At the start of the twenty-first century, 1 percent of the U.S. population is behind bars. An additional 3 percent is on parole or probation. In all but two states, incarcerated felons cannot vote, and in three states felon disenfranchisement is for life. More than 5 million adult Americans cannot vote because of a felony-class criminal conviction, meaning that more than 2 percent of otherwise eligible voters are stripped of their political rights. Nationally, fully a third of the disenfranchised are African American, effectively disenfranchising 8 percent of all African Americans in the United States. In Alabama, Kentucky, and Florida, one in every five adult African Americans cannot vote. Punishment and Inclusion gives a theoretical and historical account of this pernicious practice of felon disenfranchisement, drawing widely on early modern political philosophy, continental and postcolonial political thought, critical race theory, feminist philosophy, disability theory, critical legal studies, and archival research into state constitutional conventions. It demonstrates that the history of felon disenfranchisement, rooted in postslavery restrictions on suffrage and the contemporaneous emergence of the modern “American” penal system, reveals the deep connections between two political institutions often thought to be separate, showing the work of membership done by the criminal punishment system and the work of punishment done by the electoral franchise. Felon disenfranchisement is a symptom of the tension that persists in democratic politics between membership and punishment. This book shows how this tension is managed via the persistence of white supremacy in contemporary regimes of punishment and governance.

The racial injustice that continues to plague the United States couldn't be a clearer challenge to the country's idea of itself as a liberal and democratic society, where all citizens have a chance at a decent life. Moreover, it raises deep questions about the adequacy of our political ideas, particularly liberal political theory, to guide us out of the quagmire of inequality. So what does justice demand in response? What must a liberal society do to address the legacies of its past, and how should we aim to reconceive liberalism in order to do so? In this book, Andrew Valls considers two solutions, one posed from the political right and one from the left. From the right is the idea that norms of equal treatment require that race be treated as irrelevant--in other words, that public policy and political institutions be race-blind. From the left is the idea that race-conscious policies are temporary, and are justifiable insofar as they promote diversity. This book takes issue with both of these sets of views, and therefore with the constricted ways in which racial justice is debated in the United States today. Valls argues that liberal theory permits, and in some cases requires, race-conscious policies and institutional arrangements in the pursuit of racial equality. In doing so, he aims to do two things: first, to reorient the terms of racial justice and, secondly, to make liberal theory confront its tendency to ignore race in favor of an underspecified commitment to multiculturalism. He argues that the insistence that race-conscious policies be temporary is harmful to the cause of racial justice, defends black-dominated institutions and communities as a viable alternative to integration, and argues against the tendency to subsume claims for racial justice, particularly as they regard African Americans, under more general arguments for diversity.

Since the end of the Cold War, the concept of reconciliation has emerged as a central term of political discourse within societies divided by a history of political violence. Reconciliation has been promoted as a way of reckoning with the legacy of past wrongs while opening the way for community in the future. This book examines the issues of transitional justice in the context of contemporary debates in political theory concerning the nature of 'the political'. Bringing together research on transitional justice and political theory, the author argues that if we are to talk of reconciliation in politics we need to think about it in a fundamentally different way than is commonly presupposed; as agonistic rather than restorative.

When someone claims that something is offensive, others are supposed to listen. Why? What is it for something to be offensive? Likewise, it’s supposed to matter if someone claims to have been offended. Is this correct? In this book, Andrew Sneddon argues that we should think of offense as a moralized bad feeling. He explains offensiveness in terms of symbolic value. We tend to give claims of both offense and offensiveness more credence than they deserve. While it is in principle possible for there to be genuine moral problems of offense and offensiveness, we should expect such problems to be rare. In virtually every democratic nation in the world, political representation is defined by where citizens live. In the United States, for example, Congressional Districts are drawn every 10 years as lines on a map. Why do democratic governments define political representation this way? Are territorial electoral constituencies commensurate with basic principles of democratic legitimacy? And why might our commitments to these principles lead us to endorse a radical alternative: randomly assigning citizens to permanent, single-member electoral constituencies that each looks like the nation they collectively represent? Using the case of the founding period of the United States as an illustration, and drawing from classic sources in Western political theory, this book describes the conceptual, historical, and normative features of the electoral constituency. As an institution conceptually separate from the casting of votes, the electoral constituency is little studied. Its historical origins are often incorrectly described. And as a normative matter, the constituency is almost completely ignored. Raising these conceptual, historical and normative issues, the argument culminates with a novel thought experiment of imagining how politics might change under randomized, permanent, national electoral constituencies. By focusing on how citizens are formally defined for the purpose of political representation, The Concept of Constituency thus offers a novel approach to the central problems of political representation, democratic legitimacy, and institutional design.

Despite the frequency with which the term 'community' is used, it is hard to find any comprehensive exploration of the nature and value of community. This book tries to remedy this omission whilst taking seriously the idea that community can be of different kinds and can exist at different levels, and that these levels and kinds may come into conflict with one another. It focuses on the question of what kind of community is valuable at the level of the state. It then explores the limits that ideals of political community place upon cultural diversity within the state, and the limits that, in turn, ideals of global community place upon the self-determination of political communities.
