The carriage of goods by sea starts off with a contract of carriage, an essentially simple and straightforward contract between two parties, the shipper and the carrier. Very often, however, a bill of lading is issued and a third party appears on the scene: the holder of the bill of lading. The holder was not involved in the making of the contract of carriage, but does have rights, and possibly obligations, against the carrier at destination. The question then is how the third-party holder of the bill acquires those rights and obligations. Analysing the different theories that have been proposed to explain the position of the third party holder, this book makes a distinction between contractual theories and non-contractual theories to explain the holder's position. Contractual theories build on the initial contract of carriage and apply contract law mechanisms while non-contractual theories construe the position of the third-party holder independently. Following the analysis and appraisal of the different theories, this book makes the case that the position of the third-party holder of the bill of lading is not obvious or self-evident; and submits that a statutory approach to the position of the holder of the bill of lading has advantages and would be preferable.

This up-to-date textbook of global vegetation ecology, which comprises the current state of knowledge, is long overdue and much-needed. It is a translation of the textbook “Vegetation der Erde” (Springer-Spektrum, Heidelberg). A short introductory chapter deals with the fundamentals of vegetation ecology that are of importance for the delimitation and characterization of the global vegetation presented in this book (chorology, evolution of plants, physiognomic and structural characteristics, phytodiversity and the human impact on it as well as general terminology concerning both plant growth forms and on vegetation structure types). In the following chapters the zonal and azonal vegetation from the tropics to the polar regions including high mountains is described and discussed. The main focus is on the characterization of interactions between the spatial location of plants and plant communities on the one hand and site conditions, historic and genetic processes, spatial and temporal patterns, ecophysiology and anthropogenic influences on the other hand. During the late 19th and early 20th centuries, many Jews from Central and Eastern Europe arrived in New York City, where they did not only find a new home, but far away from their shtetl origin, the new members of the American society also began to politically radicalize. There has been a discussion in the literature related to the field, where, how, and why the Jewish population radicalized. This study analyses two waves of radicalization: one related to the American environment that is responsible for the described process at the end of the 19th century; one, related to the developments in Eastern Europe during the early decades of the 20th century. For both radicalization processes this book compares the reasons, elements, and aims of those who join radical movements to show that there is a transatlantic perspective that links both processes to each other.

The London Magazine is briefly told in the accomplisments and failures of its four editors, and during the fourteen months of his editorship, 1820-21, John Scott succeeded in establishing the London as one of the finest literary periodicals of the nineteenth century. John Taylor, the second editor, maintained the high quality of the magazine by securing many excellent writers. But by the end of 1825, the first year of Henry Southern's editorship, the magazine had lost most of its distinguished writers. In 1987 a major breakthrough occurred in materials science. A new family of materials was discovered that became superconducting above the temperature at which nitrogen gas liquifies, namely, 77 K or –196°C. Within months of the discovery, a wide variety of experimental techniques were brought to bear in order to measure the properties of these materials and to gain an understanding of why they superconduct at such high temperatures. Among the techniques used were electromagnetic absorption in both the normal and the superconducting states. The measurements enabled the determination of a wide variety of properties, and in some instances led to the observation of new effects not seen by other measu- ments, such as the existence of weak-link microwave absorption at low dc magnetic fields. The number of different properties and the degree of detail that can be obtained from magnetic field- and temperature-dependent studies of electromagnetic abso- tion are not widely appreciated. For example, these measurements can provide information on the band gap, critical fields, the H–T irreversibility line, the amount of trapped flux, and even information about the symmetry of the wave function of the Cooper pairs. It is possible to use low dc magnetic field-induced absorption of microwaves with derivative detection to verify the presence of superconductivity in a matter of minutes, and the measurements are often more straightforward than others. For example, they do not require the physical contact with the sample that is necessary when using four-probe resistivity to detect superconductivity.
Making exhibitions is a collaborative art, producing is a multi-layered unity of ideas and objects, of invention and manifestation, of content and form. However, there is an antagonistic dimension to it, because content and form are traditionally represented by the entirely different realms of curator and designer. Future successful developments in exhibition-making are dependent on whether this gap of antagonism can be bridged. space.time.narrative calls for a paradigmatic shift of focus.
