Fair Opportunity and Responsibility lies at the intersection of moral psychology and criminal jurisprudence and analyzes responsibility and its relations to desert, culpability, excuse, blame, and punishment. It links responsibility with the reactive attitudes but makes the justification of the reactive attitudes depend on a prior and independent conception of responsibility. Responsibility and excuse are inversely related; an agent is responsible for misconduct if and only if it is not excused. As a result, we can study responsibility by understanding excuses. We excuse misconduct when an agent's capacities or opportunities are significantly impaired, because these capacities and opportunities are essential if agents are to have a fair opportunity to avoid wrongdoing. This conception of excuse tells us that responsibility itself consists in agents having suitable cognitive and volitional capacities - normative competence - and a fair opportunity to exercise these capacities free from undue interference - situational control. Because our reactive attitudes and practices presuppose the fair opportunity conception of responsibility, this supports a predominantly retributive conception of blame and punishment that treats culpable wrongdoing as the desert basis of blame and punishment. We can then apply the fair opportunity framework to assessing responsibility and excuse in circumstances of structural injustice, situational influences in ordinary circumstances and in wartime, insanity and psychopathy, immaturity, addiction, and crimes of passion. Though fair opportunity has important implications for each issue, treating them together allows us to explore common themes and appreciate the need to take partial responsibility and excuse seriously in our practices of blame and punishment.

In this book, the author provides an account of three central ideas in the philosophy of action: trying to act, acting or doing, and one’s action causing further consequences. In all three cases, novel theories of these phenomena are offered: trying to act is not a particular mental or physical act but can be explained using conditionals; that action is not the same as causing something to happen; and in the case of a special but important subset of actions, for example the opening of a window, the action is identical to the event of the window’s opening. Set within the context of the political and ideological developments of the time, History vs. Apologetics examines the role played by the Catholic Church in the rise and consolidation of the Third Reich and in particular with regard to the Nazi persecution of the Jews. Distanced in the beginning, the Catholic Church and the Nazi party drew closer as Hitler's popularity increased. At the ratification of the Concordat in Rome, a commitment not to interfere with the Nazis' 'Final Solution' to the 'Jewish Question' was traded for a verbal promise from Berlin to exclude the baptized converts. While the Nazi government violated the Concordat at every turn, the Church kept zealously its promise. Pope Pius XII never mentioned the persecuted Jews by name and denied any knowledge of the annihilation of the Jews. Even after the war, Pius XII refused to condemn anti-Semitism and Germany's role in the Holocaust. Instead, the Vatican engaged in the protection of genocide perpetrators and assisted in their mass escape. David Cymet's comprehensive critical analysis of the polemical literature on the topic makes it possible to separate legitimate history from apologetic allegations and misrepresentations, bringing to light key elements of Church policy that is intentionally misinterpreted by apologists. By surveying the Church's policy from just before the rise of Nazism to the present, Cymet demonstrates how the Nazis were able to turn the Catholic Church into their ally in their war against the Jews.
