A complete and original theory of aesthetics based on Marx and Althusser in the modernist Marxist anti-humanist tradition (Brecht, Althusser, Benjamin, Adorno). The main concepts that arise from this work are: the aesthetic level of practice, aesthetic state apparatuses, aesthetic interpellation, and pseudo dialectics, all of which are used to understand the role of aesthetic experience and its place in everyday life. - In the space long thought as necessary to fill spanning the gap between Marx and Freud, the author proposes that aesthetics can be located and defined in a concrete way. We are therefore looking at a domain involving and implicating feelings, affections, dispositions, sensibilities and sensuality, as well as their social role in art, tradition, ritual, and taboo. With the classic Marxist concepts of base and superstructure divided into levels, economic, ideological, and political, the aesthetic level of practice is the area that has traditionally been mostly either missing or mislocated and, especially perhaps, misrepresented for political reasons. The importance of this level is that it fuels and supports the media, or as Althusser described it the 'traffic' (or mediation) between base and superstructure, although for Althusser this was ideological traffic. Here, this is also defined as aesthetic. From this vantage point, we begin to be able to see aesthetic state apparatuses, analyse how they function, both in the past, historically (for example firstly in art history), and today, in the contemporary political context, to grasp the role that art and feelings, along with affective alienation, plays in our culture as a complete and, in fact, cyclical reciprocating system. ,

The Tobacco Valley, in Montanaas far northwest corner, was so named by explorer David Thompson in 1808 upon finding the resident natives using a form of wild tobacco. The Kutenai Indians were the primary inhabitants until late in the 19th century when cattlemen found the isolated valley. By 1890, several ranching families moved cattle overland to fatten on pasture that heretofore knew only the track of a Kutenai Indian pony. Eureka came into being when the Great Northern Railroad was built through in 1904. With what seemed like limitless timber, a lumber mill was operating by 1906. The railroad brought in workers and entrepreneurs, hauling lumber out. Early on it was thought that farming might supplement the timber-based economy, but hopeful homesteaders soon learned that the Tobacco Valley would never deliver on the promise of fruits and vegetables. The new edition introduces new state court decisions addressing the issue of causation and whether and when a subrogated Plan seeking reimbursement must prove that the medical benefits it seeks to recover were causally related to the original negligence of the tortfeasor. An entirely new section was added concerning the subrogation and reimbursement rights of Medicare Advantage Plans, a statutorily-authorized Plan which provides the same benefits an individual is entitled to recover under Medicare. This includes recent case law which detrimentally affects the rights of such Plans to subrogate. Also added to the new edition is additional law and explanation regarding Medicaid subrogation, including the differentiation between “cost avoidance” and “pay and chase” when it comes to procedures for paying Medicaid claims. Significant improvements have been made to suggested Plan language which maximizes a Plan’s subrogation and reimbursement rights. The suggested language stems from recent decisions and developments in ERISA and health insurance subrogation from around the country since the last edition. The new edition has been completely reworked both in substance and organization. Recent case law has necessitated consolidation of several portions of the book and elimination or editing of others. A new section entitled “Liability of Plaintiff’s Counsel” has been added, which provides a clearer exposition on the laws applicable and remedies available when plaintiff’s attorneys and Plan beneficiaries settle their third-party cases and fail to reimburse the Plan. Dry Lab is a rather unconventional mystery novel. The setting, a biomedical research institute, as well as elements of the plot, and many of the characters are broadly drawn from my career in science. The term “dry lab” is one chemists use to describe a fraudulent experiment -- one in which no actual chemistry is done (hence the word "dry"). Rather, the data are fabricated to achieve the desired result. Instances of dry-labbing by the murder victim create a second layer of suspense as the hows and whys of his fraud are gradually uncovered. The characters include Dr. Jack Spivey, universally despised virologist and research con man; Rob Hastings, Spivey ́s insecure and ethics-ridden postdoctoral fellow; Wendy Rich, travel agent by day, animal rights activist and computer hacker by night; Eve Dash, Spivey ́s mistress and former call girl; and Vince Rubino, vending machine supplier and occasional self-induced psychopath. The action begins with Spivey ́s murder. Hastings is ordered by the Institute Director to put his former boss ́s scientific house in order, and discovers a rich legacy of laboratory larceny. As Spivey ́s academic heir, Hastings inherits the dead man ́s enemies, including the animal rights activists implicated in his murder. Computer sabotage, rodent venereal disease, toxic Twinkies and a purloined AIDS drug all figure in the plot, along with blackmail, murder, and romantic intrigue. ---The Science in Dry Lab--- The science supporting key elements of Dry Lab’s plot is both accurate and plausible, although, of course, not always practicable. The death of Jack Spivey, for example, results from administration of a monoamine oxidase inhibitor anti-depressant, a class of drugs known to cause hypertensive crisis in patients with a history of high blood pressure. This and the later attempted murder of Rob Hastings by induced anaphylactic shock both involve the use of a targeted toxin -- a substance harmless to anyone without specific susceptibility to its biological effects. Spivey’s pet project, sponsored by Thanopest Inc., to drive native rat populations into extinction using a genetically engineered rat virus reminiscent of HIV has a similar basis in real science. The effectiveness of the anti-AIDS drug Spivey sold to his acquaintance, Terry Detweiler, is a bit more of a reach, but there is precedent for anti-cancer drugs acting against viruses like HIV. AZT is one such example. The science discussed in the brainstorming session between Hastings, the Mexican scientist who discovered the drug, and Detweiler, who is also a scientist, is again plausible and internally consistent. And, finally, Rob’s rescue during his anaphylactic episode through sexual arousal should also work. Under such circumstances, a twenty-something male would release a sizable burst of adrenaline, which would most certainly help counteract the effects of the allergen.
