Everywhere,new tax rules are under development to engage with the ever-increasing complexity and sophistication of aggressive tax planning and to reverse the tax base erosion it leads to. The most prominent initiative in this context is the Base Erosion and Profit Shifting (BEPS) project of the OECD. Although double non-taxation is among the main issues the BEPS project intends to address, this book shows that this phenomenon has not yet been fully understood. Focusing on the fundamental freedoms and the State aid rules of the EU, this book thoroughly explains the nature of double non-taxation from an EU law perspective, its relation to double taxation, and the impact of EU law on these phenomena. Among the issues dealt with in the course of the analysis are the following: – locating the gaps and inconsistencies among domestic tax systems exploited by taxpayers; – hybrid mismatch arrangements as a prime example of double non-taxation; – political efforts undertaken within the EU in order to address double taxation and double non-taxation; – double non-taxation in the European VAT system; – the convergence of the fundamental freedoms and the State aid rules; – the ECJ’s dilemma with regard to juridical double taxation; – the deviating approach with regard to economic double taxation; – the potential impact of the ECJ’s case law on the EU law compatibility of double non-taxation. The tax jurisprudence of the ECJ is referred to and comprehensively analysed throughout this whole book. A final chapter provides an outlook on possible developments in the future. By providing the first in-depth analysis of EU law’s impact on double non-taxation – and the double taxation relief standards with which it is intimately related – this book takes a giant step towards greater legal certainty in this challenging area of tax law. It will quickly take its place as a major practical analysis which benefits tax authorities, scholars, and tax practitioners across Europe and even beyond.

The Second World War affected the lives and shaped the experience of millions of individuals in Germany - soldiers at the front, women, children and the elderly sheltering in cellars, slave labourers toiling in factories, and concentration-camp prisoners and POWs clearing rubble in the Reich's devastated cities. Taking a 'history from below' approach, the volume examines how the minds and behaviour of individuals were moulded by the Party as the Reich took the road to Total War. The ever-increasing numbers of German workers conscripted into the Wehrmacht were replaced with forced foreign workers and slave labourers and concentration camp prisoners. The interaction in everyday life between German civilian society and these coerced groups is explored, as is that society's relationship to the Holocaust. From early 1943, the war on the home front was increasingly dominated by attack from the air. The role of the Party, administration, police, and courts in providing for the vast numbers of those rendered homeless, in bolstering civilian morale with 'miracle revenge weapons' propaganda, and in maintaining order in a society in disintegration is reviewed in detail. For society in uniform, the war in the east was one of ideology and annihilation, with intensified indoctrination of the troops after Stalingrad. The social profile of this army is analysed through study of a typical infantry division. The volume concludes with an account of the various forms of resistance to Hitler's regime, in society and the military, culminating in the failed attempt on his life in July 1944.

Known as Lemberg in German and Lwów in Polish, the city of L'viv in modern Ukraine was in the crosshairs of imperial and national aspirations for much of the twentieth century. This book tells the compelling story of how its inhabitants (Roman Catholic Poles, Greek Catholic Ukrainians, and Jews) reacted to the sweeping political changes during and after World Wars I and II. The Eastern Front shifted back and forth, and the city changed hands seven times. At the end of each war, L'viv found itself in the hands of a different state.While serious tensions had existed among Poles, Ukrainians/Ruthenians, and Jews in the city, before 1914 eruptions of violence were still infrequent. The changes of political control over the city during World War I led to increased intergroup frictions, new power relations, and episodes of shocking violence, particularly against Jews. The city's incorporation into the independent Polish Republic in November 1918 after a brief period of Ukrainian rule sparked intensified conflict. Ukrainians faced discrimination and political repression under the new government, and Ukrainian nationalists attacked the Polish state. In the 1930s, anti-Semitism increased sharply. During World War II, the city experienced first Soviet rule, then Nazi occupation, and finally Soviet conquest. The Nazis deported and murdered nearly all of the city's large Jewish population, and at the end of the war the Soviet forces expelled the city's Polish inhabitants.Based on archival research conducted in L'viv, Kiev, Warsaw, Vienna, Berlin, and Moscow, as well as an array of contemporary printed sources and scholarly studies, this book examines how the inhabitants of the city reacted to the changes in political control, and how ethnic and national ideologies shaped their dealings with each other. An earlier German version of this volume was published as Kriegserfahrungen in einer multiethnischen Stadt: Lemberg 1914?1947 (2011).

This new approach to the social history of Afrikaner nationalism looks into the diverse causes for the rise of a political movement which was to shape South African history profoundly during the 20th Century. In the 1930s Afrikaner nationalism transformed itself from a populist into a cultural nationalism, becoming politically radicalised at the same time. The nationalist symbol of the oxwagon was used not only by the National Party, but also by the extra- and antiparliamentarian mass movement Ossewabrandwag, which was founded in 1939. Drawing on a broad range of archival resources the social history of this extremist organisation is analysed, showing local and regional differences. The Ossewabrandwag as a nationalist movement counted a considerable part of the Afrikaans white population among its members. Therefore, the Ossewabrandwag can be understood approprately only in the context of radical Afrikaner nationalism. Given that the potential for political radicalisation in the white South African population was considerable, ideological influences from overseas played merely an additional role. The book looks into the reasons for the mass participation in the Ossewabrandwag. In addition it analyses the organisation's fight with the National Party and its illegal and treasonable activities. In this context the book discusses which ideological influences on the apartheid policy can be identified as coming from organised right wing extremism.

It is the English translation of the 3rd edition of the well-received German book “5000 Jahre Geometrie,” in which geometry is presented as a chain of developments in cultural history and their interaction with architecture, the visual arts, philosophy, science and engineering. Geometry originated in the ancient cultures along the Indus and Nile Rivers and in Mesopotamia, experiencing its first “Golden Age” in Ancient Greece. Inspired by the Greek mathematics, a new germ of geometry blossomed in the Islamic civilizations. Through the Oriental influence on Spain, this knowledge later spread to Western Europe. The idea of comparing the performance of different risky investments, for example investment funds, on a quantitative basis dates back to the beginnings of the asset management industry and has been an important field of research in finance since then. Performance measures serve as valuable quantitative evidence for the portfolio manager's performance as well as for the evaluation of investment decisions ex post. Based on the idea of the capital asset pricing model proposed by Treynor, Sharpe and Lintner, Treynor developed the first quantitative performance measure intended to rate mutual funds, the Treynor Ratio. Since then, a large number of performance measures with very different characteristics have been developed. In addition to their power of rating investments ex post, their ability to predict future performance has been thoroughly analyzed by Grinblatt & Titman, Brown & Goetzmann, Carhart and others. Besides academia, the driving force behind the development of more sophisticated performance measures has always been the investors. This is understandable, as "the truly poor managers are afraid, the unlucky managers will be unjustly condemned, and the new managers have no track record. Only the skilled (or lucky) managers are enthusiastic." By combining and applying the results of previous research to a new sample of nearly 10,000 mutual funds that invest in different countries and asset classes, this thesis clarifies its central research question: Is the Information Ratio a useful and reliable performance measure? In order to answer this central question, it has been split up into the following sub-parts: What are the characteristics of a useful and reliable performance measure? What actually is "good" performance? Is the "good" performance a result of luck or of skilled decisions and does it persist over time? Managing a successful transition of the current energy supply system to less carbon emitting options, ensuring a safe and secure supply during the whole process and in the long term, is one of the largest challenges of our time. Various approaches and first implementations show that it is not only technological issue, but also a matter of societal acceptance and acceptability, considering basic ethic values of the society.
