Evidence Under the Rules: Text, Cases, and Problems is one of the?most widely adopted Evidence casebooks ever published. Structured around the Federal Rules of Evidence, the book contains carefully edited cases and secondary materials, as well as numerous problems that allow students to apply new concepts during classroom exercises or on their own. Text boxes provide interesting background on select cases and additional perspectives on key issues. New to the 10th Edition: Additional problems are provided, and often these are combined into the Notes following cases and other materials. These problems generate good classroom discussion, without displacing conversations about the cases and the principles under consideration. The book is also redesigned, with more colors on the page, and other design features that provide clues to the content of the textual material. The Note material, found after cases and textual accounts, includes organizational headings that act as signposts calling the attention of students to the key issues. The book retains the old favorites, like Boys on the Bridge (Problem 2-C), A Papier Mache Man (Problem 3-I), and “If You Want to Stay Healthy (Problem 4_Q). New end-of-chapter quizzes are included to help in the review of the materials. A thoroughly updated and expanded Index. Benefits for instructors and students: Introductory text that provides a foundation for understanding the cases and materials that follow. Numerous problems that treat cutting-edge issues, allowing students to apply important concepts to contemporary evidentiary problems. A Teacher’s Manual that provides suggestions by the authors for discussing the Notes and cases. “Comment/Perspective” text boxes that provide broader perspectives to aid in understanding doctrine. Sidebars that contain photographs and text relating to important cases, offering background on how the evidence issue arose.
Albert Lambert was born in Missouri and went into his father's pharmaceutical business, but he found his true love in the air. While visiting Paris in 1906, he became interested in ballooning, then in airplanes. In 1907, Albert helped form the St. Louis Aero Club to promote aviation, then helped form the first airport in the area. In 1923, he opened Lambert-St. Louis Flying Field. He also helped raise money to build The Spirit of St. Louis for Charles Lindbergh.
This fourth volume in the comprehensive series “fills a gap in the existing narrative” of WWII’s Mediterranean air war (Journal of Military History). The fourth volume in this momentous series commences with the attacks on the Italian island fortress of Pantellaria, which led to its surrender and occupation achieved almost by air attack alone. The account continues with the ultimately successful, but at times very hard fought, invasions of Sicily and southern Italy as burgeoning Allied air power, now with full US involvement, increasingly dominated the skies overhead. The successive occupations of Sardinia and Corsica are also covered in detail. This is essentially the story of the tactical air forces up to the point when Rome was occupied, just at the same time as the Normandy landings were occurring in northwest France. With regards to the long-range tactical role of the Allied heavy bombers, only the period from May to October is examined, while they remained based in North Africa, with the narrative continuing in a future volume. This volume also delves into the story of “the soldiers’ air force.” Frequently overshadowed by more immediate newsworthy events elsewhere, the soldiers’ struggle was often of an equally Homeric nature. “No future publication on the Mediterranean air war will be credible without use of this series.” —Air Power History

