The amicus curiae – or friend of the court – is the main mechanism for actors other than the parties, including civil society actors and states, to participate directly in proceedings in international criminal tribunals. Yet reliance on this mechanism raises a number of significant questions concerning: the functions performed by amici, which actors seek to intervene and why, and the influence of amicus interventions on judicial outcomes. Ultimately, the amicus curiae may have a significant impact on the fairness, representativeness and legitimacy of the tribunals' proceedings and decisions. This book provides a comprehensive examination of the amicus curiae practice of the International Criminal Court and other major international criminal tribunals and offers suggestions for the role of the amicus curiae. In doing so, the authors develop a framework to augment the potential contributions of amicus participation in respect of the legitimacy of international criminal tribunals and their decisions, while minimising interference with the core judicial competence of the tribunal and the right of the accused to a fair and expeditious trial.
The transition from silent to synchronized sound film was one of the most dramatic transformations in cinema's history, as it radically changed the technology, practices, and aesthetics of filmmaking within a few short years. In France, debates about sound cinema were fierce and widespread. In French Musical Culture and the Coming of Sound Cinema, author Hannah Lewis argues that the debates about sound film resonated deeply within French musical culture of the early 1930s, and conversely, that discourses surrounding a range of French musical styles and genres shaped audiovisual cinematic experiments during the transition to sound. Lewis' book focuses on many of the most prominent directors and screenwriters of the period, from Luis Buñuel to Jean Vigo, as well as experiments found in lesser-known films. Additionally, Lewis examines how early sound film portrayed the diverse soundscape of early 1930s France, as filmmakers drew from the music hall, popular chanson, modernist composition, opera and operetta, and explored the importance of musical machines to depict and to shape French audiovisual culture. In this light, the author discusses the contributions of well-known composers for film alongside more popular music hall styles, all of which had a voice within the heterogeneous soundtrack of French sound cinema. By delving into this fascinating developmental period of French cinematic history, Lewis encourages readers to challenge commonly-held assumptions about how genres, media, and artistic forms relate to one another, and how these relationships are renegotiated during moments of technological change.
From ancient to modern times, sexualised war violence against women was tolerated if not encouraged as a means of reward, propaganda, humiliation, and terror. This was and is in defiance of international laws that have criminalised acts of sexualised war violence since the 18th century. Ad hoc international tribunals have addressed especially war rape since the 15th century. The International Criminal Court (ICC), however, is the first independent, permanent, international criminal court that recognises not only war rape but also sexual slavery and other sexualised crimes as crimes against humanity, war crimes, and acts of genocide in its statute and supporting documents. This book explores how the ICC definitions of rape and forced marriage came about, and addresses the ongoing challenge of how to define war rape and forced marriage in times of armed conflict in a way that adequately reflects women’s experiences, as well as the nature of the crimes. In addition to deepening the understanding of the ICC negotiations of war rape and forced marriage, and of the crimes themselves, this volume highlights relevant factors that need to be considered when criminalising acts of sexualised war violence under international law. Sexualised Crimes, Armed Conflict and the Law draws on feminist and constructivist theories and offers a comprehensive theoretical and empirical examination of the definition of rape and forced marriage. This study traces the emergence of the concept of the body as a sanctuary from its biblical roots to its expressions in late Second Temple Judaism. Harrington's hypothesis is that the destruction of the first Jerusalem temple was a catalyst for a new reality vis-à-vis the temple and the emergence of increased emphasis on the holiness of the people along with concomitant standards of purity in a certain stream of Judaism. The study brings into relief elements of this attitude from exilic texts, e.g. Ezekiel, to Ezra-Nehemiah, the Dead Sea Scrolls and other Second Temple Jewish texts, including early Jesus and Pauline traditions. The goal is to provide a history of the concept of the body-cum-temple metaphor which comes to its fullest expression in the letters of Paul to the Corinthians. The concept of the body as a sanctuary as it comes to fruition in late second temple Judaism must be understood within the conceptual world of Jewish holiness of the time. The metaphor of the temple provides a frame of reference but only a close analysis of the concepts of holiness, purity, and impurity and the dynamics between them can provide depth and distinction. Of particular importance, critical to proper understanding of the temple metaphor, are the notions of the elect, holy status of Israel and its possible desecration by wrongful sexual relations, the loss of the temple and the ripple effect of creating at least temporary substitutes for processes of the cult, the widespread concern in Second Temple Judaism for ritual purity in support of greater holiness, and a desire among Jews for the residence and agency of the spirit of holiness.
Trauma was a potent influence in the lives of pre-1924 Eastern European Jewish immigrants. They uprooted themselves because of grinding poverty, anti-Semitic discrimination, pogroms, and the violence of World War I. This book’s psychoanalytically-informed life stories, based on 22 in-depth interviews with the immigrants’ adult children, tell the tales of these immigrants and their children. Many of the children believed their parents had left their lives in Eastern Europe behind them. This disavowal—aided by the immigrants’ silence and denial—allowed their children to minimize the trauma and loss their parents suffered both before and after immigrating. I analyze the impact of parental trauma and loss on the second generation. Trauma and loss affected the transmission of memory, and, consequently, often immigrants’ recollections were not passed on to future generations. The topics of trauma and loss in the lives of Eastern European immigrants are relevant in understanding current immigrants to America. Often immigrants’ children tried to repay the debt that they felt was incurred by their parents’ sacrifices. Resilience, accomplishment, and their transition from their immigrant parents’ world to their own full participation in the American milieu characterized the adult lives of the immigrants’ children.

Within an international context in which the right to silence has long been regarded as sacrosanct, this book provides the first comprehensive, empirically-based analysis of the effects of curtailing the right to silence. The right to silence has served as the practical expression of the principles that an individual was to be considered innocent until proven guilty, and that it was for the prosecution to establish guilt. In 1791, the Fifth Amendment to the US Constitution proclaimed that none ‘shall be compelled in any criminal case to be a witness against himself’. In more recent times, the privilege against self-incrimination has been a founding principle for the International Criminal Court, the new South African constitution and the ad hoc International Criminal Tribunals for Rwanda and the former Yugoslavia. Despite this pedigree, over the past 30 years when governments have felt under pressure to combat crime or terrorism, the right to silence has been reconsidered (as in Australia), curtailed (in most of the United Kingdom) or circumvented (by the creation of the military tribunals to try the Guantánamo detainees). The analysis here focuses upon the effects of the Criminal Justice and Public Order Act 1994 in England and Wales. There, curtailing the right to silence was advocated in terms of ‘common sense’ policy-making and was achieved by an eclectic borrowing of concepts and policies from other jurisdictions. The implications of curtailing this right are here explored in detail with reference to England, Wales and Northern Ireland, but within a comparative context that examines how different ‘types’ of legal systems regard the right to silence and the effects of constitutional protection.
