Through jurisdictional competition, law markets promise to improve our laws and, by establishing certainty, streamline the operation of the legal system. But the law market also limits governments' ability to enforce regulations and protect citizens from harmful activities. Given this tradeoff, O'Hara and Ribstein argue that simple contractual choice-of-law rules can help maximize the benefits of the law market while tempering its social costs. They extend their insights to a wide variety of legal problems, including corporate governance, securities, franchise, trust, property, marriage, living will, surrogacy, and general contract regulations. In Imagining a Greater Germany, Erin R. Hochman offers a fresh approach to the questions of state- and nation-building in interwar Central Europe. Ever since Hitler annexed his native Austria to Germany in 1938, the term "Anschluss" has been linked to Nazi expansionism. The legacy of Nazism has cast a long shadow not only over the idea of the union of German-speaking lands but also over German nationalism in general. Due to the horrors unleashed by the Third Reich, German nationalism has seemed virulently exclusionary, and Anschluss inherently antidemocratic. However, as Hochman makes clear, nationalism and the desire to redraw Germany’s boundaries were not solely the prerogatives of the political right. Focusing on the supporters of the embattled Weimar and First Austrian Republics, she argues that support for an Anschluss and belief in the großdeutsch idea (the historical notion that Germany should include Austria) were central to republicans’ persistent attempts to legitimize democracy. With appeals to a großdeutsch tradition, republicans fiercely contested their opponents’ claims that democracy and Germany, socialism and nationalism, Jew and German, were mutually exclusive categories. They aimed at nothing less than creating their own form of nationalism, one that stood in direct opposition to the destructive visions of the political right. By challenging the oft-cited distinction between "good" civic and "bad" ethnic nationalisms and drawing attention to the energetic efforts of republicans to create a cross-border partnership to defend democracy, Hochman emphasizes that the triumph of Nazi ideas about nationalism and politics was far from inevitable.

Why are preservice teachers often told by veteran teachers to "forget what you learned" in teacher preparation programs? Why is there a gap between pedagogical practices employed at schools and those taught at colleges and universities? And why, after evidence from countless studies, are there still so few teachers of color working in our rapidly diversifying schools? These questions are addressed in this book, which describes a reconceptualized teacher preparation program based on a teacher residency model. This model is grounded in three core beliefs: first, that teacher quality is a shared responsibility between universities and school districts; second, that all students have a right to high-quality teachers who are as racially, ethnically, and linguistically diverse as the students they teach; and third, that for education to be transformative, future educators must have the right balance of theoretical knowledge and practical experiences grounded in specific contexts. Through a combination of rich description and qualitative and quantitative program data, the authors make the case that university programs focused on the communities they serve can ensure more effective, learner-ready teachers who remain in the profession longer. By providing a detailed blueprint for program development, the contents of this book will be of value and interest to educational leaders, policy makers, and researchers.

Why do Blacks underperform in school? Researchers continue to pursue this question with vigor not only because Blacks currently lag behind Whites on a wide variety of educational indices but because the closing of the Black-White achievement gap has slowed and by some measures reversed during the last quarter of the 20th century. The social implications of the persistent educational 'gap' between Blacks and Whites are substantial. Black people's experience with poor school achievement and equally poor access to postsecondary education reduces their probability for achieving competitive economic and social rewards and are inconsistent with repeated evidence that Black people articulate high aspirations for their own educational and social mobility. Despite the social needs that press us towards making better sense of 'the gap,' we are, nevertheless, limited in our understanding of how race operates to affect Black students' educational experiences and outcomes. In Beyond Acting White we contend with one of the most oft cited explanations for Black underachievement; the notion that Blacks are culturally opposed to 'acting White' and, therefore, culturally opposed to succeeding in school. Our book uses the 'acting White' hypothesis as the point of departure in order to explore and evaluate how and under what conditions Black culture and identity are implicated in our understanding of why Black students continue to lag behind their White peers in educational achievement and attainment. Beyond Acting White provides a response to the growing call that we more precisely situate how race, its representations, intersectionalities, and context specific contingencies help us make better sense of the Black-White achievement gap.

Despite years of research, debate and changes in mental health policy, there is still a lack of consensus as to what recovery from psychosis actually means, how it should be measured and how it may ultimately be achieved. In Recovering from a First Episode of Psychosis: An Integrated Approach to Early Intervention, it is argued that recovery from a first episode of psychosis (FEP) is comprised of three core elements: symptomatic, social and personal. Moreover, all three types of recovery need to be the target of early intervention for psychosis programmes (EIP) which provide evidence-based, integrated, bio-psychosocial interventions delivered in the context of a value base offering hope, empowerment and a youth-focused approach. Over the 12 chapters in the book, the authors, all experienced clinicians and researchers from multi-professional backgrounds, demonstrate that long-term recovery needs to replace short term remission as the key target of early psychosis services and that, to achieve this, we need a change in the way we deliver EIP: one that takes account of the different stages of psychosis and the ‘bespoke’ targeting of integrated medical, psychological and social treatments during the ‘critical period’. Illustrated with a wealth of clinical examples, this book will be of great interest to clinical psychologists, psychiatrists, psychiatric nurses and other associated mental health professionals.

