The right to demonstrate is considered fundamental to any democratic system of government, yet in recent years it has received little academic attention. However, events following the recent G20 protests in April 2009 make this a particularly timely work. Setting out and explaining in detail the domestic legal framework that surrounds the right of peaceful protest, the book provides the first extensive analysis of the Strasbourg jurisprudence under Articles 10 and 11 of the European Convention on Human Rights, offering a critical look at recent cases such as Öllinger, Vajnai, Bukta, Oya Ataman, Patyi and Ziliberberg, as well as the older cases that form its bedrock. The principles drawn from this case-law are then synthesised into the remainder of the book to see how the right of protest enshrined in the Human Rights Act 1998 now operates. The five central chapters show how the right is defined: the restrictions on the choice of location of a protest; the constraints imposed on peaceful, persuasive protest; the near total intolerance of any form of obstructive or disruptive protest; the scope of preventive action by the police; and the extent to which commercial targets can avail themselves of private law remedies. This contemporary landscape is highlighted by critical analysis of the principles and case law -- including the leading decisions in Laporte, Austin, Jones and Lloyd and Kay. The book also highlights and develops themes that are currently under-theorised or ignored, including the interplay of the public and the private in regulating protest; the pivotal role played by land ownership rules; and the disjuncture between the law in the books and the law in action. While the book will appeal primarily to scholars, students and practitioners of law – as well as to campaigners and interest groups – it also offers political and socio-legal insights, which will be of interest equally to non-specialists.

How Calvinist theology helps us read characters in the early British novel, shedding new light on the origins of modern secularism The strangeness of fictional characters in the eighteenth-century novel has been well documented. They are two-dimensional yet complex; they suggest unstable correspondences between the external and the internal. In Reading Character after Calvin, David Mark Diamond traces the religious genealogy of such figures, arguing that two-dimensionality reproduces through form a model of interpretation that originates in Calvinist Protestant theology. In Calvin’s teachings, every person possessed a spiritual status as saved or damned, and their external features ostensibly reflected this inward condition. This belief, however, was always haunted by the possibility of a discrepancy between the two. Diamond shows how Calvinism survives in the pages of early novels as a guide to discerning religious hypocrisy and, eventually, distinctions related to imperial race-making. He tracks the migration of Calvinist character detection from its original, sectarian contexts to the worlds of eighteenth-century fiction, revealing the process by which religion came unbound from doctrinal orthodoxy and was grafted onto the ambition of racialized global dominion. Analyzing a diverse set of texts, Diamond offers a fresh account of both how literary character worked and how it works to naturalize, question, or critique the violence of empire.

The initial chapter introduces the reader to the subject of constitutional law – what it is all about, what its function is, and how it interacts with the constitutional text. The book goes on to examine Canadian federalism law and the Supreme Court of Canada's experience in the first decade in the life of the Charter of Rights. Beatty also examines significant human rights cases decided by the major courts around the world, in order to illustrate how the same principles and methods of reasoning are used to resolve disputes about the validity of laws no matter what the issue is or where it arises. The book concludes by showing how a theory of constitutional law which emphasizes the social duties which politicians must respect rather than individual rights should be responsive to the concerns of those who are more sceptical about the virtues of law and the courts as well as those who fear the cultural imperialism of western legal concepts. Beatty proposes a radically new way to think about the idea of ‘rights,’ one which emphasizes the social duties that are inherent in every conception of rights. The book argues that by reorienting our thinking about what rights and the rule of law are all about, it is easier to see that rather than being in conflict or tension with each other, democratic decision making and judicial review are supportive of a common set of values and ideals.

There have been many remarkable women who served British Intelligence during the Second World War. One whose dubious claim to have worked for them is a fascinating tale involving three marriages – the first, to a spurious White Russian prince; the second to a playboy-turned-criminal involved in a major jewellery robbery in the heart of London’s Mayfair in the late 1930s. After the war she became romantically involved with a well-known British Fascist, but finally married another notorious criminal whom she had met earlier during the war. The descriptions variously ascribed to her ranged from ‘remarkable’ and ‘quite ravishing’ to ‘...a woman whose loose living would make her an object of shame on any farm-yard’. Until now, very little has been recorded about Stella Lonsdale’s life. She doesn’t even merit a mention in the two official histories of MI5, even though she managed to tie them up in knots for years. This book will explore the role this strange woman may or may not have played in working for British Intelligence, the French Deuxième Bureau, or the Abwehr – German military intelligence – during the Second World War, using her MI5 files as a primary source.
