In recent years,a number of key terms of the criminal law have seemed to defy definition. Scepticism over the possibility of defining basic concepts and identifying general principles has been voiced by both judges and academic commentators. This raises broad issues of theoretical interest, but also touches on such practical concerns as the efforts made by the Law Commission to reform the law as well as wider proposals for the codification of criminal law. Furthermore, the Human Rights Act incorporates a requirement of legality under Article 7 of the ECHR, whose scope is clearly connected to our understanding of how criminal offences are defined. This book undertakes an investigation of the role and scope of definition within the criminal law, set within a wider examination of the nature of legal materials and the diversity of perspectives on law. It offers a fascinating account of how the rules and principles found within legal materials provide opportunities for responding to, rather than merely following the law. In the light of this account, the book takes issue with some of the established views on the roles of judges and academics and, in a series of case studies concerning the definition of theft and changes to the definition of recklessness recently introduced by the House of Lords in R V G , explores the intimate connection between the use of legal materials and the practice of definition. More specific objectives of the book involve providing a more rigorous assessment of the serious challenge made by a 'criticial' perpective on the criminal law; challenging the conventional intellectual apparatus of the criminal law; demonstrating how general theoretical insights on the process of definition can assist with the practical problems of defining criminal offences; clarifying the uses of definition in the work of the judiciary and law reformers; and, determining realistic expectations for the principle of legality within the criminal law.

This book is an exploration of what it takes for an event to count as an action. I first became interested in this topic nearly a decade ago while working on a different topic. I kept coming across philosophers making claims about the nature of action that seemed false or at least dubious to me. As a consequence I turned to the philosophy of action directly, to get to the heart of the matter. I have wrestled with this territory ever since. I hope that, with this book, I have finally earned the intuitions that put me at odds with the philosophers I was originally reading. This book develops ideas in Part Two of my doctoral dissertation, which I wrote at Queen’s University in Kingston, Ontario, Canada. I loved being at Queen’s, for both professional and personal reasons. My thanks go to the Social Sciences and Humanities Research Council of Canada for financial support as a doctoral candidate. Steve Leighton and Ronald de Sousa were readers for my dissertation. They provided some early and invaluable challenges to the ideas developed here. The presumption of innocence is universally recognized as a fundamental human right and a core principle in the administration of criminal justice. Nonetheless, statutes creating criminal offences regularly depart from the presumption of innocence by requiring defendants to prove specific matters in order to avoid conviction. Legislatures and courts seek to justify this departure by asserting that the reversal of the burden of proof is necessary to meet the community interest in prosecuting serious crime and maintaining workable criminal sanctions. This book investigates the supposed justifications for limitation of the presumption of innocence. It does so through a comprehensive analysis of the history, rationale and scope of the presumption of innocence. It is argued that the values underlying the presumption of innocence are of such fundamental importance to individual liberty that they cannot be sacrificed on the altar of community interest. In particular, it is argued that a test of 'proportionality', which seeks to weigh individual rights against the community interest, is inappropriate in the context of the presumption of innocence and that courts ought instead to focus on whether an impugned measure threatens the values which the presumption is designed to protect. The book undertakes a complete and systematic review of the United Kingdom and Strasbourg authority on the presumption of innocence. It also draws upon extensive references to comparative material, both judicial and academic, from the United States, Canada and South Africa.

Adding to the growing literature on shared formulation, the authors provide over two decades of practice-based evidence for the use of a Shared Assessment, Formulation and Education (SAFE) approach to working with those with complex mental health and behavioural needs. The SAFE approach offers an evidence-informed framework for multidisciplinary teams to address the needs of those with complex and enduring psychosis for whom current evidence-based interventions are ineffective in promoting their recovery. Drawing from richly detailed case studies, the authors provide a range of useful tools and fomulation templates for use by clinicans and professionals alike. They put forward a shared language to promote a multidisciplinary understanding of service users' complex needs and a means of organising treatment into a focused, realistic and targeted approach aimed at reducing barriers to recovery and allowing individuals to lead personally meaningful lives. The book focuses predominantly on the treatment of those with psychosis who require bespoke, multi-theory informed care.
