This course follows the development of the so-called “soft law” from its origins in public international law to commercial arbitration, where it is used today as a label for various instruments and phenomena, covering both procedural aspects and the applicable substantive law: model laws, arbitration rules, guidelines, the UNIDROIT Principles, the lex mercatoria, and others. It presents three particularly well-known sets of guidelines by the International Bar Association and discusses the pros and cons of “soft law” instruments and their potential normativity. The analysis suggests that “soft law” instruments are typically less well recognised in practice than is generally assumed. The author explains what such instruments can achieve and what minimum requirements they have to fulfil to at least aspire to some legitimacy. He argues ultimately that “soft law” instruments can be very useful tools, but they do not carry any normativity.
Fanny Mendelssohn Hensel (1805-47), pianist and composer, maintained a prolific and witty correspondence with her younger brother Felix over the course of approximately 25 years, which is here presented in English translation, with the original German for reference. As the leader of a vibrant salon, Hensel deploys her critical prowess to describe Berlin musical life, including its conservative institutions and personalities, as well as to evaluate Felix's works-in-progress in detail. We also learn about Hensel's own compositions, her attitudes toward herself as a composer, and the significance of Felix's views on the formation of those attitudes. Hensel's letters provide a fascinating glimpse into the problems and challenges facing gifted women musicians in the nineteenth century. The 150 letters are drawn from the Green Books collection of letters addressed to Felix Mendelssohn, in the Bodleian Library, Oxford. Again and again and again: PHILOSOPHIA FIAT, QUAE PHILOLOGIA FUIT! As a consequence of certain developments in these last hundred years, ancient philosophy has been slipping from the hands of philosophers to become finally an almost exclusive domain of philologists. This has been happening not only because a tremendous amount of genuinely philological work had to be done, and still is needed, in collecting and textually adjusting the pertinent material, but also because a thorough knowledge and command of the ancient languages has become ever more and more of a rarity among philosophers, unfortunately. From the viewpoint of philosophical culture, this is disastrous. For most philologists are in a state of innocence as far as philosophy is concerned. Of course, they themselves are not aware of it. But the tragicomical fact remains: They have all the answers and do not know the questions. And so, led astray by philosophical miscon ceptions, they even commit appalling philological blunders every once in a while.
Bei der Herausgabe der KLEINschen Vorlesung über die hyper geometrische Funktion erschienen nur zwei Wege gangbar: Entweder eine durchgreifende Umarbeitung, auch im großen, oder eine möglichst weitgehende Erhaltung der ursprünglichen Form. Vor allem auch aus historischen Gründen wurde der letztere Weg beschritten. Daher ist die Anordnung des Stoffes erhalten geblieben; e, s ist nur, von kleinen Änderungen abgesehen, ein Exkurs über homogene Schreibweise aus der KLEINschen Vorlesung über lineare Differentialgleichungen ein gefügt, ferner sind die Schlußbemerkungen zur geometrischen Theorie im Falle komplexer Exponenten als durch die Arbeiten von F. SCHILLING überholt, weggelassen. Aus dem obengenannten Grunde sind beispiels weise auch Entwicklungen beibehalten worden, die heute schon dem Anfänger geläufig sind (etwa die Ausführungen über stereographische Projektion). In Rücksicht auf möglichste Erhaltung der KLEINschen Darstellung sind ferner Hinweise des Herausgebers auf inzwischen ge machte Fortschritte der Wissenschaft vom Texte getrennt als Anmerkun gen am Schluß zusammengestellt. Diese Hinweise erheben aber in keiner Weise den Anspruch auf Vollständigkeit. Bei der nicht zu um gehenden Revision des Textes im einzelnen ist, dem oben angegebenen Gesichtspunkt entsprechend, möglichste Wahrung des persönlichen KLEINschen Stils angestrebt. übrigens habe ich darauf Bedacht genommen, auch dem A nlänger die Lektüre durch Anmerkungen und durch Nachweise der KLEINschen Zitate zu erleichtern. Denn zweifellos bieten gerade diese Vorlesungen eine treffliche Ergänzung und Weiterführung dessen, was der Studierende mittleren Semesters an Geometrie und Funktionentheorie kennen gelernt hat.

This important and accessible book identifies the key elements in the quest for best practice in online language teaching. The authors, all of them international experts who have made significant contributions to the debate about how to exploit the new technologies, consider online language teaching from three crucial perspectives: design, tools and pedagogy. Their recommendations are such that they can actually be realised in spite of the limitations of today's educational environments. The book demonstrates that the new technologies offer far greater potential for authentic encounters and constructivist learning than even the best classroom simulations; that automated exercise and feedback structures can be individualised and meaningful; and that if we have to teach fully by distance, these ventures no longer need to represent impoverished versions of live classes but can engender a strong sense of community. To achieve this we need to understand what elements constitute good design both in technical and pedagogical terms, to think seriously about providing the best feedback possible, and to have the courage to take the risks associated with letting go of traditional learner/teacher relationships.

In Deutschland findet diese soziale Konstruktion auf dem Boden des Integrationsdiskurses satt. Das Wesen eines Diskurses ist es, dass er nicht das Produkt einer/eines einzelnen Autorin/Autors ist, sondern in einem Prozess der Aushandlung zwischen mit mehr oder weniger Macht ausgestatteten Teilnehmer_innen sozial konstruiert wird. Der Begriff des Integrationsdiskurses liefert deshalb eine gute Folie, unter der die Beteiligung von Menschen mit Migrationshintergrund an der Integrationsdebatte untersucht werden kann. Die Leitfragen dieser Arbeit sind: 1) Wie partizipieren Menschen mit Migrationshintergrund am Integrationsdiskurs? 2) Wie verändern sie das gesellschaftliche Verständnis von Citizenship? Im Folgenden wird zunächst ein Analysemodell entwickelt, mit dem Diskurse analysiert werden können. Dabei interessiert mich insbesondere, welche Rolle dominante Diskurse sowie Interventionen von mit weniger Macht Ausgestatteten in der sozialen Konstruktion von Citizenship spielt. Anschließend werden verschiedene Studien, die das Engagement von Menschen mit Migrationshintergrund untersuchen, daraufhin analysiert, inwiefern sie Anhaltspunkte dafür bieten, wie diese sich an der sozialen Konstruktion von Citizenship beteiligen. Im abschließenden Fazit sollen die Ergebnisse unter einer Antwort auf die Leitfrage zusammengefasst dargestellt werden.
In Part 3 of the First Trilogy "Characterising Locally Finite Groups Satisfying the Strong Sylow Theorem for the Prime p" & "About the Strong Sylow Theorem for the Prime p in Simple Locally Finite Groups" & "The Strong Sylow Theorem for the Prime p in Projective Special Linear Locally Finite Groups" we continue the program begun in [10] to optimise along the way 1) its beautiful Theorem about the first type "An" of infinite families of finite simple groups step-by-step to further types by proving it for the second type "A = PSLn". We start with proving the beautiful Conjecture 2 of [10] about the General Linear Groups over (commutative) locally finite fields, stating that their rank is bounded in terms of their p-uniqueness, and then break down this insight to the Special Linear Groups and the Projective Special Linear (PSL) Groups over locally finite fields. We close with suggestions for future research -> regarding the remaining rank-unbounded types (the "Classical Groups") and the way 2), -> regarding the (locally) finite and p-soluble groups, and -> regarding Augustin-Louis Cauchy's and Évariste Galois' contributions to Sylow theory in finite groups, which culminate in the announcement of a Second Trilogy.
