How do courts reconcile protecting family life with immigration control in human rights cases? This book addresses that question through an analysis of 11 UK Supreme Court decisions on immigration and family life, mostly focusing on Article 8 ECHR, the right to respect for family life, and starting with Huang v SSHD in 2007. The analysis is set against a national context that includes the Human Rights Act 1998 and regular controversies over immigration. The book explains how the European Court of Human Rights jurisprudence has developed in recent years, but, particularly in the absence of children, it often still awards little weight to claims by citizens and residents to be joined by family when immigration status is an issue. This reflects governments' resistance to encroachment on their control over borders. The Supreme Court decisions show that, despite powers conferred by the Human Rights Act, a more nuanced position in domestic law was difficult to articulate and sustain. The book explores the way in which these problems were reflected in the changing language, argumentation, and structure of judgments. These problems revealed judges to be strategic actors drawing on personal and institutional values and responding to the shifting political context. A more generous reading of Article 8 would be legally coherent but needs wider societal support to be realisable. The book ends with a discussion of how, if such support were present, the jurisprudence could give more weight to the needs of families. It is vital reading for anyone interested in families and immigration, and in the problems and potential of human rights adjudication.

To date, virtually all of the 34 states that mandate parental involvement have put judges in charge of the bypass process. Individual judges are thereby responsible for deciding whether or not the minor has a legitimate basis to seek an abortion absent parental participation. In this revealing and disturbing book, Helena Silverstein presents a detailed picture of how the bypass process actually functions. Silverstein led a team of researchers who surveyed more than 200 courts designated to handle bypass cases in three states. Her research shows indisputably that laws are being routinely ignored and, when enforced, interpreted by judges in widely divergent ways. In fact, she finds audacious acts of judicial discretion, in which judges structure bypass proceedings in a shameless and calculated effort to communicate their religious and political views and to persuade minors to carry their pregnancies to term. Her investigations uncover judicial mandates that minors receive pro-life counseling from evangelical Christian ministries, as well as the practice of appointing attorneys to represent the interests of unborn children at bypass hearings. Girls on the Stand convincingly demonstrates that safeguards promised by parental involvement laws do not exist in practice and that a legal process designed to help young women make informed decisions instead victimizes them. In making this case, the book casts doubt not only on the structure of parental involvement mandates but also on the naïve faith in law that sustains them. It consciously contributes to a growing body of books aimed at debunking the popular myth that, in the land of the free, there is equal justice for all.

A passionate horsewoman and successful artist, the autobiographical anecdotes in the earlier part of the book are lively and amusing. The longer second section gives a detailed account of how she and Nina Hollings, her long-term companion and sister of the composer and suffragette Ethel Smyth, raised and manned one of the first mobile X-Ray units to be used by the British in World War I - Marie Curie was organizing the French radiography service - for which they both received numerous decorations. Helena Gleichen paints a vivid picture of the war in Italy, which tends to be little remembered compared to the Western Front, and above all gives an extremely interesting account of how the X-ray Unit was set up and operated, and the considerable impact it had on the treatment and survival rate of the wounded. Gleichen's fascinating writings are here given a new Introduction by Caroline Stone.

In late October 1991, Syrian and Israeli leaders sat down at the Middle East peace conference in Madrid and committed themselves to holding face-to-face talks to conclude a final resolution of the 43-year conflict between them. The promised bilateral negotiation opened that December: It was the first negotiation to be conducted directly between representatives of the two states.1 In the 50 months of discussions that ensued, the Israelis and Syrians surmounted some quite extraordinary difficulties. They were able to overcome (indeed, they drew vital strength from) a change of government in Israel in June 1992. They survived the November 1995 assassination of Israeli Premier Yitzhak Rabin, numerous setbacks in the overall climate of Israeli-Arab peace-making,2 and several changes in the format of the talks themselves. In addition, while much of value was accomplished in the face-to-face negotiations in Washington, a parallel high-level track was kept constantly in operation, undertaken by Secretary of State Warren Christopher, who made over a dozen visits to the Middle East during the first Clinton administration, and also through summit meetings and frequent letters and phone calls to the two leaders from the White House. According to several authoritative accounts, among the contentious issues that the negotiators were able to resolve were the depth of the projected Israeli withdrawal from the Golan and the nature of the envisaged peace. The talks also resulted in agreement on the text of the all important "Aims and Principles" document (full title "the Aims and Principles of the Security Arrangement"). After Shimon Peres' favored negotiator, Uri Savir, had completed his first round in the negotiations with Syria in early 1996, officials from Israel, the United States, and Syria all expressed confidence that 1996 would see agreement on the final text of the Israel- Syria agreement. But in early March 1996, after the Israeli population suffered 79 losses from bombs set off by Palestinian extremists, the Peres government suspended its participation in the talks with Syria. Immediately thereafter, the Israeli-Syrian relationship plunged into a rapid downward spiral of mutual recriminations and hostility which neither Israel, nor Syria--nor the United States--appeared to do anything to brake. The rhetoric of the Middle Easterners shifted quickly from expressions of optimism regarding the peace talks to increasingly gloomy prognostications. With dread inevitability, this descent into political and rhetorical confrontation between the two states became transformed (as had occurred so often in the past) into an actual confrontation in Lebanon. On the night of April 10-11, 1996, the Peres government launched a much-expanded version of an earlier (July 1993) bombing campaign against its neighbor, which this time included intensive attacks from air, ground, and sea on facilities throughout the south of the country and up to, and including, Beirut.
