The Chinese Exclusion Act of 1882, which barred practically all Chinese from American shores for ten years, was the first federal law that banned a group of immigrants solely on the basis of race or nationality. By changing America's traditional policy of open immigration, this landmark legislation set a precedent for future restrictions against Asian immigrants in the early 1900s and against Europeans in the 1920s. Tracing the origins of the Chinese Exclusion Act, Andrew Gyory presents a bold new interpretation of American politics during Reconstruction and the Gilded Age. Rather than directly confront such divisive problems as class conflict, economic depression, and rising unemployment, he contends, politicians sought a safe, nonideological solution to the nation's industrial crisis--and latched onto Chinese exclusion. Ignoring workers' demands for an end simply to imported contract labor, they claimed instead that working people would be better off if there were no Chinese immigrants. By playing the race card, Gyory argues, national politicians--not California, not organized labor, and not a general racist atmosphere--provided the motive force behind the era's most racist legislation.

The Action Plan for Australian Mammals 2012 is the first review to assess the conservation status of all Australian mammals. It complements The Action Plan for Australian Birds 2010 (Garnett et al. 2011, CSIRO Publishing), and although the number of Australian mammal taxa is marginally fewer than for birds, the proportion of endemic, extinct and threatened mammal taxa is far greater. These authoritative reviews represent an important foundation for understanding the current status, fate and future of the nature of Australia. This book considers all species and subspecies of Australian mammals, including those of external territories and territorial seas. For all the mammal taxa (about 300 species and subspecies) considered Extinct, Threatened, Near Threatened or Data Deficient, the size and trend of their population is presented along with information on geographic range and trend, and relevant biological and ecological data. The book also presents the current conservation status of each taxon under Australian legislation, what additional information is needed for managers, and the required management actions. Recovery plans, where they exist, are evaluated. The voluntary participation of more than 200 mammal experts has ensured that the conservation status and information are as accurate as possible, and allowed considerable unpublished data to be included. All accounts include maps based on the latest data from Australian state and territory agencies, from published scientific literature and other sources. The Action Plan concludes that 29 Australian mammal species have become extinct and 63 species are threatened and require urgent conservation action. However, it also shows that, where guided by sound knowledge, management capability and resourcing, and longer-term commitment, there have been some notable conservation success stories, and the conservation status of some species has greatly improved over the past few decades. The Action Plan for Australian Mammals 2012 makes a major contribution to the conservation of a wonderful legacy that is a significant part of Australia’s heritage. For such a legacy to endure, our society must be more aware of and empathetic with our distinctively Australian environment, and particularly its marvellous mammal fauna; relevant information must be readily accessible; environmental policy and law must be based on sound evidence; those with responsibility for environmental management must be aware of what priority actions they should take; the urgency for action (and consequences of inaction) must be clear; and the opportunity for hope and success must be recognised. It is in this spirit that this account is offered.

At STIAS, the ‘Health in Transition’ theme includes a programme to address the epidemic rise in the incidence of non-communicable diseases (NCDs) such as Type 2 diabetes, hypertension, obesity, coronary heart disease and stroke in Africa. The aim is to advance awareness, research capacity and knowledge translation of science related to the Developmental Origins of Health and Disease (DOHaD) as a means of preventing NCDs in future generations. Application of DOHaD science is a promising avenue for prevention, as this field is identifying how health and nutrition from conception through the first 1 000 days of life can dramatically impact a developing individual’s future life course, and specifically predicate whether or not they are programmed in infancy to develop NCDs in later life. Prevention of NCDs is an essential strategy as, if unchecked, the burden of caring for a growing and ageing population with these diseases threatens to consume entire health budgets, as well as negatively impact the quality of life of millions. Africa in particular needs specific, focussed endeavors to realize the maximal preventive potential of DOHaD science, and a means of generating governmental and public awareness about the links between health in infancy and disease in adult life. This volume summarizes the expertise and experience of a leading group of international scientists led by Abdallah Daar brought together at STIAS as part of the ‘Health in Transition’ programme.

