The quantification of contractual money awards is a topic of both significant theoretical interest and immense practical importance. Recent debates have ranged from the availability of gain-based relief to the basis for principles of remoteness and mitigation. While these and other important issues, such as the recovery of damages for non-pecuniary loss, are touched upon, the book's principal objective is to challenge the conventional interpretation of the principle generally acknowledged to govern this area of the law, which Parke B famously laid down in Robinson v Harman. According to this conventional interpretation, the objective of all money awards given in accordance with the Robinson v Harman principle is simply to 'compensate' the promisee for the 'loss' that can be attributed to the promisor's failure to perform as promised. After challenging this orthodoxy, Dr Winterton proposes a new understanding of the Robinson v Harman principle, which draws an important distinction between money awards that substitute for the performance promised and money awards that aim to make good certain detrimental factual consequences that can be attributed to a promisor's breach. In exploring the significance of this distinction, the different principles underpinning the quantification and restriction of each kind of award are explored in addition to some important theoretical issues such as the effect that the occurrence of a breach has on the rights generated by contract formation. The book's unifying objective is to outline a coherent picture of the law of contractual money awards. It will be of interest to judges, practitioners and academics alike. Made up of members of the Coldstream and Scots Guards, British Yeomanry cavalry regiments, New Zealanders, South Africans, and Indian Army men, the Long Range Desert Group was perhaps the most effective of all the "special forces" established by the Allies during the Second World War. It was able to go thousands of miles into enemy territory, well-armed and carrying its own supplies of petrol, food and even water to last for weeks at a time - something quite new in military history. Using experience acquired in WWI and inter-war exploration travels, the LRDG thus developed the ability to appear almost anywhere in the desert to carry out almost every type of ground reconnaissance mission possible in desert warfare, exploring and mapping the terrain, transporting agents behind enemy lines or determining the strength and location of enemy forces with an extraordinary degree of accuracy and detail and thus able to verify or hide Ultra intelligence. Equally important were their skills in the art of desert navigation, demonstrated in the outflanking of the enemy during the Allied advance from El Alamein westward to Tunisia, as led by the LRDG. Once it had teamed up with the Special Air Service (SAS), made up of British, Free French, Commonwealth and Jewish Palestinian soldiers, the LRDG perfected the art of irregular mechanized warfare conducted in the rear of the enemy's forces in the desert, attacking enemy installations of all kinds, mining roads, raiding airfields, destroying enemy aircraft on the ground and inflicting losses upon the enemy in inverse proportion to their own remarkably low rate of casualties. Through meticulous research in original archival material, this book thus tells the extraordinary story of how a relatively small number of dedicated men developed the methods and techniques for crossing by motor vehicle the depths of the then unmapped and seemingly impassable great deserts of Egypt and Libya, the Western Desert, during the British Army's North African Campaign of 1940-43. The Long Range Desert Group and the Special Air Service as a matter of course did extraordinary things - the heroic was the commonplace. Their tactics, techniques and remarkable success in desert warfare continue to make them of great interest to the student of military affairs. Likewise, as it seeks to answer how the deep desert can best be used for military purposes, this study is pertinent to today's military operations, perhaps more so than at any time since World War II. The counterinsurgency (COIN) paradigm dominates military and political conduct in contemporary Western strategic thought. It assumes future wars will unfold as "low intensity" conflicts within rather than between states, requiring specialized military training and techniques. COIN is understood as a logical, effective, and democratically palatable method for confronting insurgency—a discrete set of practices that, through the actions of knowledgeable soldiers and under the guidance of an expert elite, creates lasting results. Through an extensive investigation into COIN's theories, methods, and outcomes, this book undermines enduring claims about COIN's success while revealing its hidden meanings and effects. Interrogating the relationship between counterinsurgency and war, the authors question the supposed uniqueness of COIN's attributes and try to resolve the puzzle of its intellectual identity. Is COIN a strategy, a doctrine, a theory, a military practice, or something else? Their analysis ultimately exposes a critical paradox within COIN: while it ignores the vital political dimensions of war, it is nevertheless the product of a misplaced ideological faith in modernization.

From 1896 to 1924, motivated by fears of an irresistible wave of Asian migration and the possibility that whites might be ousted from their position of global domination, British colonists and white Americans instituted stringent legislative controls on Chinese, Japanese, and South Asian immigration. Historians of these efforts typically stress similarity and collaboration between these movements, but in this compelling study, David C. Atkinson highlights the differences in these campaigns and argues that the main factor unifying these otherwise distinctive drives was the constant tensions they caused. Drawing on documentary evidence from the United States, Great Britain, Australia, Canada, South Africa, and New Zealand, Atkinson traces how these exclusionary regimes drew inspiration from similar racial, economic, and strategic anxieties, but nevertheless developed idiosyncratically in the first decades of the twentieth century. Arguing that the so-called white man's burden was often white supremacy itself, Atkinson demonstrates how the tenets of absolute exclusion--meant to foster white racial, political, and economic supremacy--only inflamed dangerous tensions that threatened to undermine the British Empire, American foreign relations, and the new framework of international cooperation that followed the First World War.