As a critical voice of the poor and marginalized, many are engaged in a global struggle for democratic norms and social justice. Yet the potential for NGOs to bring about meaningful change is limited. This book examines whether improvements in participatory opportunities for progressive NGOs results in substantive and normative policy change in one of the major trading powers, the European Union. Hannah advances a constructivist account of the role of NGOs in the EU’s trade policymaking process. She argues that NGOs have been instrumental in providing education, raising awareness, and giving a voice to broader societal concerns about proposed trade deals, both when they take advantage of formal participatory opportunities and when they protest from the streets and in the media. However, the book also highlights how NGO inputs are mediated by the social structure of global trade governance. Epistemes—the background knowledge, ideological and normative beliefs, and shared assumptions about how the world works—determine who has a voice in global trade governance. Showing how NGOs succeed only when their advocacy conforms broadly to the dominant episteme, this book will be of value to scholars and students with an interest in NGOs and international trade negotiations. It will also be of interest to policymakers, national trade negotiators, government departments, and the trade policy community.

In the 1920s a distinctively American detective fiction emerged from the pages of pulp magazines. The “hard-boiled” stories published in Black Mask, Dime Detective, Detective Fiction Weekly, and Clues featured a new kind of hero and soon challenged the popularity of the British mysteries that held readers in thrall on both sides of the Atlantic. In Hard-Boiled Erin A. Smith examines the culture that produced and supported this form of detective story through the 1940s. Relying on pulp magazine advertising, the memoirs of writers and publishers, Depression-era studies of adult reading habits, social and labor history, Smith offers an innovative account of how these popular stories were generated and read. She shows that although the work of pulp fiction authors like Dashiell Hammett, Raymond Chandler, and Erle Stanley Gardner have become “classics” of popular culture, the hard-boiled genre was dominated by hack writers paid by the word, not self-styled artists. Pulp magazine editors and writers emphasized a gritty realism in the new genre. Unlike the highly rational and respectable British protagonists (Miss Marple and Hercule Poirot, for instance), tough-talking American private eyes relied as much on their fists as their brains as they made their way through tangled plotlines. Casting working-class readers of pulp fiction as “poachers,” Smith argues that they understood these stories as parables about Taylorism, work, and manhood; as guides to navigating consumer culture; as sites for managing anxieties about working women. Engaged in re-creating white, male privilege for the modern, heterosocial world, pulp detective fiction shaped readers into consumers by selling them what they wanted to hear – stories about manly artisan-heroes who resisted encroaching commodity culture and the female consumers who came with it. Commenting on the genre’s staying power, Smith considers contemporary detective fiction by women, minority, and gay and lesbian writers.

The Mind of the Holocaust Perpetrator in Fiction and Nonfiction examines texts that portray the inner experience of Holocaust perpetrators and thus transform them from archetypes of evil into complex psychological and moral subjects. Employing relevant methodological tools of narrative theory, Erin McGlothlin analyzes these unsettling depictions, which manifest a certain tension regarding the ethics of representation and identification. Such works, she asserts, endeavor to make transparent the mindset of their violent subjects, yet at the same time they also invariably contrive to obfuscate in part its disquieting character. The Mind of the Holocaust Perpetrator in Fiction and Nonfictioncontains two parts. The first focuses on portraits of real-life perpetrators in nonfictional interviews and analyses from the 1960s and 1970s. These works provide a nuanced perspective on the mentality of the people who implemented the Holocaust via the interventional role of the interviewer or interpreter in the perpetrators’ performances of self-disclosure. In part two, McGlothlin investigates more recent fictional texts that imagine the perspective of their invented perpetrator-narrators. Such works draw readers directly into the perpetrator’s experience and at the same time impede their access to the perpetrator’s consciousness by retarding their affective connection. Demonstrating that recent fiction featuring perpetrators as narrators employs strategies derived from earlier nonfictional portrayals, McGlothlin establishes not only a historical connection between these two groups of texts, whereby nonfictional engagement with real-life perpetrators gradually gives way to fictional exploration, but also a structural and aesthetic one. The book bespeaks new modes of engagement with ethically fraught questions raised by our increasing willingness to consider the events of the Holocaust from the perspective of the perpetrator. Students, scholars, and readers of Holocaust studies and literary criticism will appreciate this closer look at a historically taboo topic.

Murphy shows the perils of a society in which "stop-and-frisk" becomes "stop-and-spit," or in which police pose undercover to get a DNA sample from your discarded lunch. Already, police can collect DNA when making an arrest, sometimes before charging a person with a crime. The government is building a massive DNA database, stockpiling samples from as much as a third of the male population, and the laws regulating what they can and cannot do with them are weak. Murphy shows how this invites the riskiest kind of genetic surveillance imaginable. Just because DNA testing is good science does not mean that it is foolproof. Faulty forensic science is the number two factor leading to wrongful conviction, and yet we have done little to improve the use of science in criminal justice.
