The Foundations of Restitution for Wrongs

Restitution for wrongs', or 'restitutionary damages', is the judicial award which compels the wrongdoer to give up to the victim the benefit obtained through the perpetration of the wrong, independently of any loss suffered by the victim. The establishment of a civil trial in Roman law, which left compensation as the main response, and a widespread, loss-centred interpretation of the Aristotelian theory of corrective justice explain, but do not justify the difficulties encountered by modern attempts to account for restitutionary damages. Mistakes in the classification of this institution have complicated the picture. To overcome some of these problems, this study considers the basic structure of restitutionary damages from different angles. In part one, the topic is analysed from a comparative perspective. Although the focus remains on English law, the German, the Italian and the Roman jurisdictions provide research data which, in part two, support the development of a theory of restitution for wrongs as corrective justice.

Francesco Izzo's pathbreaking study argues that in the "realm of seriousness" of mid-nineteenth-century Italy, comedywas not an anachronistic intruder, but a significant and vital cultural presence. Benvenuto Olivieri was a Florentine banker active in Rome during the first half of the sixteenth century. A self made man without any great family patrimony, he rose to prominence during the pontificate of Pope Paul III, becoming involved with a variety of papal enterprises which allowed him to get to the heart of the mechanisms governing the papal finances. Amassing a considerable fortune along the way, Olivieri soon built himself a role as co-ordinator of the appalti (revenue farms) and became one of the most powerful players in the complex network that connected bankers and the papal revenue. This book explores the indissoluble link that had developed between the papacy and bankers, illuminating how the Apostolic Chamber, increasingly in need of money, could not meet its debts, without farming out the rights to future income. Utilising documents from a rich corpus of unpublished sources in Florence and Rome, Guidi Bruscoli unravels the web of financial connections that bound together Florentine and Genoese bankers with the papacy, and looks at how money was raised and the appalti managed.

This book aims to highlight the causes why the Prohibition Era led to an evolution of the New York mob from a rural, ethnic and small-scale to an urban, American and wide-scale crime. The temperance project, advocated by the WASP elite since the early nineteenth century, turned into prohibition only after the end of WWI with the enactment of the Eighteenth Amendment. By considering the success that war prohibition made to the soldiers' psychophysical condition, Congress aimed to shift this political move even to civil society. So it was that the Italian, Irish and Jewish mobs took the chance to spread their bribe system to local politics due to the lucrative alcohol bootlegging. New York became the core of the national anti-prohibition, where the smuggling from Canada and Europe merged into the legendary Manhattan nightclubs and speakeasies. With the coming of the Great Depression, the Republican Party was aware about the failure of this political measure, leading to the making of a new corporate underworld. The book is addressed to historians of New York, historians of crime and historians of modern America as well as to an audience of readers interested in the history of the Prohibition Era.

The racism and antisemitism of Fascist Italy have often been described as ‘mild’, ‘cultural’, ‘spiritual’, and essentially non-violent, especially in comparison with the racial ideology of Nazi Germany. This book challenges this simplistic interpretation with a thorough analysis of the texts and images of the magazine La Difesa della razza (Defence of the race), the principal public voice of Fascist biological racism, which appeared fortnightly between 1938 and 1943 under the editorship of Telesio Interlandi, Mussolini’s ‘unofficial mouthpiece’, with governmental financial support. A negative icon of the propaganda of Fascist racism, La Difesa della razza first appeared in August 1938 shortly before the passing of Italy’s Racial Laws, but had a long gestation. It was the expression of a Fascist cultural milieu – journalists, writers, artists, and architects – headed by Interlandi, whose racism and antisemitism dated back to the end of the First World War. By placing the magazine’s emergence in this longer timescale, and exploring the interrelationships of political action, ideological discourse, and imagery, this book also demonstrates how the project of ‘anthropological revolution’ – building the New Man – was a central element of Italian Fascism, from the very beginning to the deportation of Italian Jews. This new English edition has been thoroughly revised and updated.

