Best known for his Civil War photographs, Alexander Gardner also documented the construction of the Union Pacific Railway, Eastern Division (later the Kansas Pacific Railroad), across Kansas beginning in 1867. This book presents recent photographs by John R. Charlton of the scenes Gardner recorded, paired with the Gardner originals and accompanied by James E. Sherow’s discussion. Like most rephotography projects, this one provides fascinating information about the changes in the landscape over the last century and a half. The book presents ninety pairs of Gardner’s and Charlton’s photographs. In all of Charlton’s photos he duplicates the exact location and time of day of the Gardner originals. Sherow uses the paired images to show how Indian and Anglo-American land-use practices affected the landscape. As the Union Pacific claimed, the railroad created an American empire in the region, and Charlton’s rephotography captures the transformation of the grasslands, harnessed by the powerful social and economic forces of the railroad.
Exploring the little-known history behind the legal doctrine of prior appropriation--"first in time is first in right"--used to apportion water resources in the western United States, this book focuses on the important case of Wyoming v. Colorado (1922). U.S. Supreme Court Associate Justice Willis Van Devanter, a former Chief Justice of Wyoming, ruled in that state's favor, finding that prior appropriation applied across state lines--a controversial opinion influenced by cronyism. The dicta in the case, that the U.S. Government has no interest in state water allocation law, drove the balkanization of interstate water systems and resulted in the Colorado River Interstate Compact between Wyoming, Colorado, Utah, New Mexico, Arizona, Nevada and California. The exhaustive research that has gone into this book has uncovered the secret that Associate Justice Van Devanter had waited eleven years to publish his opinion in this important, but politically self-serving, case, at last finding a moment when his senior colleagues were sufficiently absent or incapacitated to either concur or dissent. Without the knowledge of his "brethren," save his "loyal friend" Taft, and without recusal, Van Devanter unilaterally delivered his sole opinion to the Clerk for publication on the last day of the Supreme Court's October 1921 Term.
Motorists traveling along State Highway 104 north of Tucumcari, New Mexico, may notice a sign indicating the location of Fort Bascom. The post itself is long gone, its adobe walls washed away. In 1863, the United States, fearing a second Confederate invasion of New Mexico Territory from Texas, built Fort Bascom. Until 1874, the troops stationed at this site on the Eroded Plains along the Canadian River defended Hispanic and Anglo-American settlements in eastern New Mexico and far western Texas against Comanches and other Southern Plains Indians. In Fort Bascom, James Bailey Blackshear presents the definitive history of this critical outpost in the American Southwest, along with a detailed view of army life on the late-nineteenth-century western frontier. Located in the middle of what General William T. Sherman called “an awful country,” Fort Bascom’s hardships went beyond the army’s efforts to control the Comanches and Kiowas. Blackshear shows the difficulties of maintaining a post in a harsh environment where scarce water and forage, long supply lines, poorly constructed facilities, and monotonous duty tested soldiers’ endurance.
