Yet, according to Randy Barnett and Evan Bernick, the Supreme Court has long misunderstood or ignored the original meaning of the amendmentÕs key clauses, covering the privileges and immunities of citizenship, due process of law, and the equal protection of the laws. Barnett and Bernick contend that the Fourteenth Amendment was the culmination of decades of debates about the meaning of the antebellum Constitution. Antislavery advocates advanced arguments informed by natural rights, the Declaration of Independence, and the common law. They also utilized what is today called public-meaning originalism. Although their arguments lost in the courts, the Republican Party was formed to advance an antislavery political agenda, eventually bringing about abolition. Then, when abolition alone proved insufficient to thwart Southern repression and provide for civil equality, the Fourteenth Amendment was enacted. It went beyond abolition to enshrine in the Constitution the concept of Republican citizenship and granted Congress power to protect fundamental rights and ensure equality before the law. Revising traditional 'rise of the nation-state' narratives, this collection explores the development of and interactions among various forms of local, national, and transnational identities and affiliations during the long eighteenth century. By treating place as historically contingent and socially constructed, this volume examines how Britons experienced and related to a landscape altered by agricultural and industrial modernization, political and religious reform, migration, and the building of nascent overseas empires. In mapping the literary and cultural geographies of the long eighteenth century, the volume poses three challenges to common critical assumptions about the relationships among genre, place, and periodization. First, it questions the novel’s exclusive hold on the imagining of national communities by examining how poetry, drama, travel-writing, and various forms of prose fiction each negotiated the relationships between the local, national, and global in distinct ways. Second, it demonstrates how viewing the literature and culture of the long eighteenth century through a broadly conceived lens of place brings to the foreground authors typically considered 'minor' when seen through more traditional aesthetic, cultural, or theoretical optics. Finally, it contextualizes Romanticism’s long-standing associations with the local and the particular, suggesting that literary localism did not originate in the Romantic era, but instead emerged from previous literary and cultural explorations of space and place. Taken together, the essays work to displace the nation-state as a central category of literary and cultural analysis in eighteenth-century studies.

He uses evidence gathered in Europe and the United States--including highly confidential reports of the Nazi Security Service--to dissect the reactions, views, and conduct of disparate political and social groups, most notably the Austrian Nazi Party, the industrial working class, the Catholic Church, and the farming community. Sketching a nuanced and complex portrait of Austrian attitudes and behavior in the Nazi era, Bukey demonstrates that despite widespread dissent, discontent, and noncompliance, a majority of the Austrian populace supported the Anschluss regime until the bitter end, particularly in its economic and social policies and its actions against Jews.
The settlers of New Netherland were obligated to uphold religious toleration as a legal right by the Dutch Republic's founding document, the 1579 Union of Utrecht, which stated that "everyone shall remain free in religion and that no one may be persecuted or investigated because of religion." For early American historians this statement, unique in the world at its time, lies at the root of American pluralism. New Netherland and the Dutch Origins of American Religious Liberty offers a new reading of the way tolerance operated in colonial America. Using sources in several languages and looking at laws and ideas as well as their enforcement and resistance, Evan Haefeli shows that, although tolerance as a general principle was respected in the colony, there was a pronounced struggle against it in practice. Crucial to the fate of New Netherland were the changing religious and political dynamics within the English empire. In the end, Haefeli argues, the most crucial factor in laying the groundwork for religious tolerance in colonial America was less what the Dutch did than their loss of the region to the English at a moment when the English were unusually open to religious tolerance. This legacy, often overlooked, turns out to be critical to the history of American religious diversity. This book traces the history of working people who helped established the foundation of the American empire in the Pacific from its origins after the American Revolution to its coming of age in the 1840s and 1850s. Beginning with the expeditions of the Columbia and the Lady Washington, Lampe argues that the early American Pacific can best be considered through the interaction of four major locations, connected through the networks of trade: the merchant ship, the Northwest Coast, Honolulu, and Canton (Guangzhou). In each of these locations, the labors of a diverse population of working people was harnessed in the critical labors of empire building, including the transportation of goods. The central question that the consideration of working people in the Pacific economy during this period is, Lampe argues, the role of power applied on these laborers by an international capitalist class, emerging alongside the Pacific commercial empires. Lampe also finds that this power was not uncontested and emerged in response to the activities of labor. Working people, on the ship and in the port cities, found ways to secure their piece of the profitable trade, often through illicit means.
