The Law of Debtors and Creditors is a new case book for a three-unit law school course focusing on the basic principles of American debtor-creditor law. The book focuses on the law of execution on money judgments, using New York law as a paradigm. It also thoroughly covers fraudulent conveyance law, as it exists under state law and under bankruptcy in general. The book also explores the basic principles of chapter 7 liquidation, as well as a thorough review of the avoidance powers granted to a bankruptcy trustee under the Bankruptcy Code. Excluded from this volume is coverage of issues unique to consumer bankruptcy, on which the author has published a separate case book with Vandeplas Publishing, LLC. About the author: David Gray Carlson is Professor of Law at the Benjamin N. Cardozo School of law. He is the author of a treatise on secured credit in bankruptcy and of over sixty law review articles on various aspects of bankruptcy and debtor-creditor law. Many of these articles have involved procedural and constitutional issues connected with the enforcement of money judgments obtained in state and federal courts and issues involving fraudulent conveyance and voidable preference law, all of which are implicated in the current volume. He has taught a basic debtor-creditor course for over 25 years. Besides teaching at Cardozo Law School, Carlson has taught at the George Washington School of Law, the, University of Miami Law School, the University of Michigan Law School, Washington & Lee School of Law, and the Interdisciplinary Institute at Herzlya, Israel.

David Gray Carlson and Peter Goodrich argue that the postmodern legal mind can be characterized as having shifted the focus of legal analysis away from the modernist understanding of law as a system that is unitary and separate from other aspects of culture and society. In exploring the various "other dimensions" of law, scholars have developed alternative species of legal analysis and recognized the existence of different forms of law. Carlson and Goodrich assert that the postmodern legal mind introduced a series of "minor jurisprudences" or partial forms of legal knowledge, which both compete with and subvert the modernist conception of a unitary system of law. In doing so scholars from a variety of disciplines pursue the implications of applying the insights of their disciplines to law. Carlson and Goodrich have assembled in this volume essays from some of our leading thinkers that address what is arguably one of the most fundamental of interdisciplinary encounters, that of psychoanalysis and law. While psychoanalytic interpretations of law are by no means a novelty within common law jurisprudence, the extent and possibilities of the terrain opened up by psychoanalysis have yet to be extensively addressed. The intentional subject and "reasonable man" of law are disassembled in psychoanalysis to reveal a chaotic and irrational libidinal subject, a sexual being, a body and its drives. The focus of the present collection of essays is upon desire as an inner law, upon love as an interior idiom of legality, and represents a signficant and at times surprising development of the psychoanalytic analysis of legality. These essays should appeal to scholars in law and in psychology. This book examines the archival aesthetic of mourning and memory developed by Latin American artists and photographers between 1997-2016. Particular attention is paid to how photographs of the assassinated or disappeared political dissident of the 1970s and 1980s, as found in family albums and in official archives, were not only re-imagined as conduits for private mourning, but also became allegories of social trauma and the struggle against socio-political amnesia. Memorials, art installations, photo-essays, street projections, and documentary films are all considered as media for the reframing of these archival images from the era of the Cold War dictatorships in Argentina, Chile, Guatemala, and Uruguay. While the turn of the millennium was supposedly marked by “the end of history” and, with the advent of digital technologies, by “the end of photography,” these works served to interrupt and hence, belie the dominant narrative on both counts. Indeed, the book's overarching contention is that the viewer’s affective identification with distant suffering when engaging these artworks is equally interrupted: instead, the viewer is invited to apprehend memorial images as emblems of national and international histories of ideological struggle.

The ongoing project seeks to understand humanity's relation to nature in a profoundly ethical way. This volume develops an understanding in ecological terms. It does so by examining the notion of giving in relation to having, calling into question the ways in which being human, and being itself, have been understood in terms of what one must have and possess in order to live well—goods, qualities, a body, a dwelling, freedom, land, children, family, things, knowledge, power, authenticity—all forms of genitivity. Having is explored in terms of ecstasy, squander, generosity, and sustenance, then as betrayal and forgiveness. Betrayal is understood as the expressiveness of things, always promised to circulation in abundance beyond containment, use or profit: the circulation of goods and commodities together with the circulation of images, meanings, language, and writing.

Coping with the practical problems of bureaucracy is hampered by the limited self-conception and the constricted mindsets of mainstream public administration thinking. Modernist public administration theory, although valuable and capable of producing ever more remarkable results, is limiting as an explanatory and catalytic force in resolving fundamental problems about the nature, size, scope, and functioning of public bureaucracy and in transforming public bureaucracy into a more positive force. This original study specifies a reflexive language paradigm for public administration thinking and shows how a postmodern perspective permits a revolution in the character of thinking about public bureaucracy. The author considers imagination, deconstruction, deterritorialization, and alterity. Philosophy in the middle of the 20th Century, between 1920 and 1968, responded to the cataclysmic events of the time. Thinkers on the Right turned to authoritarian forms of nationalism in search of stable forms of collective identity, will, and purpose. Thinkers on the Left promoted egalitarian forms of humanism under the banner of international communism. Others saw these opposed tendencies as converging in the extinction of the individual and sought to retrieve the ideals of the Enlightenment in ways that critically acknowledged the contradictions of a liberal democracy racked by class, cultural, and racial conflict. Key figures and movements discussed in this volume include Schmitt, Adorno and the Frankfurt School, Arendt, Benjamin, Bataille, French Marxism, Black Existentialism, Saussure and Structuralism, Levi Strauss, Lacan and Late Pragmatism. These individuals and schools of thought responded to this 'modernity crisis' in different ways, but largely focused on what they perceived to be liberal democracy's betrayal of its own rationalist ideals of freedom, equality, and fraternity.
