI Instrument as approved by the ELI Council and General Assembly, features 115 recommendations on a wide variety of themes affected by the rescue of financially distressed businesses, such as the legal rules for professions and courts, treatment and ranking of creditors' claims, contract, corporate and labour law as well as laws relating to transaction avoidance. Part II consists of national reports that sketch the legal landscape in 13 States and of an 'Inventory Report on International Recommendations from Standard-Setting Organisations', both of which provided insight for the drafting of the Instrument. This volume is designed to assist those involved in a process of law reform and those setting standards for soft law in the business rescue context.
This open access book examines more than two centuries of societal development using novel historical and statistical approaches. It applies the well-being monitor developed by Statistics Netherlands that has been endorsed by a significant part of the international, statistical community. It features The Netherlands as a case study, which is an especially interesting example; although it was one of the world’s richest countries around 1850, extreme poverty and inequality were significant problems of well-being at the time. Monitors of 1850, 1910, 1970 and 2015 depict the changes in three dimensions of well-being: the quality of life 'here and now', 'later' and 'elsewhere'. The analysis of two centuries shows the solutions to the extreme poverty problem and the appearance of new sustainability problems, especially in domestic and foreign ecological systems. The study also reveals the importance of natural capital: soil, air, water and subsoil resources, showing their relation with the social structure of the ‘here and now ́. Treatment and trade of natural resources also impacted on the quality of life ‘later’ and ‘elsewhere.’ Further, the book illustrates the role of natural capital by dividing the capital into three types of raw materials and concomitant material flows: bio-raw materials, mineral and fossil subsoil resources. Additionally, the analysis of the institutional context identifies the key roles of social groups in well-being development. The book ends with an assessment of the solutions and barriers offered by the historical anchoring of the well-being and sustainability issues. This unique analysis of well-being and sustainability and its institutional analysis appeals to historians, statisticians and policy makers.
This new work examines three important case-studies of international conference diplomacy concerning military security, as presented at the semi-universal Geneva negotiations on the Chemical Weapons Convention (1992), the regional Stockholm conference on Confidence- and Security-Building Measures (CSBMs, 1986) and the Vienna bloc-to-bloc talks between East and West on Mutual and Balanced Force Reductions (MBFR, 1989). The authors describe in great detail the course and results of these conferences, and make a comparison of the negotiating processes before and after the abolition of the Warsaw Treaty Organization after the political events of 1989 in Eastern Europe. The central terms underlying this study are defined within a newly developed comprehensive theoretical framework that is used to analyze the three negotiating processes. In the final chapter a number of concrete recommendations are made which aim to increase the efficacy and efficiency of future multilateral negotiations.
Bringing together a comparative analysis of the accessibility by public transport of 23 cities spanning four continents, this book provides a "hands-on" introduction to the evolution, rationale and effectiveness of a new generation of accessibility planning tools that have emerged since the mid-2000s. The Spatial Network Analysis for Multimodal Urban Transport Systems (SNAMUTS) tool is used as a practical example to demonstrate how city planners can find answers as they seek to improve public transport accessibility. The First Modern Economy provides a comprehensive economic history of the Netherlands during its rise to European economic leadership, the 'Golden Age', and subsequent decline (1500–1815). The authors argue that it was the first modern economy, and defend their position with detailed analyses of its major economic sectors, as well as investigations of social structure and macro-economic performance. Dutch economic history is placed in its European and world context, and inter-continental and colonial trade are discussed fully. Special emphasis is placed on the environmental context of economic growth and later decline, as well as on demographic developments. They attest that a product, service, information or person possesses certain qualifications or meets safety, quality or technical standards. This important book presents an in-depth analysis of the liability and obligations of certifiers, evaluates existing certification processes in selected fields and proposes new mechanisms which could increase the accuracy and reliability of certifiers’ ratings, marks or reports. Rembrandt’s extraordinary paintings of female nudes—Andromeda, Susanna, Diana and her Nymphs, Danaë, Bathsheba—as well as his etchings of nude women, have fascinated many generations of art lovers and art historians. But they also elicited vehement criticism when first shown, described as against-the-grain, anticlassical—even ugly and unpleasant. However, Rembrandt chose conventional subjects, kept close to time-honored pictorial schemes, and was well aware of the high prestige accorded to the depiction of the naked female body. Why, then, do these works deviate so radically from the depictions of nude women by other artists? To answer this question Eric Jan Sluijter, in Rembrandt and the Female Nude, examines Rembrandt’s paintings and etchings against the background of established pictorial traditions in the Netherlands and Italy. Exploring Rembrandt’s intense dialogue with the works of predecessors and peers, Sluijter demonstrates that, more than any other artist, Rembrandt set out to incite the greatest possible empathy in the viewer, an approach that had far-reaching consequences for the moral and erotic implications of the subjects Rembrandt chose to depict. This new book offers a substantial framework for examining the competence or powers of the EC in the field of company law, and the requirements for the lawful exercise of these powers (the principle of subsidiarity and the observance of Article 43 EC in particular). In order to provide a clear understanding of the practical relevance of this framework, the author tests the provisions of specific EC company law instruments for compatibility with the EC Treaty. Although the substantial body of EC company law that has been built up over the years is covered, the focus is on EC company law instruments which have been adopted in implementation of the 2003 Action Plan. The term “hazardous wastes” covers a wide range of disused products and production wastes generated not only in industrial sectors, but also in all areas of everyday life. Hazardous wastes are to a large extent shipped by sea to third countries for recycling or disposal. While the procedural requirements for such movements are laid out in the 1989 Basel Convention, explicit rules of responsibility and liability for resulting damages are neither provided by the Basel Convention nor by other international conventions. The Liability Protocol to the Basel Convention of 1999 has not yet entered into force. This book examines the existing rules of responsibility and liability applying to States and private persons and outlines the conditions under which liability may be incurred. Subsequently, the advantages and shortcomings of the 1999 Liability Protocol are analyzed. Although this Protocol faces substantial political headwind, from a legal perspective it includes principally useful and reasonable approaches and should therefore be ratified.

Hyperbolic Dynamics and Brownian Motion illustrates the interplay between distinct domains of mathematics. There is no assumption that the reader is a specialist in any of these domains: only basic knowledge of linear algebra, calculus and probability theory is required. The content can be summarized in three ways: Firstly, this book provides an introduction to hyperbolic geometry, based on the Lorentz group. The Lorentz group plays, in relativistic space-time, a role analogue to the rotations in Euclidean space. The hyperbolic geometry is the geometry of the unit pseudo-sphere. The boundary of the hyperbolic space is defined as the set of light rays. Special attention is given to the geodesic and horocyclic flows. Hyperbolic geometry is presented via special relativity to benefit from the physical intuition. Secondly, this book introduces basic notions of stochastic analysis: the Wiener process, Itô's stochastic integral, and calculus. This introduction allows study in linear stochastic differential equations on groups of matrices. In this way the spherical and hyperbolic Brownian motions, diffusions on the stable leaves, and the relativistic diffusion are constructed. Thirdly, quotients of the hyperbolic space under a discrete group of isometries are introduced. In this framework some elements of hyperbolic dynamics are presented, as the ergodicity of the geodesic and horocyclic flows. This book culminates with an analysis of the chaotic behaviour of the geodesic flow, performed using stochastic analysis methods. This main result is known as Sinai's central limit theorem.
