This book examines the institutions that are producing consumer law at the international level, the substantive issues enshrined in these laws, and the enforcement mechanisms meant to ensure effective protection. The majority of existing research is devoted to the comparative perspective, between countries or between the US and the EU. This book investigates the forceful activities of international and regional organizations, and shifts the focus of research to the internationalization of consumer law, which is largely neglected in particular in the Western-centered political and legal debate. Much of what constitutes consumer law today is focused on banking and finance, and more broadly the financialization and digitalization of the global economy, and society has created a shift in international consumer law production. This book investigates the role that international organizations have on the creation and enforcement of consumer law, and will be of interest to consumer lawyers, practitioners, and officials in organizations such as the United Nations, European Union, and World Bank.
The conversion of Lutz Löb and Jenny van Gelder from Judaism to Roman Catholicism dramatically changed the lives of the extended Löb family. This scientific-historical study traces the personal and spiritual journey of Lutz and Jenny from their baptisms in 1907 through the lives of their children. The story benefits from historical documents and pieces of oral history from the only one of their eight children who survived the Nazi era, Paula van Broekhoven-Löb. The abbess of Koningsoord Abbey and the abbot of Koningshoeven Abbey generously provided access to the archives of the monasteries where the seven other Löb children lived as nuns and monks of the Löb family. Each chapter begins with a citation from a significant situation or event, placing the reader immediately within the lived experience of that period. Photos of the time and the family supplement the historical narrative. The secret conversion of Lutz and Jenny and their lifelong witness to their faith created a tear in the fabric of the extended family while later leading to many idealized portrayals of them and their children. It is the intent of this book to offer an accurate and balanced account, situating the Catholic Löb family within their extended Jewish family, and to correct several decades of hagiography, so restoring humanity and dignity to the memories of the Löb family.

Using detailed analyses of individual buildings as a point of departure, Professor Buchwald here examines various approaches to Byzantine architectural forms, and raises questions concerning the use of stylistic and other forms of analysis. One group of articles focuses on stylistic currents in Asia Minor, including that of the 13th-century Lascarid dynasty, previously unknown. Others explore methods which appear to have been used in the design of Byzantine churches, such as dimensional ’rules of thumb’, modular and geometric systems of proportion, and the quadratura, hitherto recognised only in Western architecture. The final essays pose further questions: what were the goals and achievements of Byzantine architects, when they transformed older existing buildings? How, and why, did they use stereometric Euclidean geometry? And was there any ultimately Platonic connection?
This is the first book to deal with automatic diatom identification. It provides the necessary background information concerning diatom research, useful for both diatomists and non-diatomists. It deals with the development of electronic databases, image preprocessing, automatic contour extraction, the application of existing contour and ornamentation features and the development of new ones, as well as the application of different classifiers (neural networks, decision trees, etc.). These are tested using two image sets: (i) a very difficult set of Sellaphora pupula with 6 demes and 120 images; (ii) a mixed genera set with 37 taxa and approximately 800 images. The results are excellent, and recognition rates well above 90% have been achieved on both sets. The results are compared with identification rates obtained by human experts. One chapter of the book deals with automatic image capture, i.e. microscope slide scanning at different resolutions using a motorized microscope stage, autofocusing, multifocus fusion, and particle screening to select only diatoms and to reject debris. This book is the final scientific report of the European ADIAC project (Automatic Diatom Identification and Classification), and it lists the web-sites with the created public databases and an identification demo.

