The ratification-process to the contract about a constitution for Europe is a critical state. This volume deals with the last phases of the emergence, analyzes the constitutional approach, searches for conditions for the ratification, asks for strategies in case of the rejection by some of the member states, for the meaning of the referenda, and the possible effects of the constitution on the sovereignty of the member states.

Constitutional, Federal and Subsidiarity Aspects - The European Union and the United States of America ComparedThis collection of reports and comments from the First and Second Symposium of the Columbia Law School and the Law Faculty of the Johann Wolfgang Goethe-University Frankfurt a. Main on Comparative Law (held respectively in 1995 and 1996) deal with issues of regulatory federalism and harmonization of laws in comparative perspective. The scope of the reports and comments are broad enough to cover both constitutional principles, on the one hand, and specific areas of legislation--environmental, labor and corporate law--on the other. The purpose was to discuss the concepts of federalism and subsidiarity not only in the abstract, but also as against practical needs and political reality.
Emerging from a survery presented at the European Parliament in June 2012 this study proposes steps towards a reform of the Economic and Financial Constitution of the European Union. On the basis of constitutional theory analyses democratic mechanisms for overcoming the financial crisis positively are proposed and considered with respect to European and German constitutional law. At the centre of the fiscal pillar of the Economic and Monetary Union a reformed deficit procedure (Article 126 TFEU) is discussed. A more prominent role for the European Parliament (such as the final say on whether or not there is a deficit) shall provide for greater stability via enhanced political responsibility. In addition, the economic interdependence of the Member States must be respected in the national budgeting procedures. With respect to the economic pillar it is suggested to combine safeguarding national sovereignty and legislation of the EU by aiming at convergence by means of using margins (i.e. minimum and maximum limits) instead of rigid parameters. -- (provided by publisher).