The highly publicized obscenity trial of Radclyffe Hall's The Well of Loneliness (1928) is generally recognized as the crystallizing moment in the construction of a visible modern English lesbian culture, marking a great divide between innocence and deviance, private and public, New Woman and Modern Lesbian. Yet despite unreserved agreement on the importance of this cultural moment, previous studies often reductively distort our reading of the formation of early twentieth-century lesbian identity, either by neglecting to examine in detail the developments leading up to the ban or by framing events in too broad a context against other cultural phenomena. Fashioning Sapphism locates the novelist Radclyffe Hall and other prominent lesbians--including the pioneer in women's policing, Mary Allen, the artist Gluck, and the writer Bryher--within English modernity through the multiple sites of law, sexology, fashion, and literary and visual representation, thus tracing the emergence of a modern English lesbian subculture in the first two decades of the twentieth century. Drawing on extensive new archival research, the book interrogates anew a range of myths long accepted without question (and still in circulation) concerning, to cite only a few, the extent of homophobia in the 1920s, the strategic deployment of sexology against sexual minorities, and the rigidity of certain cultural codes to denote lesbianism in public culture.

This comparative study looks at the laws concerning the murder of slaves by their masters and at how these laws were implemented. Andrew T. Fede cites a wide range of cases—across time, place, and circumstance—to illuminate legal, judicial, and other complexities surrounding this regrettably common occurrence. These laws had evolved to limit in different ways the masters’ rights to severely punish and even kill their slaves while protecting valuable enslaved people, understood as “property,” from wanton destruction by hirers, overseers, and poor whites who did not own slaves. To explore the conflicts of masters’ rights with state and colonial laws, Fede shows how slave homicide law evolved and was enforced not only in the United States but also in ancient Roman, Visigoth, Spanish, Portuguese, French, and British jurisdictions. His comparative approach reveals how legal reforms regarding slave homicide in antebellum times, like past reforms dictated by emperors and kings, were the products of changing perceptions of the interests of the public; of the individual slave owners; and of the slave owners’ families, heirs, and creditors. Although some slave murders came to be regarded as capital offenses, the laws consistently reinforced the second-class status of slaves. This influence, Fede concludes, flowed over into the application of law to free African Americans and would even make itself felt in the legal attitudes that underlay the Jim Crow era.

Wartime Basketball tells the story of basketball's survival and development during World War II and how those years profoundly affected the game's growth after the war. Prior to World War II, basketball--professional and collegiate--was largely a regional game, with different styles played throughout the country. Among its many impacts on home-front life, the war forced pro and amateur leagues to contract and combine rosters to stay competitive. At the same time, the U.S. military created base teams made up of top players who found themselves in uniform. The war created the opportunity for players from different parts of the country to play with and against each other. As a result, a more consistent form of basketball began to take shape. The rising popularity of the professional game led to the formation of the World Professional Basketball Tournament (WPBT) in 1939. The original March Madness, the WPBT was played in Chicago for ten years and allowed professional, amateur, barnstorming, and independent teams to compete in a round-robin tournament. The WPBT included all-black and integrated teams in the first instance where all-black teams could compete for a "world series of basketball" against white teams. Wartime Basketball describes how the WPBT paved the way for the National Basketball League to integrate in December 1942, five years before Jackie Robinson broke the color barrier in baseball. Weaving stories from the court into wartime and home-front culture like a finely threaded bounce pass, Wartime Basketball sheds light on important developments in the sport's history that have been largely overlooked.

Cardozo's family ties to the Jewish community were a particularly significant factor in shaping his life, as was his father's scandalous career--and ultimate disgrace--as a lawyer and judge. Kaufman concentrates, however, on Cardozo's own distinguished career, including twenty-three years in private practice as a tough-minded and skillful lawyer and his classic lectures and writings on the judicial process. From this biography emerges an estimable figure holding to concepts of duty and responsibility, but a person not without frailties and prejudice.
