Introductory textbooks on American government tell us that the Supreme Court is independent from the elected branches and that independent courts better protect rights than their more deferential counterparts. But are these facts or myths? In this groundbreaking new work, Anna Harvey reports evidence showing that the Supreme Court is in fact extraordinarily deferential to congressional preferences in its constitutional rulings. Analyzing cross-national evidence, Harvey also finds that the rights protections we enjoy in the United States appear to be largely due to the fact that we do not have an independent Supreme Court. In fact, we would likely have even greater protections for political and economic rights were we to prohibit our federal courts from exercising judicial review altogether. Harvey’s findings suggest that constitutional designers would be wise to heed Thomas Jefferson’s advice to “let mercy be the character of the law-giver, but let the judge be a mere machine.&rdquo

The first accurate quantitative re-attribution of all central texts of the British Renaissance. Describes and applies the first unbiased and accurate method of computational-linguistics authorial-attribution. Covers 303 texts with 8,106,059 words, 123 authorial bylines, a range of genres, and a timespan between 1510 and 1662. Includes helpful diagrams that visually show the quantitative-matches and the identical most-frequent phrases between the texts in each linguistic-signature-group. Detailed chronologies for each of the six ghostwriters and the bylines they wrote under, including their dates of birth, death, publications, and other biographical markers that explain why each of them was the only logical attribution. A full bibliography of the 303 tested texts. All of the raw and processed data, not only in summary-tables inside of the book, but also in-full on a publicly-accessible website: https://github.com/faktorovich/Attribution. One table includes all of the data from the first-edition title-pages (byline, printer, bookseller, date, proverbs), and the first-performance (date, troupe). A table on structural elements across all “Shakespeare”-bylined texts summarizes their plot-movements, character-types, settings, slang-usage, primary sources, and poetic design (percentage of rhyme and hendiadys). To explain why these are the first truly accurate re-attributions, numerous reasons for discrediting previous attribution claims are provided throughout. Re-Attribution of the British Renaissance Corpus describes a newly invented for this study computational-linguistics authorial-attribution method and applies it and several other approaches to the central texts of the British Renaissance. All of the attribution steps are described precisely to give readers replicable instructions on how they can apply them to any text from any period that they are interested in determining an attribution for. This method can be applied to solving criminal linguistic mysteries such as who wrote the Unabomber Manifesto, or theological mysteries such as if any of the Dead Sea Scrolls might have been forged by a modern author. This method is uniquely accurate because it uses 27 different quantitative tests that measure a text’s dimensions and its similarity or divergence to other texts automatically, without the statisticians being able to skew the outcome by altering the experiment’s analytical design. Re-Attribution guides researchers not only on how to perform the basic calculations, but also how to perform the biographical and documentary research to derive who among the potential bylines in a single signature-group is the ghostwriter, while the others are merely ghostwriter-contractors or pseudonyms. Reliable accuracy is achieved by also performing other types of attribution tests to check if these alternative approaches validate or contradict the 27-tests’ findings. Non-quantitative tests discussed include deciphering the hidden implications of contemporary pufferies, as well as comparing structural elements such as characters, plot, and element borrowings. Part II presents a revised version of the history of the birth of the theater in Britain by reviewing forensic accounting evidence in Philip Henslowe’s Diary, and the documented history of homicidal lending practices and government corruption connected with troupes and theaters. Parts III-VIII explain precisely how this series derived that the British Renaissance was ghostwritten by only six linguistic-signatures: Richard Verstegan, Josuah Sylvester, Gabriel Harvey, Benjamin Jonson, William Byrd and William Percy. The parts on each of these ghostwriters, not only explain how their biographies fit with the timelines of the texts being attributed to them, but also provide various types of evidence that explains their motives for ghostwriting. And Part IX returns for an intricate analysis of a few pseudonyms or ghostwriting-contractors who were uniquely difficult to exclude as potential ghostwriters; in parallel, these chapters question the reasons these individuals would have needed to purchase ghostwriting services. “The complete series on British Renaissance Re-Attribution and Modernization by Anna Faktorovich is a remarkable accomplishment. Extreme weather is increasing in scale and severity as global warming worsens. While poorer communities are typically most vulnerable to the negative effects of climate change, even well-resourced communities are increasingly vulnerable as climate-related storms intensify. Yet little is known about how middle-class communities are responding to these storms and the resulting damage. In Soaking the Middle Class, sociologists Anna Rhodes and Max Besbris examine how a middle-class community recovers from a climate-related disaster and how this process fosters inequality within these kinds of places. In 2017, Hurricane Harvey dropped record-breaking rainfall in Southeast Texas resulting in more than $125 billion in direct damages. Rhodes and Besbris followed 59 flooded households in Friendswood, Texas, for two years after the storm to better understand the recovery process in a well-resourced, majority-White, middle-class suburban community. As such, Friendswood should have been highly resilient to storms like Harvey, yet Rhodes and Besbris find that the recovery process exacerbated often-invisible economic inequality between neighbors. Two years after Harvey, some households were in better financial positions than they were before the storm, while others still had incomplete repairs, were burdened with large new debts, and possessed few resources to draw on should another disaster occur. Rhodes and Besbris find that recovery policies were significant drivers of inequality, with flood insurance playing a key role in the divergent recovery outcomes within Friendswood. Households with flood insurance prior to Harvey tended to have higher incomes than those that did not. These households received high insurance payouts, enabling them to replace belongings, hire contractors, and purchase supplies. Households without coverage could apply for FEMA assistance, which offered considerably lower payouts, and for government loans, which would put them into debt. Households without coverage found themselves exhausting their financial resources, including retirement savings, to cover repairs, which put them in even more financially precarious positions than they were before the flood. The vast majority of Friendswood residents chose to repair and return to their homes after Hurricane Harvey. Even this devastating flood did not alter their plans for long-term residential stability, and the structure of recovery policies only further oriented homeowners towards returning to their homes. Prior to Harvey, many Friendswood households relied on flood damage from previous storms to judge their vulnerability and considered themselves at low risk. After Harvey, many found it difficult to assess their level of risk for future flooding. Without strong guidance from federal agencies or the local government on how to best evaluate risk, many residents ended up returning to potentially unsafe places. As climate-related disasters become more severe, Soaking the Middle Class illustrates how inequality in the United States will continue to grow if recovery policies are not fundamentally changed.

The ubiquity of waste paper in early modern England has long been misunderstood. Though insults and modesty tropes that refer to waste paper are widespread, these have often been dismissed as nothing more than rhetorical flourishes. Paired with the common misconception that paper would have been too valuable to 'waste' in the sixteenth and seventeenth centuries, these tropes have been read as scatological flights of fancy. Waste Paper in Early Modern England argues that such commonplaces are in fact indicative of everyday, material experience - of an author's, reader's, housewife's, or city-dweller's immersion in an environment brimming with repurposed scraps and sheets. It demonstrates that waste paper makes visible a radically different understanding of waste matter in the early modern period than in our own. More than a rhetorical aside, repurposed pages were both materially and figuratively useful. Drawing on a range of literary, pictorial, and bibliographical sources, Waste Paper in Early Modern England reveals how layers of meaning accreted around paper fragments in the sixteenth and seventeenth centuries, and how, because of the widespread sensitivity to the life cycle of paper and books, wasted pages prompted meaningful imaginative work. The book's five chapters recount how, in this period, the biography of waste paper provided a thing to think with concerning matter and temporality - a potent and flexible emblem for the troublesome passage of books and all other sorts of bodies through time.
