In the first half of the twentieth century, Jack Trice, Ozzie Simmons, and Johnny Bright played college football for three Iowa institutions: Iowa State University, the University of Iowa, and Drake University, respectively. At a time when the overwhelming majority of their opponents and teammates were white, the three men, all African American, sustained serious injuries on the gridiron due to foul play, either because of their talents, their race, or, most likely, an ugly combination of the two. Moments of Impact tells their stories and examines how the local communities of which they were once a part have forgotten and remembered those assaults over time. Of particular interest are the ways those memories have been expressed in a number of commemorations, including a stadium name, a trophy, and the dedication of a football field. Jaime Schultz focuses on the historical and racial circumstances of the careers of Trice, Simmons, and Bright as well as the processes and politics of cultural memory. Schultz develops the concept of “racialized memory”—a communal form of remembering imbued with racial significance—to suggest that the racial politics of contemporary America have generated a need to redress historical wrongs, congratulate Americans on the ostensible racial progress they have made, and divert attention from the unrelenting persistence of structural and ideological racism.

English courts have traditionally held a policy of judicial restraint towards regulatory decisions in the commercial context. This book provides a critical view of the courts' deferential attitude and advocates a more intensive form of judicial review which is more satisfactory in terms of individual justice.Addressing the issue in three parts, the orthodox common law position on judicial review is first set out, demonstrating the deferential approach of the courts and highlighting the limited scope of review in a commercial context. The regulator's expertise and institutional autonomy, and the demands of administrative efficiency, all contribute to preventing the courts from interfering with the development of regulatory policies.The book then moves on to consider how current policy appears to be inconsistent with the relevant values of English public law which protect individuals from capricious and arbitrary executive action - particularly the right of the applicant to obtain an independent assessment of the validity of the impugned decision by a court which acts as ultimate arbiter of law.Setting out an alternative model based on European human rights law, the book contends close supervision is necessary over decisions which alter or determine the operation of markets in order to reach a level of judicial control that is consistent with the requirements of fairness and reasonableness in this area and with proper respect for the rights of the parties involved. This alternative approach finds its roots in the principle of proportionality, which entails a greater judicialattenuation of administrative autonomy in order to ensure that actions do not go beyond what it is strictly necessary to achieve the desired outcome.

Socio-political conditions structure patterns and practices of urban reproduction and, in turn, Urban Space reflects conditions in the Global South. The result is different space related outcomes. This is the central topic of this collection. In this book, a unique collection of case study-based accounts posits both English and Spanish academic literature to interpret and reinterpret the appropriation, negotiation and reconfiguration of Urban Space in cities, from Colombia to Namibia. This collection will be of particular interest to urban scholars and others interested in contemporary urban change, especially those with an interest in the Global South. Readers will encounter new perspectives on the State’s enduring influence in urban land and territory reconfiguration and the contrasting wider rhetoric that affords and legitimises a key role for the private sector. The case studies also illuminate opportunities and possibilities for grassroots organising to challenge prevailing city actor hierarchies. Hidden older illegal drug users are a seldom researched group; most research on illegal drug users instead focusses on the young or the institutionalised. To counter this trend, this book reports on a study of current 'hidden' users of illegal drugs aged 40 and over. These are individuals who have sustained illegal drug use over the long term, largely away from the gaze of the authorities, whilst living otherwise 'conventional' lives, holding down jobs, raising families and so on. Thus they have much to tell us about how illegal substances can be integrated into life over the long term, how that integration intersects with other aspects of one's existence, and how illegal drug use is ultimately shaped by changes in personal circumstances and wider social contexts. Utilising insights from the 'life course perspective', the development of the participants' use over their lives is analysed and placed in social context. The book also details the nature of their current drug use. Thus, the book illustrates the place of illegal drugs in the lives of the participants, and how this came to be over the decades as they also juggled work, family and the everyday minutiae of life with their use. The result is a unique look at the illegal drug use of an often ignored group of older drug users, which charts the changing role that illegal drugs have played - and continue to play - in their lives.