Long gone are the times when investors could make decisions based on intuition. Modern asset management draws on a wide-range of fields beyond financial theory: economics, financial accounting, econometrics/statistics, management science, operations research (optimization and Monte Carlo simulation), and more recently, data science (Big Data, machine learning, and artificial intelligence). The challenge in writing an institutional asset management book is that when tools from these different fields are applied in an investment strategy or an analytical framework for valuing securities, it is assumed that the reader is familiar with the fundamentals of these fields. Attempting to explain strategies and analytical concepts while also providing a primer on the tools from other fields is not the most effective way of describing the asset management process. Moreover, while an increasing number of investment models have been proposed in the asset management literature, there are challenges and issues in implementing these models. This book provides a description of the tools used in asset management as well as a more in-depth explanation of specialized topics and issues covered in the companion book, Fundamentals of Institutional Asset Management. The topics covered include the asset management business and its challenges, the basics of financial accounting, securitization technology, analytical tools (financial econometrics, Monte Carlo simulation, optimization models, and machine learning), alternative risk measures for asset allocation, securities finance, implementing quantitative research, quantitative equity strategies, transaction costs, multifactor models applied to equity and bond portfolio management, and backtesting methodologies. This pedagogic approach exposes the reader to the set of interdisciplinary tools that modern asset managers require in order to extract profits from data and processes.

These memories, handwritten by Elmo Cermaria (Nonno Peppe) for his grandson Checco (Francesco Nicolini), tell of when, as a young man of 20, he found himself hurled into the inferno of the First World War. In those days, you could cry your heart out for a bread roll denied, then miraculously regained thanks to the compassion of a German soldier, “the hated enemy”. These recollections are terse, without a trace of rhetoric and devoid of recriminations. Nonno Peppe tells the facts just as he experienced them first hand, without expressing any condemnation of those responsible for them, even though an awareness of the large-scale massacre he witnessed transpires from his account. When Nonno Peppe delivered the manuscript to his grandson on his wedding day, he asked him to make a promise: “Let the President of the Republic know what we did for Italy.” A hundred years ago, whole generations of young Italian men were stripped of human honor and dignity. Only a few of these young men would live on and become our grandfathers; and only a few of us would be fortunate enough to become “grandchildren of the Great War” and bear witness to their ordeal.

Territory, Time and State is a study of long term archaeological history in the remote and beautiful upland valley of Gubbio within the Umbrian Apennines of Italy. The aim of the work is well defined by the natural constraints of this mountainous region. The authors have developed a multi-disciplinary approach to study the human and physical characteristics of the valley from the paleolithic to the medieval period. They integrate the analysis of a unique text (the Iguvine Tables) with excavation, field survey and environmental reconstruction to provide a synthesis of current knowledge. They break boundaries of time and tradition which are normally compartmentalised between different scholars. Although the linkage is sometimes controversial, it is always stimulating. The book has two major focuses: the first is on the Bronze Age landscape where spectacular sites and finds have contributed very significantly to our knowledge of pre-state Italy; and the second is on the identity and character of the early city state of Gubbio and its incorporation into the Roman world.

La sopra citata volontà si è concretizzata con una apposita Convenzione, sottoscritta nel febbraio del 2018, che ha ritenuto di coinvolgere studiosi, appartenenti a prestigiose Università Italiane ed Internazionali, i cui attori principali erano quelli che fino ad allora avevano già dato il loro massimo contributo di alto valore scientifico, sia sull’ Area Lateranense sia nell’area di competenza dell’Antico Ospedale. The Conference came about as the expression of the desire of the Soprintendenza Speciale Archeologica Beni Artistici e del Paesaggio for Rome, a desire which our Administration also shared, to expand knowledge of the underground remains that stand below our hospital buildings, in relation to, and in analogy with, the work already done in the past, near the area where the Constantinian Basilica stood, which was dedicated to the Most Holy Saviour, and the adjacent areas, on which were built all the other structures to complete the Patriarchio, ever since the 4th century AD. This aforementioned desire took concrete shape with a special Agreement, signed up to in February 2018, which set out to involve academics from prestigious Universities, in Italy and abroad. The main players in this Agreement were the same ones who, up until that time, had already made their biggest contribution, of high scientific value, both in the Lateran Area and in the area pertaining to the Ancient Hospital itself.
