Sovereignty generally refers to a particular national territory, the inviolability of the nation’s borders, and the right of that nation to protect its borders and ensure internal stability. From the Middle Ages until well into the Modern Period, however, another concept of sovereignty held sway: responsibility for the common good. James Turner Johnson argues that these two conceptions—sovereignty as self-defense and sovereignty as acting on behalf of the common good—are in conflict and suggests that international bodies must acknowledge this tension. Topics in this volume reflect both perennial and pressing contemporary issues in the ethics of the use of military force and are written by established professionals and respected commentators. Subjects are organized by three major perspectives on the use of military force: the decision whether to use military force in a given context, the matter of right conduct in the use of such force, and ethical responsibilities beyond the end of an armed conflict. This expansive volume traces the rhetoric of reform across American history, examining such pivotal periods as the American Revolution, slavery, McCarthyism, and today's gay liberation movement. At a time when social movements led by religious leaders, from Louis Farrakhan to Pat Buchanan, are playing a central role in American politics, James Darsey connects this radical tradition with its prophetic roots. Public discourse in the West is derived from the Greek principles of civility, diplomacy, compromise, and negotiation. On this model, radical speech is often taken to be a sympton of social disorder. Not so, contends Darsey, who argues that the rhetoric of reform in America represents the continuation of a tradition separate from the commonly accepted principles of the Greeks. Though the links have gone unrecognized, the American radical tradition stems not from Aristotle, he maintains, but from the prophets of the Hebrew Bible.
This book is about religion, pacifism, and the nonviolence that informs pacifism in its most coherent form. Pacifism is one religious approach to war and violence. Another is embodied in just war theories, and both pacifism and just war thinking are critically examined. Although moral support for pacifism is presented, a main focus of the book is on religious support for pacifism, found in various religious traditions. A crucial distinction for pacifism is that between force and violence. Pacifism informed by nonviolence excludes violence, but, the book argues, allows forms of force. Peacekeeping is an activity that on the face of it seems compatible with pacifism, and several different forms of peacekeeping are examined. The implications of nonviolence for the treatment of nonhuman animals are also examined. Two models for attaining the conditions required for a world without war have been proposed. Both are treated and one, the model of a biological human family, is developed. The book concludes with reflections on the role of pacifism in each of five possible futurescapes.

First full-length study of the use and perception of deceit in medieval warfare. Deception and trickery are a universal feature of warfare, from the Trojan horse to the inflatable tanks of the Second World War. The wars of the Central Middle Ages (c. 1000-1320) were no exception. This book looks at the various tricks reported in medieval chronicles, from the Normans feigning flight at the battle of Hastings (1066) to draw the English off Senlac Hill, to the Turks who infiltrated the Frankish camp at the Field of Blood (1119) disguised as bird sellers, to the Scottish camp followers descending on the field of Bannockburn (1314) waving laundry as banners to mimic a division of soldiers. This study also considers what contemporary society thought about deception on the battlefield: was it a legitimate way to fight? Was cunning considered an admirable quality in a warrior? Were the culturally and religious "other" thought to be more deceitful in war than Western Europeans? Through a detailed analysis of vocabulary and narrative devices, this book reveals a society with a profound moral ambivalence towards military deception, in which authors were able to celebrate a warrior's cunning while simultaneously condemning their enemies for similar acts of deceit. It also includes an appendix cataloguing over four hundred incidents of military deception as recorded in contemporary chronicle narratives.
Before military action, and even before mobilization, the decision on whether to go to war is debated by politicians, pundits, and the public. As they address the right or wrong of such action, it is also a time when, in the language of the just war tradition, the wise would deeply investigate their true claim to jus ad bellum (“the right of war”). Wars have negative consequences, not the least impinging on human life, and offer infrequent and uncertain benefits, yet war is part of the human condition. James G. Murphy’s insightful analysis of the jus ad bellum criteria—competent authority, just cause, right intention, probability of success, last resort, and proportionality—is grounded in a variety of contemporary examples from World War I through Vietnam, the "soccer war" between Honduras and El Salvador, Afghanistan, and the Middle East conflict. Murphy argues persuasively that understanding jus ad bellum requires a primary focus on the international common good and the good of peace. Only secondarily should the argument about going to war hinge on the right of self-defense; in fact, pursuing the common good requires political action, given that peace is not simply the absence of violence. He moves on to demonstrate the interconnectedness of the jus ad bellum criteria, contending that some criteria depend logically on others—and that competent authority, not just cause, is ultimately the most significant criterion in an analysis of going to war. This timely study will be of special interest to scholars and students in ethics, war and peace, and international affairs.