Public-private partnerships are a new way of carrying out research and development (R&D) in Latin Americas agricultural sector. These partnerships spur innovation for agricultural development and have various advantages over other institutional arrangements fostering R&D. This report summarizes the experiences of a research project that analyzed 125 public-private research partnerships (PPPs) in 12 Latin American countries. The analysis indicates that several types of partnerships have emerged in response to the various needs of the different partners. Nevertheless, public-private partnerships are not always the most appropriate mechanism by which to carry out R&D and foster innovation in agriculture. Sometimes, it is more efficient to organize research via participatory projects or through research contracts.

This book is a radical reinterpretation of the process that led to Mexican independence in 1821—one that emphasizes Mexico's continuity with Spanish political culture. During its final decades under Spanish rule, New Spain was the most populous, richest, and most developed part of the worldwide Spanish Monarchy, and most novohispanos (people of New Spain) believed that their religious, social, economic, and political ties to the Monarchy made union preferable to separation. Neither the American nor the French Revolution convinced the novohispanos to sever ties with the Spanish Monarchy; nor did the Hidalgo Revolt of September 1810 and subsequent insurgencies cause Mexican independence. It was Napoleon's invasion of Spain in 1808 that led to the Hispanic Constitution of 1812. When the government in Spain rejected those new constituted arrangements, Mexico declared independence. The Mexican Constitution of 1824 affirms both the new state's independence and its continuance of Spanish political culture.

2018 Outstanding Academic Title, selected by Choice Political Culture in Spanish America, 1500–1830 examines the nature of Spanish American political culture by reevaluating the political theory, institutions, and practices of the Hispanic world. Consisting of eight case studies with a focus on New Spain and Quito, Jaime E. Rodríguez O. demonstrates that the process of independence of Spanish America differs from previous claims. In 1188 King Alfonso IX convened the Cortes, the first congress in Europe that included the three estates: the clergy, the nobility, and the towns. This heritage, along with events in the sixteenth century, including the rebellion of Castilla and the Protestant Reformation, transformed the nature of Hispanic political thought. Rodríguez O. argues that those developments, rather than the Enlightenment, were the basis of the Hispanic revolution and the Constitution of 1812. Emphasizing continuity rather than the rejection of Hispanic political culture, and including the Atlantic perspective, Political Culture in Spanish America, 1500–1830 demonstrates the nature of the Hispanic revolution and the process of independence. Rodríguez O.’s work will encourage historians of Spanish America to reexamine the political institutions and processes of those nations from a broad perspective to gain a deeper understanding of the Spanish American countries that emerged from the breakup of the composite monarchy.

The Forging of the Cosmic Race" challenges the widely held notion that Mexico's colonial period is the source of many of that country's ills. The authors contend that New Spain was neither feudal nor pre-capitalists as some Neo-Marxist authors have argued. Instead they advance two central themes: that only in New Spain did a true mestizo society emerge, integrating Indians, Europeans, Africans, and Asians into a unique cultural mix; and that colonial Mexico forged a complex, balanced, and integrated economy that transformed the area into the most important and dynamic part of the Spanish empire. The revisionist view is based on a careful examination of all the recent research done on colonial Mexican history. The study begins with a discussion of the area's rich pre-Columbian heritage. It traces the merging of two great cultural traditions—the Meso-american and the European—which occurred as a consequence of the Spanish conquest. The authors analyze the evolution of a new mestizo society through an examination of the colony's institutions, economy, and social organization. The role of women and of the family receive particular attention because they were critical to the development of colonial Mexico. The work concludes with an analysis of the 18th century reforms and the process of independence which ended the history of the most successful colony in the Western hemisphere. The role of silver mining emerges as a major factor of Mexico's great socio-economic achievement. The rich silver mines served as an engine of economic growth that stimulated agricultural expansion, pastoral activities, commerce, and manufacturing. The destruction of the silver mines during the wars of Independence was perhaps the most important factor in Mexico's prolonged 19th century economic decline. Without the great wealth from silver mining, economic recovery proved extremely difficult in the post-independence period. These reverses at the end of the colonial epoch are important in understanding why Mexicans came to view the era as a "burden" to be overcome rather than as a formative period upon which to build a new nation.