The Unfair Commercial Practices Directive is the most important directive in the field of trade practices to have emerged from the EC but it builds upon European activity which has sought to regulate trade practices on both a sectoral and horizontal level. It is an umbrella provision, which uses general clauses to protect consumers. How effective this approach is and how it relates the existing acquis are fundamental issues for debate. This work provides a critical appraisal of the Unfair Commercial Practices Directive linking discussion of it to general debates about how fair trading should be regulated. It explains how the Directive fits into the existing acquis. It also examines national traditions where these are necessary to explain the European approach, as in the case of general clauses. The book will be a valuable tool for any student of consumer law seeking to understand the thinking behind the directive and how it will affect national laws. It will also influence policy makers by suggesting how the directive should be interpreted and what policy lies behind its formulation. Businesses and their advisers will use the book as a means of understanding the new regulatory climate post-the directive.
The EC Consumer Law Compendium presents the results of a wide-ranging study prepared for the European Commisison. This Compendium provides the reader with the necessary information for conducting pan-European cross-border consumer transactions. For the first time, the transposition of 8 key consumer directives (including those on sales, unfair terms, distance and doorstep selling as well as package travel and timeshare) into the national laws of all Member States is analyzed. The findings of this study reveal the substantial differences between the various national implementing measures as a result of utilising minimum harmonisation clauses and regulatory options.

The Anabaptists were at the radical, utopian edge of the Reformation, ruthlessly repressed by Catholic, Lutheran and secular authorities alike. Hans-Jurgen Goertz gives a comprehensive account of their political and religious significance, their views, and their social setting within the wider context of the Reformation. Sebastian Castellio, linguist, humanist and religious reformer, is one of the most remarkable figures of the Reformation. Attracted by Calvin's reforms, Castellio moved to Geneva in the 1540s, where he wrote his influential work on educational reform. Ironically, it was Castellio's work as a scholar in Geneva, which was to lead to his falling out with Calvin, and ultimately his forced departure from Geneva and his resettlement in Basle. Exiled from Geneva, Castellio soon attracted a circle of like-minded reformers who opposed the intolerant attitude of Calvin, exemplified by the execution of the heretical Michael Servetus. It is Castellio's residence in Basle, where he developed his 'liberal' humanist approach to religious toleration in opposition to Calvin's dogmatic othodoxy, which forms the core of this study. It explores what toleration meant and how both sides argued their case. Much attention is paid to Castellio's most important work 'On Heretics', in which he argues against the execution of those who err in the faith. By telling the fascinating tale of Castellio's life, this work illuminates the furious debate which he unleashed and how it marked a crucial stage in the development of Protestant thought.

A concise analysis of the relationship between patent rights and human rights is given in this book, focusing on the right to food. The UN Sub-Commission on Human Rights identified ‘apparent conflicts’ or ‘actual or potential conflicts’ between human rights and intellectual property rights. The TRIPS Agreement under the WTO Agreement and the International Covenant on Economic, Social and Cultural Rights constitute the central treaties in the analysis. The book finds that the right to food and related human rights of the Covenant give important guidance when implementing intellectual property legislation and science policy in general. Moreover, the book does not find that the two treaties actually conflict. There are, however, concerns regarding the national implementation of the treaties.
This book analyses the dichotomy between the goal of social inclusion and the effect of social exclusion through over-indebtedness since 2008 in Europe. Filling a vital gap in the current literature on the effects of the financial and economic crisis, this volume puts into context academic discussion with the real-life dimension of over-indebtedness. Reports from six European countries provide socio-economic and legal information on over-indebtedness as well as the regulatory and judicial responses to the problems entailed by over-indebtedness. They form the empirical background for five analyses of different aspects of the inclusion-exclusion dichotomy. It becomes clear that in the context of credit expansion, individual over-indebtedness has turned into a social issue, which the current design of the consumer credit and mortgage system in Europe has helped to produce while disregarding the consequential danger of social exclusion.
In the last few years the study of germinal centers of the lymphoid tissue has progressed at an accelerated pace. Questions about their role and their significance in immune responses that could not be answered, mainly because of tedmicallimitations, are presently approached experimentally from many different directions. Hypotheses, some more than half a century old, receive renewed attention. At this time, members of the Biology Division, Oak Ridge National Laboratory, U.S.A., and of the Institute of Pathology, University of Bern, Switzerland, decided to bring together workers interested in the field. The Conference was held in Bern, June 22-24, 1966, and included fifty-seven contributions which were discussed at length. The range of interest extended from phylogenesis and anatomy to studies on cell proliferation, immunohistochemistry, cancer research and radiobiology. The aim of this broad coverage was to combine all available information on the role of germinal centers in immune responses in a single package, instead of leaving it scattered around in reports dealing with divergent immunological problems. This attempt is reflected in the present book. A rather large space has been devoted to the lively discussions which followed the reports, the volume of most of which had been voluntarily limited. The discussions are not reported verbatim but care has been taken to insure neutrality and objectivity in the necessary adaptation of the shortened transcription. We have been very fortunate indeed, to have Drs.
This aesthetically unique book combines ecological, morphological and anatomical, as well as phylogenetic studies on plant material in a largely unexplored dry mountain region above the timberline. It offers the first comparative analysis of hundreds of plants - annuals, perennial herbs and dwarf shrubs - in an area of 87,000 km2 at altitudes from 2600 to 6150 m above sea level in the Western Himalaya. Characteristic landscape pictures of all major vegetation types and maps show at which locations and altitudes the individual species of vascular plants are distributed, while macroscopic plant pictures and plant age are related to high-quality micro-sections and micro-photographs. The anatomical features of 345 dicotyledons were characterized using the published coding systems and those of 155 monocotyledones were characterized on the basis of a newly developed key. The number of annual rings and anatomical features of the xylem and phloem of dicots are compared and related to different ecological conditions within this extremely dry and cold environment. The ecological and anatomical characterization is used to create a phylogenetic tree based on nucleotide sequences, and indicates which features are genetically stable and which ones are modified by environmental factors. The book appeals to scientists in the fields of plant taxonomy, morphology, anatomy and ecology.