In the late 1980s and early 1990s, the relative calm world of Japanese Buddhist scholarship was thrown into chaos with the publication of several works by Buddhist scholars Hakamaya Noriaki and Matsumoto Shiro, dedicated to the promotion of something they called Critical Buddhism (hihan bukkyo). In their quest to re-establish a "true" - rational, ethical and humanist - form of East Asian Buddhism, the Critical Buddhists undertook a radical deconstruction of historical and contemporary East Asian Buddhism, particularly Zen. While their controversial work has received some attention in English-language scholarship, this is the first book-length treatment of Critical Buddhism as both a philosophical and religious movement, where the lines between scholarship and practice blur. Providing a critical and constructive analysis of Critical Buddhism, particularly the epistemological categories of critica and topica, this book examines contemporary theories of knowledge and ethics in order to situate Critical Buddhism within modern Japanese and Buddhist thought as well as in relation to current trends in contemporary Western thought.
James Hickey proceeds from the premise that throughout history, humans have demonstrated a proclivity for using violence against one another as a means to achieve an end, means enabled, in many respects, by the technologies available at the time. Advancing technology has often been a prime enabler of ever-increasing levels of violence and attendant human suffering. At a few junctures in history, however, certain technologies have seemingly provided the armed forces that possess them the ability to fight wars with decreasing levels of violence and suffering. Today, precision-guided munitions (PGMs) with their high degree of discrimination and accuracy again hold such promise. This book seeks to answer the question: Do PGMs mitigate suffering in war, and have these weapons changed the way decisions regarding war and peace have been made? Answering this question helps us understand possible shifts in emphasis in modern warfare, both in terms of methods employed and of the greater concern placed on limiting human suffering during conflict. This book will help students of ethics, just war and military history and senior military and civilian leaders to understand the possible outcomes and wider implications of their strategic choices to use such technology.
The Sword and the Cross is a study of the relationships that exist between politics and ethics. Its intention is to point out that moral convictions conceived and implemented without political wisdom can be bankrupt and that geopolitical strategy formulated and effected without ethical character can be disastrous. Toner contends that politics and ethics are different sides of the same coin. Therefore commanders (that is, leaders in politics and government, in diplomacy, and in the military) must develop both strategic sense and ethical intuition. A study of the relationship between the sacred and the profane, this book promotes an understanding of the ways in which power and purpose can--and must--be complementary. This study concludes that violence and conflict are part of human existence and that full and final redemption from our struggles is the gift of grace--and not of human artifice. At the same time, we have the burden (and the glory) of doing all we can to achieve our own safety and happiness, which requires political and military prudence. The reconciliation of faith or conscience with power or command is the task of leaders who are informed by civic virtue. In turn, civic virtue is the product of wise education rooted in serious study of what ought to be as well as of what is; but ethically impoverished modern education too rarely asks questions about visions of the Good. Because these conclusions are rooted in a controversial religious and philosophical tradition, they will generally challenge the accepted views in the field.

Juan de Solorzano Pereira (1575-1654) was a lawyer who spent eighteen years as a judge in Peru before returning to Spain to serve on the Councils of Castile and of the Indies. Considered one of the finest lawyers in Spain, his work, De Indiarum Jure, was the most sophisticated defense of the Spanish conquest of the Americas ever written, and he was widely cited in Europe and the Americas until the early nineteenth century. His work, and that of the Spanish School of international law theorists generally, is often seen as leading to Hugo Grotius and modern international law.
