This book presents an answer to the question of why modern legal institutions and the idea of citizenship are important for leading a free life. The majority of views in political and legal philosophy regard the law merely as a useful instrument, employed to render our lives more secure and to enable us to engage in cooperate activities more efficiently. The view developed here defends a non-instrumentalist alternative of why the law matters. It identifies the law as a constitutive feature of our identities as citizens of modern states. The constitutivist argument rests on the (Kantian) assumption that a person’s practical identity (its normative self-conception as an agent) is the result of its actions. The law co-constitutes these identities because it maintains the external conditions that are necessary for the actions performed under its authority. Modern legal institutions provide these external prerequisites for achieving a high degree of individual self-constitution and freedom. Only public principles can establish our status as individuals who pursue their life plans and actions as a matter of right and not because others contingently happen to let us do so. The book thereby provides resources for a reply to anarchist challenges to the necessity of legal ordering.

Lawyers involved in international commercial transactions know well that unforeseen events affecting the performance of a party often arise. Not surprisingly, exemptions for non-performance are dealt with in a significant number of arbitral awards. This very useful book thoroughly analyzes contemporary approaches, particularly as manifested in case law, to the scope and content of the principles of exemption for non-performance which are commonly referred to as 'force majeure' and 'hardship.' The author shows that the 'general principles of law' approach addresses this concern most effectively. Generally accepted and understood by the business world at large, this approach encompasses principles of international commercial contracts derived from a variety of legal systems. It's most important 'restatements' are found in the 1980 United Nations Convention on Contracts for the International Sale of Goods (CISG) and the UNIDROIT Principles of International Commercial Contracts (UPICC). When Grimmelshausen's The Singular Life Story of Heedless Hopalong (Der seltzame Springinsfeld) first appeared in 1670 or 1671, it was as nearly guaranteed of commercial success as any work of fiction can be. Its titular hero and primary narrator was already familiar to the German-reading public as a minor character in the most popular novel of the age, Simplicissimus, and a major character in its sequel, The Runagate Courage. The Singular Life Story of Heedless Hopalong is the third of the five novels by Hans Jacob Christoffel von Grimmelshausen which make up the so-called Simplician cycle. The first novel, Simplicissimus, has long been available in English translation; the second appeared fifteen years ago. This publication makes a complete and annotated English version of the third novel available to English readers for the first time. Like it predecessors, Heedless Hopalong is full of earthy humor and penetrating observations about man's foibles and the human dilemma. In it Grimmelshausen vividly portrays the most important Simplician characters, Courage and Hopalong, as they are in their old age. In the remaining two-thirds of the novel Hopalong tells the story of his life, describing his experience as a juggler boy, as a member of various armies during the Thirty Years' War, as an innkeeper, a beggar, etc., in language refreshingly direct, forthright, and lively. In his characterization of Hopalong, Grimmelshausen created one of German literature's finest portraits of the common soldier. The Singular Life Story of Heedless Hopalong is the recipient of the First Basilius Award in Germanics.
Among the tribal populations of India there is none which rivals in numerical strength and historical importance the group of tribes known as Gonds. In the late 1970s, numbering well over four million, Gonds extend over a large part of the Deccan and constitute a prominent element in the complex ethnic pattern of the zone where Dravidian and Indo-Aryan populations overlap and dovetail. In the highlands of the former Hyderabad State (now Andhra Pradesh) concentrations of Gonds persisted in their traditional lifestyle until the middle of the twentieth century: feudal chiefs continued to function as tribal heads and hereditary bards preserved a wealth of myths and epic tales. It was at that time that Christoph von Fürer-Haimendorf first began his study of this group of Gonds, spending the better part of three years in their villages. While observing their daily life and their elaborate ritual performances, he also saw the threat which more advanced Hindu populations, infiltrating into the Gonds’ habitat and competing for their ancestral land, were posing to their way of life. During the thirty years prior to publication the author had frequently revisited the Gond region and in 1976-7 he undertook a detailed re-study of social and economic developments in the villages he knew best. His long-standing familiarity with many individual Gonds has allowed him to draw in this book, originally published in 1979, an intimate picture of the life of a specific village community and to trace the fates of individual men and women over a long stretch of time. While his earlier book The Raj Gonds of Adilabad: Myth and Ritual concentrated mainly on the Gonds’ mythology and ritual practices, the present volume devotes more space to a detailed analysis of the operation of social forces and the traditional structure of a society characterised by a high degree of cohesion. In 1979 the Gonds were once again being subjected to the pressure of outside forces and Professor von Fürer-Haimendorf lays special emphasis on the analysis of the process of social change forced upon the Gonds by settlers from outside. The last part of the book thus represents a case history of the transformation of a tribal society under the impact of modernisation and relentless population growth.