There’s nothing quite as controversial in American sports as college football’s national championship, making it common fodder for talk around the water cooler as well as loftier debates among professional journalists in the sports pages. Walsh takes a comprehensive view of over a century of controversy, breaking teams down into one of three categories: perennial powers, contenders, and former greats. He then reviews the ten most controversial championships, suggests candidates for the best overall football program, and concludes with some thoughts on the future of the BCS. A comprehensive appendix lists national champions since 1869; AP and USA Today/UPI final polls; final BCS standings; first-team All-Americans; and College Football Hall of Fame inductees.
Why do some crises affect the stock market far more than others? What will happen to an individual's financial security when the next major terrorist attack occurs? When faced with disaster, why do investment advisors keep telling clients to just be patient? Wall Street typically suggests that, when crisis hits, investors must put life on pause with the hope that someday, perhaps years later, portfolio values will return to normal. This standard "wait and see" approach involves sitting through chaos, confusion, and even long-term loss. The Prepared Investor offers an innovative and practical approach that reveals how the true story of investing through crisis is very different from the standard dogma that's accepted today. Christopher Manske demonstrates how readers can protect and grow their net worth in the face of calamity using twenty specific action steps built on an understanding of how different crises affect society and the investment markets. Like Outliers showed a different way to look at success and Nine Lies About Work turned the establishment upside down on leadership and teams, Manske convincingly demonstrates that society's reaction to true crisis is absolutely predictable. In making this pattern clear, Manske offers a compelling and instructive approach to maximizing your portfolio despite tomorrow's uncertainty. From this vantage point, readers will see why the investing world barely reacted when a disease killed more people than all the deaths attributed to both World Wars, how a few National Guardsmen sank the entire stock market, how the secret Napoleon knew explains investors' selling behavior, and why a simple statement from particular leaders can be just as much a crisis as an airplane flying into the World Trade Center. Investment concepts change with research and experience. Diversification, though accepted today, used to be a very controversial way to manage risk in a portfolio. Similarly, Wall Street did not always use a Risk Assessment Questionnaire to help investors select the proper investments. Manske challenges today's dogma surrounding crisis investing and suggests the time has come to change the story because, during a real crisis, "wait and see" is horribly inadequate. Wall Street's current approach leaves investors dependent on the promise that things will get better, but successful portfolio management in the face of major calamity is more proactive - and a lot more optimistic - than it seems on the surface. At its core, The Prepared Investor is about how training and preparation can help people to behave better than their instinctual reactions. By shining a light on how specific catalysts create certain patterns of behavior, Manske shows readers that if the crisis is new and threatening, the effect will be predictable and familiar. On the curious journey to answer the question, "How can investors protect and grow their net worth in the face of crisis?" readers will come to understand how foolish it is for Wall Street to approach all types of calamity with the same "just hold on" solution. Using well-researched case studies, Manske explains why academics cannot agree on the actual start of the Vietnam War, what the coronavirus and advancing artificial intelligence have in common, why the biggest danger to a portfolio during crisis is probably the owner's own natural instincts, and why it's important to get ready for tomorrow's crisis right now. Pulitzer Prize winner Peggy Noonan wrote in The Wall Street Journal, "You can't see all the world's weapons and all its madness and not know that eventually we will face a terrible day or days... Maybe it will involve nuclear weapons...an attack on the grid, maybe bioterrorism. But it will be bad..." People know something's coming as they listen to the news warn of cybersecurity issues and North Korea's nuclear program. They read about extremists who take drastic steps to be prepared for anything from a dirty bomb to
In this groundbreaking work, Paul A. Djupe and Christopher Gilbert analyze national data from a survey of over 2,400 Episcopal and Evangelical Lutheran Church of America clergy, looking deeper into their motivations for political action. Using these data, the authors argue that clergy roles in politics and civic life result from the intersection of their personal beliefs and interests, the specific needs of their congregation and community, and ongoing influences from their denomination.
Existing texts on liquid theory are limited to simple liquids of spherical molecules, but nearly all liquids of practical interest have molecules that are non-spherical, resulting in more diverse phenomena. This text is the first to provide the molecular theory for such liquids, and describes applications to a wide range of physical properties.
One thousand years ago, in the valley of Kashmir, a great Tantric master named Kshemaraja wrote his masterpiece: the Pratyabhijnahrdayam, which means "The Essence of the Recognition Philosophy". This text was a concise primer, written to introduce spiritual seekers to the Recognition philosophy in less formally philosophical, more approachable language. What Kshemaraja created turned out to be one of the world's great spiritual masterpieces, breathtaking in its brevity but stunning in its power. It came to be considered equivalent to scripture itself by later generations, because of its undeniable inspiration. This book expounds the subtleties of this spiritual and philosophical classic. One of the most powerful and revelatory spiritual masterpieces of world history, the Pratyabhijnahrdayam is one of the primary sources for the study and practice of nondual Tantrik Yoga, and it has never been accurately translated or fully explained until now.
“Manifest Destiny” was the belief that the United States was meant to reach from the Atlantic Ocean to the Pacific Ocean. The story of how it was achieved is full of excitement, which readers discover as they explore this pivotal period in American history. Important social studies curriculum topics, including immigration and westward expansion, are presented in an engaging way. Historical images allow readers to place themselves on a wagon train or a railroad. Primary sources are included throughout the text to help readers gain experience relating those sources of information to what they know about history.

Existing texts on the statistical mechanics of liquids treat only spherical molecules. However, nearly all fluids of practical interest are composed of non-spherical molecules that are often dipolar or exhibit other kinds of electrostatic forces. This book describes the statistical mechanical theory of fluids of non-spherical molecules and its application to the calculation of physical properties, and is a sequel to Theory of Molecular Fluids. Volume 1: Fundamentals by C.G. Gray and K.E. Gubbins. The emphasis is on the new phenomena that arise due to the non-spherical nature of the intermolecular forces, such as new phase transitions, structural features and dielectric effects. It contains chapters on the thermodynamic properties of pure and mixed fluids, surface properties, X-ray and neutron diffraction structure factors, dielectric properties and spectroscopic properties. The book is aimed at beginning graduate students and research workers in chemistry, physics, materials science and engineering.

This Open Access book discusses an extension to low-coherence interferometry by dispersion-encoding. The approach is theoretically designed and implemented for applications such as surface profilometry, polymeric cross-linking estimation and the determination of thin-film layer thicknesses. During a characterization, it was shown that an axial measurement range of 79.91 μm with an axial resolution of 0.1 nm is achievable. Simultaneously, profiles of up to 1.5 mm in length were obtained in a scan-free manner. This marked a significant improvement in relation to the state-of-the-art in terms of dynamic range. Also, the axial and lateral measurement range were decoupled partially while functional parameters such as surface roughness were estimated. The characterization of the degree of polymeric cross-linking was performed as a function of the refractive index. It was acquired in a spatially-resolved manner with a resolution of 3.36 x 10-5. This was achieved by the development of a novel mathematical analysis approach.

Growing up, I had always had a strange fascination of the idea that a spiritual realm could exist. Every time ghost programs came on television, I'd be watching. Although I couldn't believe in God, Satan or anything else that wasn't tangible. I needed physical proof to comprehend the existence of everything. In high school I began going on paranormal investigations weekly. In my eleventh grade English class I received an Opposing Viewpoints project. The subject I chose was Paranormal Phenomenon. Instead of using the encyclopedias to research my subject like the rest of my class did, I went straight to the real source. The following week I found a Ouija Board, video camera, and other tools to carry out my own paranormal investigation. When I got more info from spirits than I had intended to, I began feeling the presence of something staring at me. The last night of the investigation, I got home late at night. When I stepped into the doorway something occurred that took everyone in the house complete surprise.
