This book is based on four visits to China between 1971 and 1989 by Honda Katsuichi, an investigative journalist for Asahi Shimbun. His aim is to show in pitiless detail the horrors of the Japanese Army's seizure and capture of Nanjing in December 1937. Unvarnished accounts of the testimony - Chinese victims and Japanese perpetrators - to the rape and slaughter are juxtaposed with public relations announcements of the Japanese Army as printed in various Japanese newspapers of the time. The bland announcements of triumphant victories stand in bitter contrast to the atrocities that actually took place on the scene. The story unfolds with horrible detail as we watch the triumphant progress of the Japanese army whose troops were bent on rape and killing in the so-called "heat of battle." Yet by recalling the testimony of Japanese soldiers and reporters who were on the scene, as well as reproducing dispatches by Japanese Army authorities at the time, Honda makes it clear that the atrocities were part of a studied effort directed by the Japanese high command to impress the Chinese people with the power of its army and the folly of resistance to it - the estimate of 300,000 killed in these "military operations" is no exaggeratoin. The carriage of goods by sea starts off with a contract of carriage, an essentially simple and straightforward contract between two parties, the shipper and the carrier. Very often, however, a bill of lading is issued and a third party appears on the scene: the holder of the bill of lading. The holder was not involved in the making of the contract of carriage, but does have rights, and possibly obligations, against the carrier at destination. The question then is how the third-party holder of the bill acquires those rights and obligations. Analysing the different theories that have been proposed to explain the position of the third party holder, this book makes a distinction between contractual theories and non-contractual theories to explain the holder's position. Contractual theories build on the initial contract of carriage and apply contract law mechanisms while non-contractual theories construe the position of the third-party holder independently. Following the analysis and appraisal of the different theories, this book makes the case that the position of the third-party holder of the bill of lading is not obvious or self-evident; and submits that a statutory approach to the position of the holder of the bill of lading has advantages and would be preferable.
IN the earliest eras of historic Japan there existed a hereditary corporation of raconteurs (Katari-be) who, from generation to generation, performed the function of reciting the exploits of the sovereigns and the deeds of heroes. They accompanied themselves on musical instruments, and naturally, as time went by, each set of raconteurs embellished the language of their predecessors, adding supernatural elements, and introducing details which belonged to the realm of romance rather than to that of ordinary history. These Katari-be would seem to have been the sole repository of their country's annals until the sixth century of the Christian era. Their repertories of recitation included records of the great families as well as of the sovereigns, and it is easy to conceive that the favour and patronage of these high personages were earned by ornamenting the traditions of their households and exalting their pedigrees. But when the art of writing was introduced towards the close of the fourth century, or at the beginning of the fifth, and it was seen that in China, then the centre of learning and civilization, the art had been applied to the compilation of a national history as well as of other volumes possessing great ethical value, the Japanese conceived the ambition of similarly utilizing their new attainment. For reasons which will be understood by and by, the application of the ideographic script to the language of Japan was a task of immense difficulty, and long years must have passed before the attainment of any degree of proficiency.
