Although a poor replacement for a professional military in wartime, the militia embodied a set of ideas that defined attitudes toward social order, civic responsibility, and the nature and relative powers of the government. It was the supreme expression of civic values in a traditional, communal, agrarian village society. Rowe argues that the antebellum militia should be seen as a social and political institution, rather than a military one, and contends that it is a key to understanding the political and social values of early 19th century America. Ultimately, changing social and political values, demographic change and mobility, and finally the dramatic expansion of federal power occasioned by the Civil War would destroy the traditional militia. Because the militia's functions, failures, and meanings were most clearly apparent in new settlements along the frontier, Rowe examines three case studies that represent successive leaps across the Appalachians (Kentucky), the Mississippi (Missouri), and the Great Plains (Washington Territory). The first generation of settlers in Kentucky deliberately built a formal militia organization, in part for self-defense, in part as an explicit ideological and political statement. Despite both pre-existing Franco-Spanish militia and federal attempts to use the Territory in militia reform, American settlers in Missouri created a traditional Anglo-American militia there. A generation later, settlers in Washington Territory attempted to do the same, but the effort dissolved in a bitter controversy over the territorial governor's declaration of martial law.

John Armstrong was destined to be a humble farmer on the Pennsylvania frontier until the American Revolution changed his life. In all our history there is no more despicable character.” Rebuilding his life in Ohio and Indiana, Armstrong became a noted government official, militia officer, land speculator, and pioneer.

In The Making of Reverse Discrimination Ellen Messer-Davidow offers a fresh and incisive analysis of the legal-judicial discourse of DeFunis v. Odegaard (1974) and Regents of the University of California v. Bakke (1978), the first two cases challenging race-conscious admissions to professional schools to reach the US Supreme Court. While the voluminous literature on DeFunis and Bakke has focused on the Supreme Court’s far from definitive answers to important constitutional questions, Messer-Davidow closely examines each case from beginning to end. She investigates the social surrounds where the cases incubated, their tours through the courts, and their aftereffects. Her analysis shows how lawyers and judges used the mechanisms of language and law to narrow the conflict to a single white male applicant and a single white-dominated university program to dismiss the historical, sociological, statistical, and experiential facts of “systemic racism” and thereby to assemble “reverse discrimination” as a new object of legal analysis. In exposing the discursive mechanisms that marginalized the interests of applicants and communities of color, Messer-Davidow demonstrates that the construction of facts, the reasoning by precedent, and the invocation of constitutional principles deserve more scrutiny than they have received in the scholarly literature. Although facts, precedents, and principles are said to bring stability and equity to the law, Messer-Davidow argues that the white-centered narratives of DeFunis and Bakke not only bleached the color from equal protection but also served as the template for the dozens of anti–affirmative action projects—lawsuits, voter referenda, executive orders—that conservative movement organizations mounted in the following years.

This book explores the application of federal Indian policy to Alaska Natives in the 20th century, a process driven by the federal government's desire to acquire Indian land. Twentieth century Indian policy, as applied in Alaska, has oscillated between encouraging the privatization of land and assimilation of Native Alaskans into the dominant society, and allowing for Native autonomy and self-government. The Alaska Reorganization Act of 1936, better known as the Alaska Native New Deal, promoted Native self-government through constitutions and native self-sufficiency through corporations within geographic limits of designated reservations. In Alaska, the federal government's termination policy extended state jurisdiction over Native peoples after World War Two. A new policy of self-determination was initiated by the passage of the Alaska Native Claims Settlement Act of 1971. With this act, 40 million acres were conveyed to newly created Native corporations. Alaska Natives would achieve self-determination by participation in corporate decisions. This history of the legislation and implementation of federal Indian policy in Alaska explores the tensions and reversals expressed through successive legislative acts, and focuses upon the implications of this policy for Native Alaskans.
