How the West Was Drawn explores the geographic and historical experiences of the Pawnees, the Iowas, and the Lakotas during the European and American contest for imperial control of the Great Plains during the eighteenth and nineteenth centuries. David Bernstein argues that the American West was a collaborative construction between Native peoples and Euro-American empires that developed cartographic processes and culturally specific maps, which in turn reflected encounter and conflict between settler states and indigenous peoples. Bernstein explores the cartographic creation of the Trans-Mississippi West through an interdisciplinary methodology in geography and history. He shows how the Pawnees and the Iowas--wedged between powerful Osages, Sioux, the horse- and captive-rich Comanche Empire, French fur traders, Spanish merchants, and American Indian agents and explorers--devised strategies of survivance and diplomacy to retain autonomy during this era. The Pawnees and the Iowas developed a strategy of cartographic resistance to predations by both Euro-American imperial powers and strong indigenous empires, navigating the volatile and rapidly changing world of the Great Plains by brokering their spatial and territorial knowledge either to stronger indigenous nations or to much weaker and conquerable American and European powers. How the West Was Drawn is a revisionist and interdisciplinary understanding of the global imperial contest for North America's Great Plains that illuminates in fine detail the strategies of survival of the Pawnees, the Iowas, and the Lakotas amid accommodation to predatory Euro-American and Native empires.

Exploring this dynamic in Charlotte Bronta's Villette, Mary Elizabeth Braddon's Lady Audley's Secret, George Eliot's Daniel Deronda, and Thomas Hardy's Tess of the d'Urbervilles, she argues that although women's disclosures to male confessors repeatedly depict wrongdoing committed against them, they themselves are viewed as the transgressors. Based on cultural criticism, poststructuralism, and feminist theory, Bernstein's analysis constitutes a reassessment of Freud's and Foucault's theories of confession. In Only One Place of Redress David E. Bernstein offers a bold reinterpretation of American legal history: he argues that American labor and occupational laws, enacted by state and federal governments after the Civil War and into the twentieth century, benefited dominant groups in society to the detriment of those who lacked political power. Both intentionally and incidentally, claims Bernstein, these laws restricted in particular the job mobility and economic opportunity of blacks. A pioneer in applying the insights of public choice theory to legal history, Bernstein contends that the much-maligned jurisprudence of the Lochner era—with its emphasis on freedom of contract and private market ordering—actually discouraged discrimination and assisted groups with little political clout. To support this thesis he examines the motivation behind and practical impact of laws restricting interstate labor recruitment, occupational licensing laws, railroad labor laws, minimum wage statutes, the Davis-Bacon Act, and New Deal collective bargaining. He concludes that the ultimate failure of Lochnerism—and the triumph of the regulatory state—not only strengthened racially exclusive labor unions but contributed to a massive loss of employment opportunities for African Americans, the effects of which continue to this day. Scholars and students interested in race relations, labor law, and legal or constitutional history will be fascinated by Bernstein’s daring—and controversial—argument.
The Southern Pacific Railroad and its predecessors served Texas from 1853 to 1996. Stretching from El Paso to the Louisiana border and from the Rio Grande Valley to the Red River, Southern Pacific opened up vast areas of the state to settlement by transporting people, building materials, and livestock. The railroad fueled Texas's economy by moving oil, timber, agricultural commodities, coal, automobiles, petrochemicals, cement, steel, consumer goods, and myriad other products. It hauled the marble that built the state capitol in Austin and the materials to build the massive seawall in Galveston. Southern Pacific also played an important role in developing the ports of Beaumont, Galveston, Houston, and Corpus Christi. Examines the Reading Room of the British Museum using documentary, theoretical, historical, and literary sources Roomscape explores a specific site - the Reading Room of the British Museum - as a space of imaginative potential in relation to the emergence of modern women writers in Victorian and early twentieth-century London. Drawing on archival materials, Roomscape is the first study to integrate documentary, historical, and literary sources to examine the significance of this space and its resources for women who wrote translations, poetry, and fiction. This book challenges an assessment of the Reading Room of the British Museum as a bastion of class and gender privilege, an image established by Virginia Woolf's A Room of One's Own. Roomscape also questions the value of privacy and autonomy in constructions of female authorship. Rather than viewing reading and writing as solitary, Roomscape investigates the public, social, and spatial dimensions of literary production.
