Environmental Groups and Legal Expertise explores the use and understanding of law and legal expertise by environmental groups. Rather than the usual focus on the court room, it scrutinises environmental NGO advocacy during the extraordinarily dramatic Brexit process, from the referendum on leaving the EU in June 2016 to the debate around the new Environment Bill in the first half of 2020. There is generally a weak understanding of both the complexity and the potential of legal expertise in the environmental NGO community. Legal expertise can be more than a tool for campaigners, and more than litigation: it provides distinctive ways of both seeing the world and changing the world. The available legal resource in the sector is not just a practical limit on what can be done, but spills into the very understanding of what should be done, and what resource is needed. Mutually reinforcing links between capacity, understanding, culture and investment affect legal expertise across the board. There are, however, pockets of sophisticated legal expertise in the community, and legal expertise was heavily and often effectively used in the anomalously law-heavy Brexit-environment debate. The ability to call on thinly spread legal expertise in a crisis was in part due to effective NGO collaboration around Brexit-environment.

This book reveals what happens to applications for post-conviction review when those in England, Wales, and Northern Ireland who believe they are wrongfully convicted apply to the Criminal Cases Review Commission, the only body that can refer a case back to the Court of Appeal once appellants opportunities for direct appeal are exhausted. While the Court is obliged to hear all such referrals, the Commission can only refer a case where it believes there is a real possibility that the Court will quash the conviction. The first empirical study of all stages of decision-making within the Commission, this book starts from the premise that the test applied by the Commission (the real possibility test) is not inflexible. Though created by statute and refined through case law, it must be determined on a case-by-case basis, drawing too on cultural and structural variables, alongside fresh evidence gathered by the Commission. Through in-depth analysis of case files and interviews, Hoyle and Sato scrutinize the Commissions operational practices, its working rules and assumptions, considering how these influence its understanding of the real possibility test. Situating their rich empirical data within a framework of the Commissions social, organizational, and legal contexts, this book demonstrates that in its open-ended investigations there is considerable scope for discretion; for thorough exploration of all possible avenues or for choosing a more superficial consideration of a case. Why a monumental diary by an aunt and niece who published poetry together as “Michael Field”—and who were partners and lovers for decades—is one of the great unknown works of late-Victorian and early modernist literature Michael Field, the renowned late-Victorian poet, was well known to be the pseudonym of Katharine Bradley (1846–1914) and her niece, Edith Cooper (1862–1913). Less well known is that for three decades, the women privately maintained a romantic relationship and kept a double diary, sharing the page as they shared a bed and eventually producing a 9,500-page, twenty-nine-volume story of love, life, and art in the fin de siècle. In Chains of Love and Beauty, the first book about the diary, Carolyn Dever makes the case for this work as a great unknown “novel” of the nineteenth century and as a bridge between George Eliot and Virginia Woolf, Victorian marriage plot and modernist experimentation. While Bradley and Cooper remained committed to publishing poetry under a single, male pseudonym, the diary, which they entitled Works and Days and hoped would be published after their deaths, allowed them to realize literary ambitions that were unfulfilled during their lifetime. The enclosure of the commons, space once available for communal use, was not a singular event but an act of "slow violence" that transformed lands, labor, and basic concepts of public life leading into the nineteenth century. The Afterlife of Enclosure examines three canonical British writers—Charles Dickens, George Eliot, and Thomas Hardy—as narrators of this history, the long duration and diffuse effects of which required new literary forms to capture the lived experience of enclosure and its aftermath. This study boldly reconceives the realist novel, not as an outdated artifact, but as witness to the material and environmental dispossession of enclosure—and bearer of utopian energies. These writers reinvented a commons committed to the collective nature of the social world. Illuminating the common at the heart of the novel—from common characters to commonplace events—Carolyn Lesjak reveals an experimental figuration of the lost commons, once a defining feature of the British landscape and political imaginary.
