Examining a series of court decisions made during the 1980s regarding the legal claims of several Native American tribes who attempted to protect ancestrally revered lands from development schemes by the federal government, this book looks at important questions raised about the religious status of land. The tribes used the First Amendment right of free exercise of religion as the basis of their claim, since governmental action threatened to alter the land which served as the primordial sacred reality without which their derivative religious practices would be meaningless. Brown argues that a constricted notion of religion on the part of the courts, combined with a pervasive cultural predisposition towards land as private property, marred the Constitutional analysis of the courts to deprive the Native American plaintiffs of religious liberty. Brown looks at four cases, which raised the issue at the federal district and appellate court levels, centered on lands in Tennessee, Utah, South Dakota, and Arizona; then it considers a fifth case regarding land in northwestern California, which ultimately went to the U.S. Supreme Court. In all cases, the author identifies serious deficiencies in the judicial evaluations. The lower courts applied a conception of religion as a set of beliefs and practices that are discrete and essentially separate from land, thus distorting and devaluing the fundamental basis of the tribal claims. It was this reductive fixation of land as property, implicit in the rulings of the first four cases, that became explicitly sanctioned and codified in the Supreme Court's decision in Lyng v. Northwest Indian Cemetery Protective Association of 1988. In reaching such a position, the Supreme Court injudiciously engaged in a policy determination to protect government land holdings, and did so through a shocking repudiation of its own long established jurisprudential procedure in cases concerning the free exercise of religion.

This report describes and evaluates the ways in which user-fees are currently implemented to finance public health services in Sub- Saharan Africa. It presents the main issues that arise in assessing cost recovery through user fees and evaluates experiences to date. The authors highlight variety of practices encountered in different countries, the too common failure to structure charges so as to promote efficient use, and the lack of effective exemption structures for protecting the poor. The study thoroughly reviews standard cost recovery models and describes an initiative launched in Bamako, Mali, in 1987. Issues, experience, and conclusions are drawn from a sample of 38 countries.

This paper presents a systematic study of the relationships between the representation theories of [italic capital]R and [italic capital]A, especially those involving actual or potential quasi-hereditary structures on the latter algebra. Our original motivation comes from the theory of Schur algebras, work of Soergel on the Bernstein-Gelfand-Gelfand category [script capital]O, and resent results of Dlab-Heath-Marko realizing certain endomorphism algebras as quasi-hereditary algebras. We synthesize common features of all these examples, and go beyond them in a number of new directions.

This innovative study examines and analyses the wealth of evidence provided by the monumental effigies of Yorkshire, from the thirteenth and fourteenth centuries, including some of very high sculptural merit. More than 200 examples survive from the historic county in varying states of preservation. Together, they present a picture of the people able to afford them, at a time when the county was frequently at the forefront of national politics and administration, during the Scottish wars. Many monuments display remarkable realism, depicting people as they themselves wished to be remembered, and are accompanied by a great volume of contemporary sculptural and architectural detail. Stylistic analysis of the effigies themselves has been employed, better to understand how they relate to one another and give a firmer basis for their dating and production patterns. They are considered in relation to the history and material culture of the area at the time they were produced. A more soundly based appreciation of the sculptor's intentions and the aspirations of patrons is sought through close attention to the full extent of the visible evidence afforded by the monuments and their surroundings. The corpus is of sufficient size to permit meaningful analysis to shed light on aspects such as personal aspiration, social networks, patterns of supply and production, piety and wealth. It demonstrates the value of funerary monuments to the wider understanding of medieval society. The text will be accompanied by a comprehensive catalogue, making available a substantial body of research for the first time. The study considers the relationship between the monuments and related sculpture, architecture, painting, glass etc, together with contemporary documentary evidence, where it is available. This material and the underlying methodology are now available to illuminate monuments of the medieval period across the whole country. Its methods and messages extend understanding of all monuments, broadening its potential audience from the purely local to everyone concerned with medieval sculpture and church archaeology.
Brian Dolan's social and cultural history of the music business in relation to the history of the player piano is a critical chapter in the story of contemporary life. The player piano made the American music industry-and American music itself-modern. For years, Tin Pan Alley composers and performers labored over scores for quick ditties destined for the vaudeville circuit or librettos destined for the Broadway stage. But, the introduction of the player piano in the early 1900s, transformed Tin Pan Alley's guild of composers, performers, and theater owners into a music industry. The player piano, with its perforated music rolls that told the pianos what key to strike, changed musical performance because it made a musical piece standard, repeatable, and easy rather than something laboriously learned. It also created a national audience because the music that was played in New Orleans or Kansas City could also be played in New York or Missoula, as new music (ragtime) and dance (fox-trot) styles crisscrossed the continent along with the player piano's music rolls. By the 1920s, only automobile sales exceeded the amount generated by player pianos and their music rolls. Consigned today to the realm of collectors and technological arcane, the player piano was a moving force in American music and American life.
This scholarly study examines the shifting perceptions of slavery in the antebellum South through news accounts of major slave rebellions. Slavery remains one of the United States’ most troubling failings and its complexities have shaped American ideas about race, economics, politics, and the press since the first days of settlement. Brian Gabrial’s The Press and Slavery in America, 1791–1859 explores those intersections at moments when enslaved people revolted or conspired to revolt. Such events forced public discussions about slavery at times when supporters of the peculiar institution preferred them to be silent. This volume covers news accounts of five major slave rebellions or conspiracies: Gabriel Prosser’s 1800 Virginia slave conspiracy; the 1811 Louisiana slave revolt; Denmark Vesey’s 1822 slave conspiracy in Charleston, South Carolina; Nat Turner’s 1831 Southampton County, Virginia, slave revolt; and John Brown’s 1859 Harper’s Ferry raid. Gabrial situates these stories within a historical framework that juxtaposes the transformation of the press into a powerful mass media with the growing political divide over slavery, illustrating how two American cultures, both asserting claims to founding America, devolved into enemies over slavery. What the nineteenth century press reveals in this book are discourses that have retained resonance in contemporary race relations and American politics.
