Exploring the little-known history behind the legal doctrine of prior appropriation--"first in time is first in right"--used to apportion water resources in the western United States, this book focuses on the important case of Wyoming v. Colorado (1922). U.S. Supreme Court Associate Justice Willis Van Devanter, a former Chief Justice of Wyoming, ruled in that state's favor, finding that prior appropriation applied across state lines--a controversial opinion influenced by cronyism. The dicta in the case, that the U.S. Government has no interest in state water allocation law, drove the balkanization of interstate water systems and resulted in the Colorado River Interstate Compact between Wyoming, Colorado, Utah, New Mexico, Arizona, Nevada and California. The exhaustive research that has gone into this book has uncovered the secret that Associate Justice Van Devanter had waited eleven years to publish his opinion in this important, but politically self-serving, case, at last finding a moment when his senior colleagues were sufficiently absent or incapacitated to either concur or dissent. Without the knowledge of his "brethren," save his "loyal friend" Taft, and without recusal, Van Devanter unilaterally delivered his sole opinion to the Clerk for publication on the last day of the Supreme Court's October 1921 Term.

Although choices seems endless, public attention is not. How do digital media find the audiences they need in an era of infinite choice? In The Marketplace of Attention, James Webster explains how audiences take shape in the digital age. Webster describes the factors that create audiences, including the preferences and habits of media users, the role of social networks, the resources and strategies of media providers, and the growing impact of media measures—from ratings to user recommendations. He incorporates these factors into one comprehensive framework: the marketplace of attention. In doing so, he shows that the marketplace works in ways that belie our greatest hopes and fears about digital media. Some observers claim that digital media empower a new participatory culture; others fear that digital media encourage users to retreat to isolated enclaves. Webster shows that public attention is at once diverse and concentrated—that users move across a variety of outlets, producing high levels of audience overlap. So although audiences are fragmented in ways that would astonish midcentury broadcasting executives, Webster argues that this doesn't signal polarization. He questions whether our preferences are immune from media influence, and he describes how our encounters with media might change our tastes. Furthermore, many wielded information as a tool of power, in that those who had more information had more authority. It is becoming increasingly clear that shared collective knowledge of an organization is of far greater value than that of each individual's privately held data. In view of the librarian's changing profession, it has also become clear that they are now being charged with the mission to explore and implement new and innovative methods to encourage sharing and to better manage information. Since most special libraries are corporate libraries, the selections are taken from these different disciplines to provide perspectives from both a business standpoint and an information management one. In this intriguing and innovative work, James D. Schmidt examines federal efforts to establish "free labor" in the South during and after the Civil War by exploring labor law in the antebellum North and South and its role in the development of a capitalist labor market. Identifying the emergence of conservative, moderate, and liberal stances on state intervention in the labor market, Schmidt develops three important case studies--wartime Reconstruction in Louisiana, the Thirteenth Amendment, and the Freedmen's Bureau--to conclude that the reconstruction of free labor in the South failed in large part because of the underdeveloped and contradictory state of labor law. After Major General William Tecumseh Sherman's forces ravaged Atlanta in 1864, Ulysses S. Grant urged him to complete the primary mission Grant had given him: to destroy the Confederate Army in Georgia. Attempting to draw the Union army north, General John Bell Hood's Confederate forces focused their attacks on Sherman's supply line, the railroad from Chattanooga, and then moved across north Alabama and into Tennessee. As Sherman initially followed Hood's men to protect the railroad, Hood hoped to lure the Union forces out of the lower South and, perhaps more important, to recapture the long-occupied city of Nashville. Though Hood managed to cut communication between Sherman and George H. Thomas's Union forces by placing his troops across the railroads south of the city, Hood's men were spread over a wide area and much of the Confederate cavalry was in Murfreesboro. Hood's army was ultimately routed. Union forces pursued the Confederate troops for ten days until they recrossed the Tennessee River. The decimated Army of Tennessee (now numbering only about 15,000) retreated into northern Alabama and eventually Mississippi. Hood requested to be relieved of his command. Less than four months later, the war was over. Written in a lively and engaging style, Nashville presents new interpretations of the critical issues of the battle. James Lee McDonough sheds light on how the Union army stole past the Confederate forces at Spring Hill and their subsequent clash, which left six Confederate generals dead.
