Judicial Systems in Transition Economies' looks at the experience of countries in Central and Eastern Europe and the Baltics (CEE) and the Commonwealth of Independent States (CIS) as they reform their legal and judicial institutions to fit the needs of a market economy. The study shows, rather disturbingly, that less progress has been made in judicial reform than in most other areas of institutional reform in these countries. The transition from socialism to capitalism requires a fundamental reorientation of legal and judicial institutions. This study reviews the environment preceding reforms, forces that provoked and supported them, and the reform agendas undertaken in these countries since 1990. Against this background, it exposes the impact of reforms, implementation gaps, and the underlying determinants of success and failure. The report examines how courts have performed, and reveals their impact on public opinion and the business environment. It provides insight into linkages among reforms as well as linkages between reforms and public demand for a fair judiciary. The authors show that while each country presents different challenges and opportunities, certain lessons apply in most settings. Their insights and data would be useful to policy makers, judicial personnel, and those involved in reforming judiciaries. The study draws on numerous data sources. Bunny Flu Flu is a precocious little rabbit who loves life and often learns life’s lessons the hard way. I started writing her stories over seven years ago when I would be inspired by one of my grandchildren. There is a little of each of them in many of Bunny Flu Flu’s adventures. Who were these women? The author sought them out, interviewed them, and documented their stories for this book. In Afghanistan under Taliban rule, women were forbidden to work or go to school, they could not leave their homes without a male chaperone, and they could not be seen without a head-to-toe covering called the burqa. A woman’s slightest infractions were met with brutal public beatings. That is why it is both appropriate and incredible that the sole effective civil resistance to Taliban rule was made by women. Veiled Courage reveals the remarkable bravery and spirit of the women of the Revolutionary Association of the Women of Afghanistan (RAWA), whose daring clandestine activities defied the forces of the Taliban and earned the world’s fierce admiration. The complete subordination of women was one of the first acts of the Taliban. But the women of RAWA refused to cower. They used the burqa to their advantage, secretly photographing Taliban beatings and executions, and posting the gruesome pictures on their multi-language website, rawa.org, which is read around the world. Over the past century, the U.S. Congress argued first that prospective citizens should be judged in terms of race, then in terms of politics, then of ideology, then of wealth and skills. Each argument arose in direct response to a perceived foreign threat--a threat that was, in the government's eyes, racial, political, ideological, or economic.
