The global spread of transnational mining investment, which has been taking place since the 1990s, has led to often volatile conflicts with local communities. This book examines the regulation of these conflicts through national, transnational and local legal processes. In doing so, it examines how legal authority is being redistributed among public and private actors, as well as national and transnational actors, as a result of globalizing forces. The book presents a case study concerning the negotiation of land transfer and resettlement between a transnational mining enterprise and indigenous peasants in the Andes of Peru. The case study is used to explore the intensely local dynamics involved in negotiations between corporate and community representatives and the role played by legal ordering in these relations. Challenging views prevalent among Western and Polish scholars, this book explains Poland's surprising success in developing effective environmental and occupational regulatory systems while achieving remarkable socioeconomic growth, despite the toxic legacy of the Communist era. It offers rich insights into the questions of how one can achieve both economic growth and improved environmental and safety protection, and of the extent to which regulatory systems can be transferred across national and cultural boundaries. The authors develop a theoretical framework for assessing regulatory success, then use it to analyze Poland's recent experience. Grounded in five case studies of recently privatized firms, the analysis also presents a new survey of privately owned firms, extensive policy and data analysis, and interviews with key policy leaders, entrepreneurs, and intellectuals. The book points to case-specific decision making and information richness as key dimensions of an effective regulatory system and considers in depth the extent to which information richness is culturally dependent, and hence its portability as a policy tool. This edited collection brings together a broad range of case studies to highlight the role of Canadian corporations in producing, deepening and exacerbating conditions of dispossession both at home and abroad. Rather than presented as instances of exceptional greed or malice, the cases are described as expected and inherent consequences of contemporary capitalism and/or settler colonialism. A core purpose of the book is to combine and synthesize analyses of dispossession within and outside of Canada. While the literature tends to treat the two as distinct and unrelated phenomena, these processes are often connected, as the normalization of settler colonialism at home can lead to indifference and acceptance of dispossession caused by Canadian companies abroad. This book brings local and global cases together in order to present a rigorous analysis of the role of Canadian corporate activity in processes of dispossession. From the Executive Summary: This study of federal government trade decision-making focuses on the traditional concerns of commercial policy - tariffs and non-tariff barriers to imports...In contrast to many IRRP studies, this one does not specifically aspire to reform the trade decision-making process in Canada. Its more restricted purpose is to provide, as objectivelly as possible, a descriptive analysis of how trade decisions were made by the Trudeau government in the years 1968 to 1979. This empirical orientation is reflected in our testing of several well-known decision models against information gathered in interviews with politicians, public servants and private citizens. These decision models are outlined in Chapter One....Chapter Two consists of a description of the broad environment of trade decision-makers...It is intended primarily as backgroun for the uninitiated.
