Execution of Sentences at the Level of International Tribunals and Courts: Moving Beyond the Mere Protection of Procedural Rights and Minimal Fundamental Interests? Historically, little attention was paid to the execution of sentences passed at the level of international courts and tribunals. Capital punishment was still used, and custodial sanctions were imposed in the relevant states. It was not until the 1990s, with the creation of the ad hoc tribunals, that the execution of sentences also became a task for international tribunals, in cooperation with, and by means of transferring the sentenced person to, a state which had committed itself to executing the sentence. The basic principles of these vertical transfer, or execution of sentence, procedures, as is also the case at the level of the ICC, are characterized by a system logic, with a limited role for the sentenced person. Nonetheless, minimal human rights and international standards for the execution of sentences (as agreed upon at the level of the UN) are respected. The authors investigate if and to what extent the interests of the sentenced person could be better pursued and enhanced during vertical procedures for the execution of sentences; they therefore take a clear-cut rehabilitation and social integration perspective. Given the dominant representation of EU member states among states willing to execute sentences passed by international tribunals and courts, the authors moreover wonder whether practice should not evolve towards reflecting the obligatory compliance of these states with, besides the UN standards, additional (sometimes wider, more precise and higher) Council of Europe and EU standards. This would be reflected in the policies of the tribunals and courts (especially the ICC) relating to the conclusion of sentence execution agreements with states, as well as in the actual case-based decisions in which particular sentence execution states are chosen. The authors further plead for the conclusion of a bilateral EU-ICC agreement on the execution of sentences, since this would constitute an important contribution to international justice, and one that is likely to make the reintegration and rehabilitation of offenders (a greater) part of it.

In 2008, the introduction of the EU's Framework Decision - the principle of mutual recognition of judgments in criminal matters, imposing custodial sentences or measures involving deprivation of liberty for the purpose of their enforcement - sparked discussions as to whether the practical operation of the instrument would be compatible with its very objective, being the enhancement of detained persons' social rehabilitation prospects. Transferring detained people back to their respective Member State of residence and/or nationality within the mutual recognition framework is somewhat precarious in light of the variety of Member States' legal and prison systems. In this context, and following a call for tender by the European Commission, the authors of this book conducted the largest study to date on Member States' material detention conditions, early/conditional release provisions, and sentence execution modalities. In addition to exploring the diversity of legal frameworks, the study also assessed practitioners' views on the cross-border execution of custodial sentences in the EU. This book contains EU-level legal and practitioners' analyses, as well as the high level final report to the study, confirming preliminary concerns that flanking measures are urgently needed for a proper operation of the Framework Decision. It will be essential reading for policy makers, judicial and law enforcement authorities, and defense lawyers. Additionally, it will be an asset to everyone who is involved in or taking an interest in detention issues and cross-border execution of judgements involving deprivation of liberty in the EU. Astronomy and Astrophysics Abstracts, which has appeared in semi-annual volumes since 1969, is devoted to the recording, summarizing and indexing of astronomical publications throughout the world. It is prepared under the auspices of the International Astronomical Union (according to a resolution adopted at the 14th General Assembly in 1970). Astronomy and Astrophysics Abstracts aims to present a comprehensive documenta tion of literature in all fields of astronomy and astrophysics. Every effort will be made to ensure that the average time interval between the date of receipt of the original literature and publication of the abstracts will not exceed eight months. This time interval is near to that achieved by monthly abstracting journals, compared to which our system of accumu lating abstracts for about six months offers the advantage of greater convenience for the user. Volume 32 contains literature published in 1982 and received before February 11, 1983; some older literature which was received late and which is not recorded in earlier volumes is also included. In the past decades, the European Union has made little progress with respect to disqualifications as a sanction mechanism for the violation of laws. The creation of some form of harmonization is necessary, but the complex nature of this specific sanction mechanism has caused policy initiatives to be postponed, time after time. In answer to a call from the European Commission, the contributors in this book have conducted a comparative legal analysis in the EU 27 and looked into the practical experiences with disqualifications from a domestic and a cross border perspective. To that end, academics, policy makers, and practitioners in the Member States have been consulted. Analysis reveals a wide variety in the typology of the disqualifications as a sanction measure, the typology of the persons to whom the disqualifications can be imposed, and the typology of the authorities involved. Furthermore, there are considerable differences with respect to the inclusion of disqualifications in the national criminal records databases. Linked thereto information on foreign disqualifications is scarce and rarely used in practice. To ensure a comprehensive and consistent policy approach, this book has come up with a so called disqualification triad, comprising: (1) unified EU-wide disqualifications, (2) mutual recognition of disqualifications, and (3) EU-wide equivalent effect of disqualifications. The functioning of the disqualification triad has been further elaborated on in three case studies, which are public procurement disqualifications, disqualifications from working with children, and driving disqualifications. In doing so, this book is essential reading for both EU and national policy makers, as well as for researchers and practitioners involved. In the European Union, international cooperation in criminal matters has grown exponentially over the past few decades. Importantly, there are a wide variety of authorities involved therein, rendering the traditional distinction between police and judicial cooperation as outdated. Furthermore, its rapid growth exposed this policy field to inconsistencies and incoherence. Additionally, despite the wave of new legislation, important lacunae can be identified, setting important challenges for the future. The combination of these issues clarifies the title of this book: there is a pressing need to rethink international cooperation in criminal matters. In answer to a call from the European Commission, the contributors of this book have designed a comprehensive methodological framework to review the entirety of international cooperation in criminal matters, combining desktop reviews, expert consultations, Member State questionnaires, and focus group meetings in each of the Member States to obtain a comprehensive overview of the currently experienced obstacles and future policy options that are both needed and feasible. Over 150 individuals from different backgrounds contributed to the study, including academics, lawyers, policy makers, police, customs, intelligence services, prosecution, judiciary, correctional authorities, Ministries of Justice, and Home Affairs. The book provides an overview of the research findings and the recommendations formulated. These findings include, but are not limited to: (1) a helicopter view on cooperation with criminal justice finality, (2) a clear demarcation of the role of the judicial authorities, (3) a comprehensive review of refusal grounds, including proportionality and capacity concerns, (4) an assessment of gaps in the current body of instruments regulating international cooperation in criminal matters and possible remedies thereto, (5) a well-considered further development of Eurojust, and (6) ensuring EU wide effect of mere domestic actions. This book represents the first overall analysis of the entirety of international cooperation in criminal matters in the EU.
