How do judges sentence? In particular, how important is judicial discretion in sentencing? Sentencing guidelines are often said to promote consistency, but is consistency in sentencing achievable or even desirable? Whilst the passing of a sentence is arguably the most public stage of the criminal justice process, there have been few attempts to examine judicial perceptions of, and attitudes towards, the sentencing process. Through interviews with Scottish judges and by presenting a comprehensive review and analysis of recent scholarship on sentencing – including a comparative study of UK, Irish and Commonwealth sentencing jurisprudence – this book explores these issues to present a systematic theory of sentencing. Through an integration of the concept of equity as particularised justice, the Aristotelian concept of phronesis (or 'practical wisdom'), the concept of value pluralism, and the focus of appellate courts throughout the Commonwealth on sentencing by way of 'instinctive synthesis', it is argued that judicial sentencing methodology is best viewed in terms of a phronetic synthesis of the relevant facts and circumstances of the particular case. The author concludes that sentencing is best conceptualised as a form of case-orientated, concrete and intuitive decision making; one that seeks individualisation through judicial recognition of the profoundly contextualised nature of the process.

What does it mean to call Western society 'secular'? What is 'secularism'? And how should we understand the concept of 'secularism' in international relations, particularly the clash between radical Islam and the West? The Latin term from which the word 'secular' is derived - 'saeculum' - means 'generation' or 'age', and came to mean that which belongs to this life, to the here and now, in this world. It is widely used as a shorthand for the ideology which shapes contemporary society without reference to the divine.However, according to Graeme Smith, 'secularism' represents a great deal more. He offers a radical reappraisal of the notion of secularism and its history, beginning with the Greeks and proceeding to modernity and the contemporary period. The assumption that the West is becoming increasingly secular is often unquestioned. A proposal for a categorization of cognition based on core properties of the constituent processes that integrates theory and empirical findings across domains. All sciences need ways to classify the phenomena they investigate; chemistry has the periodic table and biology a taxonomic system for classifying life forms. These classification schemes depend on conceptual coherence, demonstrated correspondences across paradigms. This conceptual coherence has proved elusive in psychology, although recent advances have brought the field to the point at which it is possible to define the type of classificatory system needed. This book proposes a categorization of cognition based on core properties of constituent processes, recognizing correspondences between cognitive processes with similar underlying structure but different surface properties. These correspondences are verified mathematically and shown not to be merely coincidental. The proposed formulation leads to general principles that transcend domains and paradigms and facilitate the interpretation of empirical findings. It covers human and nonhuman cognition and human cognition in all age ranges. Just as the periodic table classifies elements and not compounds, this system classifies relatively basic versions of cognitive tasks but allows for complexity. The book shows that a more integrated, coherent account of cognition would have many benefits. It would reduce the conceptual fragmentation of psychology; offer defined criteria by which to categorize new empirical results; and lead to fruitful hypotheses for the acquisition of higher cognition.

It provides a thorough review of the medical literature on the physical and psychological effects of rape, the legal and philosophical literature on the seriousness of the offence, and the victim's role in sentencing. Given the increasingly common practice of perpetrators using mobile and online technologies to film or photograph the commission of sexual offences, the book examines recent socio-legal research on technology-facilitated sexual violence and considers the implications for sentencing. By building on recent scholarship on judicial decision making in sentencing and case law – comprising over 250 decisions of the relevant appellate courts – the book explores and critically analyses judicial approaches to rape sentencing. The analysis is undertaken with a view to suggesting possible reforms to rape sentencing in 'non-guideline' jurisdictions. In so doing, this book seeks to establish general principles for sentencing rape, assisting in the imposition of proportionate sentences. The decade and a half since Gorbachev came to power has been a tumultuous time for Russia. It has seen the expectations raised by perestroika dashed, the collapse of the Soviet superpower, and the emergence of a new Russian state claiming to base itself on democratic, market principles. It has seen a political system shattered by a president turning tanks against the parliament, and then that president configuring the new political structure to give himself overwhelming power. Since the end of the Cold War, more and more countries feature political regimes that are neither liberal democracies nor closed authoritarian systems. Most research on these hybrid regimes focuses on how elites manipulate elections to stay in office, but in places as diverse as Bolivia, Georgia, Kyrgyzstan, Serbia, Thailand, Ukraine and Venezuela, protest in the streets has been at least as important as elections in bringing about political change. The Politics of Protest in Hybrid Regimes builds on previously unpublished data and extensive fieldwork in Russia to show how one high-profile hybrid regime manages political competition in the workplace and in the streets. More generally, the book develops a theory of how the nature of organizations in society, state strategies for mobilizing supporters, and elite competition shape political protest in hybrid regimes.

Together with our housekeeper, Mrs Naughtie, and of course, the Laird who lives up at the big hoose and shoots grouse and other bottles of whisky, these are the actual scripts of our wee show which we performed on the wireless, when most of you were probably in bed! Hamish and I have known each other all our lives - well, not yet, obviously! We have a very close relationship and also with each other. Mrs Naughtie been with us since we first met her at the Krankie Arms, where she was working as part-time barmaid and bouncer. In addition to the scripts you'll find all kinds of other things tucked away under its kilt. There's a hectic social life in the village. You'll visit the 'bide a wee' café, proud possessor of three Michelin tyres. You'll have a conducted tour of the big hoose by Big Tam, our local guide (not during opening hours). You'll marvel at the site of the Battle of Auchtermuchty, now allotments. You'll peek into the Laird's social diary in 'oot and aboot' (40p at the post office). And a great deal more. Well, I hope this wee note will make you hurry to the till and spend the terrible amount of money these wee books cost these days. But then again this particular wee book is Scotland's answer to Richard and Judy! Hurrah! Away now ...