No century in modern European history has built monuments with more enthusiasm than the 19th. Of the hundreds of monuments erected, those which sprang from a nation-wide initiative and addressed themselves to a nation, rather than part of a nation, we may call national monuments. Nelson's Column in London or the Arc de Triomphe in Paris are obvious examples. In Germany the 19th century witnessed a veritable flood of monuments, many of which rank as national monuments. These reflected and contributed to a developing sense of national identity and the search for national unity; they also document an unsuccessful effort to create a «genuinely German» style. They constitute a historical record, quite apart from aesthetic appeal or ideological message. As this historical record is examined, German national monuments of the 19th century are described and interpreted against the background of the nationalism which gave birth to them.
In September, 1976, the International Federation for Cell Biology held its first congress in Boston. On this occasion Berlin was chosen as the site for the next congress. This meant an acknowledgement and at the same time a heavy burden for the still young European Cell Biology Organization, which repre sents a junction of European societies and groups for cell biology. In practical terms, this meant that the members of the young and, compared to the Ame rican Society for Cell Biology, small German Society for Cell Biology had to do a good deal of the organizing of the Cell Biology Congress. This is an op portunity for me, as Chairman of the Organizing Committee, and also on be half of the German Society for Cell Biology, to express my gratitude to all those who have actively participated in the preparations for this Cell Biology Congress. The success of the Congress in Berlin was to a significant extent due to their work. In particular, I would like to especially thank the Secretary General ofECBO Werner Franke, Heidelberg, as well as the Chairman of the Local Organizing Committee, Peter Giesbrecht, Berlin, for the excellent job they did. The Congress in Berlin proved to be significantly larger than that in Boston in 1976. The number of abstracts increased from 1200 to more than 1800. They have been published in the European Journal of Cell Biology. In a simi lar way the number of symposia and workshops expanded.

Preface This book is about semantics and logic. More specifically, it is about the semantics and logic of natural language; and, even more specifically than that, it is about a particular way of dealing with those subjects, known as Discourse Representation Theory, or DRT. DRT is an approach towards natural language semantics which, some thirteen years ago, arose out of attempts to deal with two distinct problems. The first of those was the semantic puzzle that had been brought to contempo rary attention by Geach's notorious "donkey sentences" - sentences like If Pedro owns some donkey, he beats it, in which the anaphoric connection we perceive between the indefinite noun phrase some donkey and the pronoun it may seem to conflict with the existential meaning of the word some. The second problem had to do with tense and aspect. Some languages, for instance French and the other Romance languages, have two morphologically distinct past tenses, a simple past (the French Passe Simple) and a continuous past (the French Imparfait). To articulate precisely what the difference between these tenses is has turned out to be surprisingly difficult.
