This book adopts a principled approach to the law applied in the construction of commercial contracts. This approach is presented as part of a coherent theory of the law of contract construction which makes a unique contribution to scholarship and understanding of the most important aspect of the practice of commercial lawyers. The law is explained by reference to three stages in construction. It distinguishes the preliminary stage in which context is established, from the 'meaning' and 'application' stages of contract construction. The approach provides insights both into the practical problems that lawyers face, in particular in relation to admissibility of extrinsic evidence, and the theoretical underpinnings of the subject. The book also explains the relationship between intention and construction, and discusses general and specific rules that determine the results of construction disputes. Each chapter is introduced by statements of its objectives and the book includes simple definitions of key concepts, as well as summaries of the complex principles which comprise the law of construction. In illustrating construction principles and their application, the exposition of the law draws on the author's knowledge of Australian contract law and the influence and role of the UNIDROIT principles, CISG and the American Restatement (Second) Contracts.

When philosophers put forward claims for or against 'property', it is often unclear whether they are talking about the same thing that lawyers mean by 'property'. Likewise, when lawyers appeal to 'justice' in interpreting or criticizing legal rules we do not know if they have in mind something that philosophers would recognize as 'justice'. Bridging the gulf between juristic writing on property and speculations about it appearing in the tradition of western political philosophy, Professor Harris has built from entirely new foundations an analytical framework for understanding the nature of property and its connection with justice. Instead he retired from the scene, permitting the forces of Crazy Horse to concentrate their strength against the troops to the north.” From With Crook at the Rosebud The 1868 Treaty of Fort Laramie gave the Sioux and Cheyenne Indian tribes control over a wide region, covering Montana, Wyoming, Nebraska, and part of the Dakotas. But in the 1870s gold was discovered in the Black Hills, and white settlers invaded Indian territory in desperate search for the precious mineral. Clashes between miners and Indians erupted. After trying other means of settling the disputes, the U.S. government decreed that all Indians in the northwest should be living on reservations by January 1876. The Sioux and the Cheyenne refused to obey, so the Bureau of Indian Affairs called in the military to enforce the order. Brigadier General George Crook led the Big Horn and Yellowstone Expeditionary forces into southern Montana against rebellious Sioux. But Crazy Horse, leading a party of Sioux and Cheyenne, defeated a portion of Crooks command at Powder River in March 1876. In his chagrin and determination for revenge, Crook led his troops to the Rosebud canyon to destroy Crazy Horse’s village. The two powerful forces, each numbering more than one thousand men, met at the Rosebud River on June 17. At the end of the fierce, day-long battle, Crook returned to his base nearly forty miles away, convinced that he had won. Time would prove, however, that the battle resulted in a stalemate. Crook’s force was removed from the larger campaign and he was unable to come to Custer’s aid at the Little Big Horn eight days later. Though the Battle of the Rosebud had a significant impact on the rest of the campaign against the Sioux, it has often been eclipsed by publicity surrounding the Battle of the Little Big Horn. It was not until 1956, when With Crook at the Rosebud was first published by Stackpole, that the first clear history of the battle emerged.

This diary is written from notes made daily by the author when he was signal sergeant to Lieutenant-Colonel P.L.Clowes, who commanded the regiment during the war until October 1901, and afterwards from notes made when he was a squadron sergeant-major and Orderly-Room Sergeant (ORS). It also incorporates the diary of C Squadron, when detached from the regiment, written by its OC, Major A.Henderson, and that of A Squadron during the time it was with Colonel Pulteney's Column, written by Major F.W.Mussenden, squadron OC. It begins with a short, background history of the regiment from its formation in 1693 to 1903 when it was in Aldershot. On 26th December 1899 the regiment was at the Curragh when mobilization orders were received and on 13th February 1900 the regiment embarked at Queenstown (Cobh) for S Africa, part of the 4th Cavalry Brigade with 7th Dragoon Guards and 17th Lancers. Embarkation strength was 19 officers, 586 WOs, NCOs and men and 487 horses (someone was going to have to walk!). The complete nominal roll of those embarking is given, listed by squadrons. The diary begins on 13th Feb followed by daily entries describing the voyage during which eleven horses and one crew member died; it ended at Cape Town on 10th March. It is on this daily entry basis that the progress of the regiment is described, in action, on the move, in camp with all the problems of campaigning on the veldt - sickness, food and water shortage, supplies and other details. Casualties are noted by name and rank and number as they occurred, each draft arriving is listed by number, rank and name and this aspect is a godsend to medallists and genealogists. We meet officers who will have a part to play in the next war - French, Plumer, Pulteney, Hamilton and others. The memorial in St Patrick's Cathedral, Dublin, lists three officers and 51 other ranks dead; the description of the unveiling ceremony as published in the Dublin Mail andEvening Mail is reproduced at the end of the book.
Although the religions of the Caribbean have been a subject of popular media, there have been few ethnographic publications. New light is shed on the Fetterman disaster, partly absolving Brevet Lieutenant Colonel William H. Fetterman of the blame many historians have placed on him for disobeying orders. The subject area embraced by the term "biological control" in its classical sense is very broad indeed. The term itself was apparently first used in 1919 by the late Harry S. Smith, and was then used specifically in reference to the suppression of insect populations by the actions of their indigenous or introduced natural enemies. The California school of biological control specialists who followed in Smith's footsteps have traditionally differentiated "natural" biological control (by indigenous natural enemies) and "applied" biological control (by man-introduced natural enemies). Subsequently, the philosophy broadened beyond the original narrow concern with population suppression of insects (and especially pest insects), to embrace directed activities against mites or other arthropod pests, various invertebrate and vertebrate pests, weeds, and organisms producing disease in humans or their domestic animals and plants. The techniques used in these activities also multiplied beyond the original concern with natural enemies. The subjects area discussed in this book is, at the same time, broader and more restricted than that covered in other books on "biological control. " On the one hand, the treatment here is restrictive in that, with rare exception, we have limited ourselves to dealing only with ideas and examples involving the suppression of insect pests through human activity or intervention in the environment.

Some of the earliest civilizations regarded the universe as organized around four principles, the four "elements" earth. water, air, and fire. Fire, which was the source of light and as such possessed an immaterial quality related to the spiritual world. was clearly the most impressive of these elements, although its quanti tative importance could not have been properly discerned. M- ern science has changed the names, but macroscopic matter is still divided into four states. The solid, liquid, and gaseous states are ordinary states, but the fourth state of matter, the plasma state, has retained a somewhat extraordinary character. It is now recognized that most of the matter of the universe is in the ionized state. but on the earth. the plasma state is still the exception. Hence the importance and also the difficulty of investigations dealing with ionized matter, which have been greatly furthered by the development of thermonuclear fusion research. The study of matter in the ionized state comprises a large diversity of problems belonging to many different branches of phys ics. A number of them relate to the microscopic properties of plasmas and concern the structure and the collisional behavior of atomic constituents. Although they are clearly of basic importance, their relevance to thermonuclear research was at first overlooked, at a time when most of the effort was concentrated on designing fusion devices and understanding macroscopic phenomena, mostly of an electromagnetic nature.
