This volume, the second in the series The Judges, which collects and synthesizes the opinions of leading international contemporary judges who have contributed significantly to the progressive development of international law, is devoted to the work of Judge Manfred Lachs, who was elected to the International Court of Justice in 1967. The US administration’s pursuit of the Al-Qaeda organisation and Taliban régime in Afghanistan, responsible for the September 11, 2001 international terrorist attacks, was supported by an international “coalition of the willing” and backed by the full legal authority of UN Security Council Resolutions. The US bid to follow this successful multilateral initiative with similar armed intervention against Saddam Hussein’s government failed to rally support in the Security Council. The US then proceeded to act unilaterally, and with British military support, to invade Iraq. The problems for contemporary international law and the UN Charter based World Order system posed by the conflicts within the Security Council and the assorted legal claims advanced, such as a revived doctrine of Humanitarian Intervention; régime change as a justification for intervention; Preemptive military strikes as an exercise in Self-defence; and Multilateralism versus Unilateralism in the exercise of the Peace and Security powers under the UN Charter, are canvassed in the present collection of legal opinions.

Originally published in 1967. The nationalistic sentiment of French Canada was starkly dramatized by the Montreal terrorist bombings in the spring of 1963. Admittedly the work of extremists, that eruption of violence was an offshoot of the profound social, political, economic, and cultural transformation—an accelerated evolution rather than a revolution—that Quebec has undergone since the end of World War II. This revolution tranquille is characterized by a new sense of self-confidence among French Canadians, an eagerness to reject what they regard as any hint of second-class citizenship, and a determination to take full share in all aspects of Canadian life—without, however, sacrificing their French culture and heritage. A threat to the Canadian Confederation is implicit in the growing reluctance of modern French-speaking Canadians to abide the "tyranny of the majority," however enlightened or well-intentioned it may be. This first book-length study in English of the conflict between French and English Canadians provides a thorough treatment of French-Canadian complaints against English Canada, and of their implications for Canadian unity. Dr. Corbett devotes the first part of his study to an analysis of the ferment within the French-speaking population of Quebec during the postwar period. He discusses the relation between French-Canadian nationalism and other nationalisms and the roles played by the language barrier, the church, and the separatist movement. In the second part of the study he considers the political, economic, and social implications of separatism, with particular regard to the proposals for adapting the Constitution to Quebecois demands. After tracing the evolution of the ambivalent English-Canadian concept of Canada's national identity, he concludes that the future of the Confederation will depend on how far the English majority is willing to go in meeting French demands.

At 1.20 a.m. on 24 March 1922, five men, four dressed in British police uniforms, broke into the North Belfast house of Owen McMahon, a well-known Catholic publican. They fatally shot McMahon, four of his sons and Eddie McKinney, an employee of the family. Nobody was ever charged for these ruthless and cold-blooded murders. In retaliation for these and other Belfast murders, the IRA assassinated the former head of the British Army, Field Marshal Sir Henry Wilson, and a subsequent British ultimatum to the Irish government sparked the first salvos of the Irish Civil War days later. The reluctance of the unionist Belfast government to pursue loyalist killers drove the rift between Northern Ireland’s two main communities even deeper, laying the foundations for the Troubles at the end of the twentieth century. Over 100 years later, Edward Burke has expertly uncovered the identity of the McMahons’ likely murderer. This is a riveting cold-case investigation that invokes the smoke-filled streets of Belfast during the cataclysmic violence of 1920–22, and explores how the ramifications of the McMahon killings are still being felt to this day.

In response, a consensus is beginning to emerge that it is vitally important that children maintain meaningful relationships with both parents after divorce. In The Equal Parent Presumption, Edward Kruk proposes a child-focused approach based on a standard that considers the best interests of the child from the perspective of the child and a responsibility-to-needs orientation to social justice for children and families. Challenging previous research and received ideas, Kruk presents an evidence-based framework of equal parental responsibility as the most effective means of ensuring the protection of family relationships following divorce, and shielding children from ongoing parental conflict and family violence. The existing system of determining parental rights and responsibilities is harming families. The Equal Parent Presumption addresses a major barrier to the principle of gender equality in parenting after divorce, and proposes a viable alternative to sole custody in the form of a legal presumption of shared and equal parenting.
